Condition 1 D. APEN-The applicant has submitted information re: condensate storage tanks receiving greater than 730-bbl. The regulations require the applicant to file an APEN 30 days after the 1st production report indicates the condensate tank exceeds 730-bbl. Copies of the APEN will be forwarded on when this occurs. Since the applicants need to record the plat before production can occur this response is reasonable. Condition 1D is approved and can be removed. Conditon 1 E. Aboveground Storage Tanks-The production facility tanks are regulated by the COGCC. This condition does not apply to oil & gas production facilities and can be removed. Condition 1F.Stormwater Discharge Permit-Oil & Gas Production facilities are not required to obtain a stormwater permit at this time because of a feasability/economic study by EPA &the State. The rule has been delayed until March 2005. This condition can be removed. Condition 1G. Waste Handling Plan-The applicant's response is that no chemicals will be stored on site. The applicant has received approval from the Board of County Commissioners for USR-1462 (April 7, 2004) and USR-1467 (May 12, 2004). The plats remain the unrecorded documents of record. Flood Hazard Development Permits (FHDP-468, FHDP-469 and FHDP-471 remain outstanding awaiting return of referral comments. Staff foresees no issue pertaining to the Flood Hazard Development Permits as a No-Rise Certificate was included in the application materials. Given the circumstances surrounding this land use application, staff recommends allowing the applicant to obtain an early release of the building permits for the identified wells. End Memorandum. Prima requests this early release as we currently have a rig that will be ready to drill these wells in the next couple of weeks. If we are not allowed to drill these locations, we will have to pay stand-by time of$8,300/day. Therefore, we appreciate anything you can do for us.
