As previously discussed with Bill Timmons, Ready Mixed Concrete and yourself, Planning Services will recognize the date of the recording the plats, in this instance October 6, 2010. Given this determination, activities associated with the Holton — Morton Lakes Special Use Permits, USR-1608 and USR-1682, respectively must commence on or before October 5, 2013. Box 4303 Boulder, Colorado 90306 Phone: 303.444.6602 RECEWED November 12, 2010 Mr. Kim Ogle Weld County Department of Planning Services 1555 North 17th Ave. Greeley, CO 80631-9117 RE: Holton-Morton Lakes(USR No. 1608 and 1682) Dear Kim: Bill Timmons and I want to again thank you again for your assistance over the past four (plus)years with the Holton and Morton Lakes Use by Special Review(USR)permits. Now that the plats for each property have been signed and recorded by the County, we thought it important to confirm Ready Mixed Concrete Company's(RMCC's)understanding of how the commencement of USR related activities relates to the three year USR vesting periods. Section 5 of the USR Resolutions for the Holton and Morton properties each state that the "Use by Special Review activity shall not occur,nor shall any building permits be issued on the property,until the USR plat is ready to be recorded in the office of the Weld County Clerk and Recorder." Development Standard 49 in each plat states that sand and gravel mining must commence "within three(3) years from the date of approval,"but there is no indication as to what the phrase"date of approval"is intended to modify. Since, in this case,the Resolutions preclude mining until the plats for the respective properties were, at a minimum, "ready to be recorded" by the County, RMCC believes that the "date of approval" in Development Standard 49 must be read in accordance with Section 5 of the USR Resolutions. As such, RMCC believes the "date of approval" for purposes of the three-year vesting period under Weld County Code Section 23-8-30 began October 6, 2010,the date the Holton and Morton plats were recorded. The initial three-year vesting period will conclude on October 6, 2013. Kim, while we have discussed this subject verbally, I thought it best to convey RMCC's understanding of the vesting trigger date for your files. If the County views the October 6, 2010 "date of approval"discussed above as incorrect, for any reason, please advise accordingly. Regards Michael J.
