That because Applicant is submitting an application for a qualifying surface development, as defined pursuant to C.R.S. § 24-65.5-102(5.7), one of the following applies (check one): a. No mineral estate owner has entered an appearance or filed an objection to the proposed application for development within thirty (30) days after the initial public hearing on the application; _ b. The Applicant and any mineral estate owners who have filed an objection to the proposed application for development or have otherwise filed an entry of appearance in the initial public hearing regarding such application no later than thirty days following the initial public hearing on the application have executed a surface use agreement related to the property included in the application for development, the provisions of which have been incorporated into the application for development or are evidenced by a memorandum or otherwise recorded in the records of the clerk and recorder of the county in which the property is located so as to provide notice to transferees of the applicant, who shall be bound by such surface use agreements; OR • 1 c. By May 2, 2009 you will need to send letters either first class (will need receipt from post office stating the letters were sent first class) or certified mail to the mineral owners and • lessees outlining your application request. The letter needs to include the address and legal description for the property, the size of the property, the proposed use, your contact information (you can also include mine if you wish), the date of the Planning Commission hearing (June 2, 2009) and the location of the hearing (Weld County Department of Planning Services 918 10th Street Greeley CO 80631). Evidence will need to be submitted to me along with the attached form signed and notarized that this was done by May 2, 2009.
