LUPTON, COLORADO 80620 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 29 , 1978 at 2 :00 p.m. , the Board of County Commissioners of Weld County, Colorado held a hearing to consider the request of Stan Rech, Box 303, Ft. Lupton, Colorado 80620 for an amendment to Special Use Permit No. 348, which hearing was continued on December 18 , 1978 at 11: 00 a.m. , and WHEREAS, the applicant has requested an amendment to Special Ilse Permit No. 348 for an oil field disposal site on a tract of land described as follows: That part of the West one-half of the Southwest one-quarter of Section 22, 'Itmnship 2 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, described as: Beginning at the Northeast corner said West one-half Southwest one-quarter; Thence S 00°04'13" W on an assumed bearing along the Fact line said West one-half South- west one-quarter, a distance of 792.00 feet; Thence S 89°49'25" W parallel with the North line said West one-half Southwest one-quarter a distance of 330.00 feet; Thence N 00°04'13" E a distance of 792.00 feet to a point on the North line said West one-half Southwest one-quarter; Thence N 89°49'25" E along said North line a distance of 330.00 feet to the point of beginning. WHEREAS, the Board reviewed the testimony of the applicant and of all others present, and reviewed the recommendations of the Weld County Planning Commission, and having been fully informed, is satisfied that the request for an amendment to Special Use Permit No. 348 should be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Special Use Permit No. 348 be, and hereby is , amended for an oil field disposal site as set forth in the recommendation of the Weld County Planning Commission 780229 I and subject to the Development Standards , with the following amend- ments , contained in the Special Use Permit: 1. Amend -Development Standard Number 1 by the -addition of the following: (d) 10 foot wide , 350 foot long fresh water and gel pit 2. Delete the present Development Standard Number 8 as now shown on the plans and replace it with the following: The Special Use Permit shall be limited to the plans shown hereon and governed by the Develop- ment Standards stated above and all applicable Weld County regulations. Any material devia- tions from the plans and/or Development Standards as shown or stated above shall require the approval of another Special Use -Permit before such changes shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . Today, John Hall, Weld County Environmental Health Director, was present and made his report. Mr. Rech canted on said report. Kenneth Lind, Legal Counsel representing Mr. Adolph Anderson, was present and listed their concerns. After study Carmissioner Jacobucci made a notion to approve this amendment to Special Use Permit No.348, Oil Field Disposal Site, with the stipulation that 1 evelopment Standard Number 1 be amended by the addition of the following: (d) 10 foot wide, 350 foot long fresh water and -gel pit, Delete the present Development Standard Number 8 as now shown on the plans and replace it with the following: The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County regulations. Any additional effluent to be discharged to the leach field (from additional tanks) would in all probability over-load the field. In fact, the leach field may already be overloaded. The appearance of the soil over, and adjacent to the field was crusted and had a saturated look. 2. To this date, I have had no clear-cut definition of "gel-water", or its chemical make-up. If indeed it is fresh water with traces of bentonite, as related to me by Stan Rech, then this opera- tion (gel pit) would have no significant impact on the environment. On the other hand, some types of "gel water" can have significant amounts of acid and other detrimental chemicals (conver- sation with the Oil and Gas Commission) . To summarize my thoughts I feel the members of the planning commission must satisfy their own minds that this "gel water" disposal operation is indeed nothing more than water with traces of bentonite. Due to prior committments I will be unable to attend your next meeting October 3, 1978. Most of our reasons for protest were stated in my last letter; and I realize that some of my statements don't really have anything to do with the issue. However, I think it is important to remember that the Planning Commission and the County Health Department originally disapproved this permit solely on the grounds , as I understand it, that the means of disposing of the salt water as employed by the applicant, Stan Rech, was not feasible or workable. I think the results of this method speak for themselves . The land around the disposal is saturated with water, salt, and who knows what else. The farmer that also protested didn' t call it "alkalai flats" for nothing. Our point is , why enlarge something that, first of all , doesn' t work and, secondly, that isn't needed due to the availability of other methods of salt water disposal in the immediate area. Weld County Disposal , Inc. , is also in the business of disposing of salt water from drilling operations and production. As a matter of fact ours was the first such facility in Weld County. Our permit was granted on December 22, 1976, after meeting extensive and very restrictive requirements set forth by the Weld County Health Department, Planning Commission, and County Commissioners. After expenditures of almost $200,000.00, we began operation. Our method of disposing of salt water was through evaporation of salt water in open pits. We were required to build three pits, two which were required to be covered with wire which obviously required extensive use of steel pipe for support. As a result of our operation the salt water becomes pure enough it can be used safely for irrigation purposes out of the one sealed pit that holds the water. The other two sealed pits, which are covered with wire, are where the wate material is concentrated. We were also required to build a house on the premises to house our manager, and his family, who is on call 24 hours a day