RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#1228-LOUIS AND GINA
FABRIZIUS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #991137, dated June 3, 1999, the Board approved Use by
Special Review Permit#1228 for a Fishery in the A(Agricultural)Zone District for Jerry and Jeannie
Bess on the following described real estate, to-wit:
Part of the E1/2 of Section 8, Township 7 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from current owners, Louis and Gina
Fabrizius, P.O. Box 429, Eaton, Colorado 80615, to vacate said Use by Special Review
Permit#1228, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Department of
Planning Services and all of the exhibits and evidence presented in this matter and, having been
fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1228 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 15th day of March, A.D., 2010.

SUBJECT: Vacation of USR-1228
The Department of Planning Services has received the attached letter dated February 11, 2010
from Louis and Gina Fabrizius requesting that USR-1228 for a fishery in the Agricultural Zone
District be vacated because the property is no longer used as a fishery.
Background information:
Legal Description: Pt E2 of Section 8, T7N, R65W of the 6th P.M., Weld County, CO.
Location: North of Hwy 14 and west of and adjacent to CR 41
USR-1228: USR-1228 was approved by the BOCC on June 30, 1999, for a fishery in
the Agricultural Zone District.
