RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 418 - PINEDA AND SONS FARMS, INC. WHEREAS, the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 19th day of September, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 418 , being the property of Pineda and Sons Farms, Inc. , described as the Northwest Quarter of Section 22, Township 7 North, Range 67 West of the 6th P .M. , Weld County, Colorado, being more particularly described as follows: The Northwest Quarter of Section 22, Town- ship 7 North, Range 67 West of the Sixth Principal Meridian, Weld County, Colorado does not come within the purview of the definition of the terms, "subdivision" and "subdivided land, " pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended and Section 2-1A(3) of the Weld County Subdi- vision Regulations . The parcel of land on which this request has been made is described as the NW4 Section 22, T7N, R67W of the 6th P. M. , Weld County, Colorado. This property is located 2-1/2 miles north- west of Severance. The property contains approximately 160 acres of Class II , III and IV irrigated soils. The request is to split the property into parcels of 2. 026 acres and 156.958 acres. Pineda and Sons Farms, Inc. wishes to transfer the 2. 026 acre parcel to Richard Pineda for a home site. Richard is a full-time employee for the farm corporation. The farm corporation owns and operates several farms in the immediate area. One , an application for a permit to move and locate a double wide mobile home on one of our farms, and two , to request for a recorded exemption for a tract of land of approxi— mately 2 acres on which the mobile home will be situated. This farm is located 5 miles north of Windsor, Colo . on Hiway 257, Zmile east on Road 78,. and 8/10 of a mile north on Road 19. We have 4 other farms within a 3 mile radius of this location, totalling about 1000 acres, we also own another 160 acre farm in Lorimer county. The original farm house on this farm was in a very dilapidated con— dition, it was badly vandalized in the winter of 1978. No one had lived in the house in the last two years, when we acquired the farm. We bulldozed and burned the house down in June 1979. The double wide mobile home will be located on the same site as the old farm house. There is now on the site an existing and active water tap in use, serviced by the North Weld County Water District. The site is also supplied electrical service by the REA, and there is an existing septic tank that we intend to clean out and have inspected. The Mountain Bell Telephone Co . has a line running through the west side of the farm. The location and site of this mobile home will the principal res- idence o.f this particular farm. The owners and residents of this home will be Mr. and Mrs . Richard Pineda and their three children. Before we explain the reasons for our two requests, we would like to inform the Weld County Commissioners and the Planning Service Staff of the nature and organization of our family farm operation. In 1955 , Tony Pineda Sr. with his two oldest sons out of high school, started farming in the Windsor and Fort Collins areas. By 1958, two more of his eight sons joined the family farm operation, with two others working part time when out of school . In 1963 the family bought their first farm, north of Wellington in Latimer County. In 1966 the family farm incorporated, with Tony Sr. as President, and four sons as officers, directors, stockholders, and main labor force of the family farm corporation. From 1967 to 1978 the family bought and acquired 5 farms in the north Windsor farming area. r Today,, at the present, Tony Pineda Sr. has been semi-retired for the last three years, Mrs. Tony Pineda still performs a substantial amount of the book and record keeping for the farm operation. Four of the sons who are the major stockholders actively operate and manage the farms. One son, Richard is employed full time by the family farm corporation. Another son who is a CSU student is em- ployed part time throughout the year. Also employed part time are two grandsons and one other employee . We , Pineda & Sons have found it difficult to find experienced farm employees. Employees that are conscientious of their work, regard— less of what they are doing, employees that are experienced and with the knowledge of handling farm equipment safely. We see in the younger members .af .the- famly- all of these preferable traits, and more. We are raising and training some excellent future farmers, but we are going to have to offer them some kind of incentative to keep them here on the farm. Two other sons with an excellent experience and background in farming have left the farms to go to work in local industry or move out of the state. Richard Pineda is one of the younger sons in the family. During the time he was in school and collLe Richard worked for us part time through the year. After a tour of military duty he continued to be employed by us, but mostly on a part time basis. Richard did not have any problem finding work, and he has always managed to find good paying work, something that we eventually had to compete against. Three years ago ,gichard and his family moved into a small farm home on one of our farms. Since then we have employed him al- most full time. Richard is now 29 years old, he is a Vietnam Veteran, he applied and qualified for a VA loan to help him purchase a mobile home. We , Pineda & Sons have also given him some financial assitance to help him in the purchase of the home. We have also promised to deed him a tract of land on which to set his own home on. Richard and his family preferred to buy a mobile home over a pre-fab type constructed one ,gr to try and build one from the ground up, mostly because of the financing. Those then are our reasons for our two requests, One for the permit for Richard' s mobile home, for which he has adequate financing, and which has all the available utilities on the site. The other request for the recorded exemption, so that we can deed and transfer. ti_tle of a 2 acre tract of land to him. We sincerely hope for a favorable approval of our requests.
