Per Weld County's requirements, please find enclosed an executed, original, mylar Plot
Plan map for the Zeek Wells Use By Special Review#1557 to be recorded in the office of the
Weld County Clerk and Recorder by the Department of Planning Services' staff. Also enclosed
is Kerr-McGee's check(#20016433) in the amount of$11.00 to cover the recording fee.
The surveyor has provided a digital copy of the map in an acceptable format to the
Department of Planning Services at maps@co.weld.co.us.

Dear Ms. Hatch:
This letter serves as Kerr-McGee Oil and Gas OnShore LP's ("KMG") response to the
Department of Planning Services' staff recommendations for approval of USR-1557 and
provides written evidence that the following requirements have been or will be met prior to
recording the plat and/or prior to construction.
1. Prior to recording the plat:
A. The Zeek wells began producing on August 29, 2006. Because of internal controls
an APEN has not been generated as of this date. Currently the tank flash
emissions are controlled with a vapor recovery unit. An Air Pollution Emissions
Notice (APEN) is required to be filed with the Colorado Department of Public
Health and Environment by the end of October 2006. Kerr-McGee will submit
the APEN in a timely manner and a copy will be forwarded to you at that time.
B. The Mountain View Fire Protection District has reviewed and approved the Fire
and Emergency Response Plan submitted to the District by KMG and has no
objection to the drilling of the wells. KMG will comply with all applicable codes
and standards mentioned in the Fire Protection District's referral letter dated April
25, 2006.
C. The oil and gas operations access road is off of WCR 32, currently maintained by
the City of Mead. The access road is graveled and drained to maintain an all
weather access road.

In an attempt to address Mead's Town Board request that Weld County "require
the applicant to petition the Town for annexation", as stated in their referral dated
April 27, 2006:
i. The applicant, Kerr-McGee, is the mineral leasehold owner underlying the
subject lands and as such is not in a position to petition the Town of Mead
for annexation of the surface estate.
E. Weld County Department of Building Inspection
i. All necessary building permits for the production facilities were obtained
from the Weld County Building Department prior to the drilling of the
Zeek wells. All required set backs and height restrictions per the Weld
County Code have been adhered to.
F. The plat shall be amended to delineate the following:
i. All pages of the plat shall be labeled USR-1557
ii. The 20 Development Standards will be listed on the plat
iii. The plat will comply with Section 23-2-260.D of the Weld County Code
iv. A total of 30 feet from the centerline of County Road 32 shall be
delineated on the plat
G. KMG has enclosed two paper copies of the plat for preliminary approval by the
Weld County Department of Planning Services.
2. Prior to Construction
A. See comments under Section 1.E.i.
B. KMG will contact Ted Eyl at the Weld County Department of Public Works to
obtain necessary moving permits associated with oil and gas drilling.
3. Upon completion of 1. above, KMG will submit a Mylar plat with all other
documentation required as Conditions of Approval. The Mylar will be prepared in
accordance with the requirements of Section 23-3-260.D of the Weld County Code and
will be recorded in the office of the Weld County Clerk and Recorder by the Department
of Planning Services' staff. KMG will submit the Mylar plat and additional requirements
as soon as possible from the date of the Board of County Commissioners resolution.
KMG will pay the recording fee.
4. Should the Mylar plat not be recorded within 30 days of the Board of County
Commissioners resolution, a$50.00 recording continuance charge will be added for each
additional three month period.
5. KMG will request the surveyor provide a digital copy of the Use by Special Review in an
acceptable format to the Department of Planning Services at mansco.weld.co.us.

6. Per its letter dated May 16, 2006, KMG requested an early release, and or waiver of any
requisite building permits from the Weld County Building Department in order that KMG
could proceed with the drilling of the subject Zeek wells outside the final resolution of
the USR process. KMG has commenced operations at its own risk prior to the Special
Review plat being ready to be recorded in the office of the Weld County Clerk and
Recorder. KMG agrees to complete the USR approval process and conduct its future
operations in accordance with the final Development Standards per the USR-1557
Resolution crafted by the County Board of Commissioners.
