HomeMy WebLinkAbout780802.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 329 - LAWRENCE HERTZKE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 14th day of August, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado that the property of Lawrence Hertzke, described as part of the Southeast Quarter (SEa) Section 1, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Beginning at the South Quarter corner of said Section 1; thence along the South line of said Southeast Quarter North 87°33'56" Fast 275.07 feet to the TRUE POINT OF BEGINNING; thence North O1°28'44" West 2387.03 feet to a point on the centerline of an existing 75.00 foot wide U.S.B.R. The property on which the recorded exemption has been requested is described as Pt . SE* Section 1 , T5N, R67W of the 6th P.M. , Weld County, Colorado. This property is located 44 miles west of Greeley on the north side of U.S . Highway 34. The property con- tains approximately 55. 7 acres of non-irrigated land with Class IV and VI non-irrigated soils. The request is to split the pro- perty into parcels of 1. 0 acres and 54. 7 acres . Mr. Hertzke desires to move a home onto the 1. 0 acre parcel which will be occupied by his sister and brother-in-law. The balance of the property will be under pivot sprinkler irrigation, and the ground put into a productive agricultural use. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons : 1. The request complies with the intent clause of the recorded exemption procedure in that non-productive agricultural land is proposed to be developed for a higher and more productive use which would be compatible with the surrounding agricul- tural uses in the area. 2. The request is in compliance with the intent clause of the Agricultural Zone District (Section 3. 3 A. of the Weld County Zoning Resolution) and the Weld County Comprehensive Plan in that the request will be encouraging agricultural uses as the highest and best use of the land. The City of Greeley Planning Commission has set forth no objections to this request . The property in question lies within the Comprehensive Planning Area of the City of Greeley. 4. The Department of Planning Services Staff recommendation for approval is conditional upon 75 feet north of the centerline of U. S. Weber Realty has purchased our farm along Business 34, just west of 47th Avenue. The house now located there must be moved before July 31. 2. It is too good a house to destroy. We can save it by moving it to the site 4h miles west on the Lawrence H. Hertzke land and remodelinm it into an excellent residence. 3. It will be occupied by my sister and her husband, Mr. and Mrs. C. A. Weishaupt. 4. The site under application is the south-eastern portion of the former prisoner-of-war camp and has been lying useless for years. No residence exists there now. Only this one house will occupy Lot B of the plat. No plans exist for any residence on Lot A at this time, as most of this is now agricultural. 5. The agricultural land is or will be under pivot sprinkler irrigation and the area of the intended recorded exemption is in the corner, which cannot be used under pivot sprinklers. So I do feel this is the best use of the intended land, as we never will use it for irrigated crop land. 6. We would appreciate prompt action to meet the July 31 deadline. Thank you. COLORADO 80631 PHONE (303)353.6123 August 10, 1978 Chuck Cunliffe Weld Dept. of Planning Services 915 Tenth Street Greeley, CO 80631 Dear Chuck: Re: Referrals 1) Rezoning "E" to "C" (Bliss) 2) Rezoning "E" to "C" (Bernhardt) 3) Recorded Exemption (Hertzke) 4) Recorded Exemption (Uyemura) 5) Recorded Exemption (McDonald.) 6) Special Use Permit (Geisert) On August 8, 1978 the Greeley Planning Commission reviewed and made the following recommendations : 1) Rezoning "E" to "C" (Bliss)- -The Commission recommended denial of the rezoning and suggested that City and County staffs meet to provide some overall guidance to development along 18th Street. , The Commission noted the following concerns : (a) inadequate public improvements (water, fire, sewer, street) , (b) lack of interior street and secondary access , (c) inadequate use buffers and site development controls , and (d) non-confor- mance with Comprehensive Plan which suggests commercial activity clustered near First Avenue and the cemetary. 2) Rezoning "E" to "C" (Bernhardt) - -The Commission recommended denial on the same grounds as the Bliss rezoning. 3) Recorded Exemption (Hertzke) --The Commission recommended no objection. It was requested that the applicant work with the Highway Department to ensure adequate dedication for a widened 10th Street. 4) Recorded Exemption (Uyemura) --The Commission recommended denial .. The Highway Department has recommended consolida- tion of access to a single driveway serving both parcels . 6) Special Use Permit, Mining (Geisert) --The Commission recommended > c no objections to the proposed mining operation. Staff expressed concern for adverse impacts of flood water diversion onto City property. We ask for your consideration of the following comments. 1 . The State Highway 34 right of way on the north side of the highway centerline is approximately 53 feet. The 40-foot right of way shown on the exemption map is apparently measured from the section line, which does not coincide with the center of the highway. We ask that a total of 75 feet north of the centerline be protected by setback, reservation, or dedication (preferably the latter) as local zoning laws and regulations permit. 2. A permit will be required if a new driveway is required as a result of moving this house. If the house is to be moved on a State Highway, an illegal load permit will also be required. After approval of this exemption, application for the Driveway Permit and the illegal load permit should be made to David N. Fraser, District IV Maintenance Superintendent, Colorado Division of Highways, P. 0. Box 850, Greeley, Colorado 80632. 3. We have no objection to the request for a 30-foot lot width variance. However, the location of any new driveway on S.H. 34 will have to be reviewed in light of its proximity to existing driveways.