to watch over the facility. This method of disposing of salt water was deemed by the Weld County Health Department to be the most effective method of disposing of waste water. Since we were the only disposal in the county we were required to build our facilities to accommodate up to six trucks at a time. This was felt to be sufficient to adequately take care of the county's salt water disposal needs. We began operations in April , 1977, and have always easily accommodated all of the trucks using our facilities. The three pits we dug were of sufficient capacity. In addition we were required to select a site approved by the Health Department and the site could not be less than 40 acres in size. Since we have been in operation we have had absolutely no complaints about our method of disposing of the water. We also have sufficient land to dig more pits if it should become necessary. We are also only a short distance from a paved road making our facility easily accessible to trucks and on roads J which can accommodate heavy trucks without tearing up the road. Approximately one year after granting our permit the person who is requesting this modification applied for and received a temporary special use permit to dispose of salt water. He received the permit in spite of a negative recommend- ation by the Health Department and the Planning Commission. The request for and granting of this permit was not known by anyone connected with our facility until it had been granted. After I discovered the permit had been granted I talked with several people in the Weld County government. One person, a county engineer, flatly stated that their method of disposing of salt water was clearly inferior to ours. In addition, many of the expensive restrictions imposed on us were not required of the new facility. Their facility is only half the size of ours . Also they were not required to build a house since they were not required to have anyone on 24 hour call . Their method of disposing of the salt water, by injecting it into the ground, is an undesirable and probably an unworkable method. To get to their facility required traveling several miles on unpaved roads that are not capable of withstanding the heavy trucks . We were required to make a considerable investment in our facility to satisfy county requirements. Considerably more than the other facility. However, now, because of the other disposal site, our water disposal income has been virtually cut in half. Our investment, as it turns out, was not a wise one. Incidenally, in obtaining their permit the other facility neglected to mention that there was already another disposal in the county, and, after talking with one of your commissioners last spring, I discovered that they led the County Commissioners to believe that there was no other such facility. I know that I have rambled alot, but it has been in an effort to give you some background into the history of these disposals . However, the point of the matter is that the request should be denied on two very sound grounds. Number One - It is not needed. Number Two - It is an ineffective method of disposing of salt water. This expansion is not needed because I can guarantee you we have ample facilities to dispose of all the salt water that needs to be disposed of. We are only operating at about one-fourth of our capacity now because of the other facility, even through we still have a man there 24 hours a day. The salt water disposal capacity that is available now is clearly more than sufficient for many years , if not forever. The requesting facility 's method of disposing of salt water by injecting it into the ground can have very bad environmental results. Any method that looses salt water, waste oil , and other waste matter into the earth is by its very nature undesirable. You might as well put it in the ground at the well site as do this . I believe if you will check with your health and engineering staff they will confirm, as they have to me, my objections and accusations . Mr. Hiatt expressed concern with the feasibility of property line monitoring wells being placed there now for water quality and results from the tests . John Hall of the Weld County Health Department responded by stating that tests have been conducted on local domestic wells in the area and have fairly good data on them. These tests were taken at the request of the County Commissioners . These wells will most likely be monitored on a six month to a year basis for current data. Mr. Kiefer questioned what would he the effect of adjacent property on the surface. There is a slight fire hazard involved and a slight chance of explosion with this business , however, Mr. Birmingham said a sprinkler system will be utilized. There would be three separate buildings - one for a warehouse for storing, one for solvent blending equipment and one for a ship and office building. Tom Honn then read the staff ' s recommendation for denial of the proposal . Mr. Otis asked what the potential danger was for explosion of the chemicals and the hazards involved. Don Marvin , Fire Chief of the Longmong Fire Protection District , said he could not approve of this proposal with only a sprinkler system installed. He recommended that a fire protection system be utilized. Some general discussion followed regarding the fire hazard danger involved with the proposed facility. Carolyn Bulthaup presented a petition to the Planning staff with 37 signatures of people in opposition to the request . She also commented that there is a fire hazard involved with trains that throw sparks. There are oil wells in the area that vent natural gas which could be ignited from the sparks . Shirley Koch expressed the same concern . Don Marvin also stated this was a real problem. Mr. Birmingham stated he would be supportive of the recommendation by Mr . It is the opinion of the Department of Planning Services Staff that .sufficient evidence has not been presented by the applicant to fully evaluate this request. Several questions remained unanswered concerning the proposed amendment which includes the additional placement of 6 storage tanks and a gel water pit on the property. The basic questions which remain unanswered include the following: What effect will the operation, as now proposed, have on the immediate area? Its effect upon the future development of the area? Its effect upon the health, safety, and welfare of the in- habitants of the area and the county? Although it appears that the requested amendment does not substantially differ from what was originally approved by the Board of County Com- missioners on April 12, 1978, two separate issues arise which were not under consideration when, the original request for the Special Use Permit was made. It is the opinion of the Department of Planning Services Staff that the applicant has not adequately addressed these issues in the present application materials or in oral statements made prior to and at the previous Planning Commission Meeting. These questions which remained unanswered with regard to the "gel water" disposal are: 1. What will be the quality of the gel water being disposed of at the proposed facility? 2. Does water of this quality have a potential of contaminating the surface and subsurface? 3. Is the procedure being proposed for gel water disposal (open pit ) a reliable, effective and environmental safe method to use? With regard to the additional six tanks being requested: 1. This control regulation pro- vides as follows : go person shall construct or operate a subsurface disposal system within the State of Colorado unless such person has a currently effective permit . for such construction or operation issued by the Division pursuant to this section. This activity is also a violation of C .R . S . 1973 , 25-8-505 ( 1 ) , which prohibits underground disposal of toxic I or hazardous waste unless the Water Quality Control Commis- sion has made certain findings as enumerated in the statute. and the Division has issued a permit . The purpose of the inspections was to determine if the oper- ation and facilities were in compliance with the Development Standards which were approved at the time your Special Use Permit was approved. The on-site inspection revealed what appears to be 2 major violations of the Development Standards' approved by the Board of County Commissioners . The first being 2 oil storage tanks in addition to what the approved Development Standard #1 limited the operation and facilities to. Secondly, you have constructed a "V" shaped trench approximately 250-300 feet in length, 6-8 feet in depth and 10-12 feet in width. The sign which is posted next to the trench and reads "Gel Water" would seem to imply you intend to dispose of Gel Water in the trench. The trench is not identified under Development Standard #1 on the Special Use Permit plan. It is the opinion of the Department of Planning Services Staff that the two additional oil storage tanks and the con- struction of the Gel Water disposal trench constitutes a change to the Special Use Permit plans and therefore, does require the approval of another Special Use Permit before these facilities are permitted. Lupton S Agricultural W Agricultural COMMENTS : I observed four oil storage tanks located on the Special Use Permit area. There were three tanks standing vertically, one lying horizontally. Two earthen pits are constructed according to the Special Use Permit plans. The west pit is partially covered with metal framing apparently to be used for the wire mesh to protect wildlife fowl . The pits appear to have been in operation. The west pit contained evidence of some kind of oil resi- due, Several small pools of the residue are present in the bottom of the pit . It would appear that the pits are not sealed and that there is some seeping into the ground. It appears the leaching field has been constructed and the ground cover replaced over it . Access to the Special Use Permit site appears to be in accordance with the Special Use Permit plans. In addition , there is a "V" shaped trench which appears to be at least 300 9 Stan Rech SUP-348 :77: 22 June 9, 1978 FOLLOW-UP FIELD CHECK feet long, 6-8 feet deep, and 10-12 feet wide. A sign which reads "Gel Water" is posted next to the trench. It appears that nothing has been placed in the trench at this time. Also, there is a 6 foot plus square portable building located in the southwest corner of the Special Use Permit area. No pictures were taken at the time of this inspection. No contact with the property owner was made. As a part of the consideration hereof, lessor agrees to provide and maintain adequate ingress and egress to the one-third (1/3) acre tract of land by means of an adequate access road to be constructed and maintained by lessor , its successors and assigns . As an additional consideration lessee agrees to pay unto the lessor a consideration of ten cents ($ . 10) per barrel for each forty two gallon barrel of water delivered unto lessor and 31 Disposal at the delivery point after treatment by lessee for removal and recovery of excess oil at lessee' s facility on said one-third (1/3) acre tract. Lessee shall have the right to install a meter on its water storage facility to record the barrels of water delivered by lessee to lessor and 31 Disposal at the delivery point. For a period of sixty (60) days following the termination of this agreement the lessee shall have the right to remove all of its facilities, structures, equipment and property installed on the one-third (1/3) acre tract of land and lessee agrees to restore the surface of said land as nearly as possible to its original and normal contour . Lessee shall have the right but not the obligation to fence in the one-third (1/3) acre tract. Lessor agrees to indemnify, protect and save the lessee, its successors and assigns, harmless from any alleged claims, demands, causes of actions or damages, or any allegations -3- a whatsoever brought against the lessee by third parties by reason of alleged pollution of fresh water sands, destruction to vegetation or animal life or any other pollution alleged to grow out of or to be caused by the improper operation and maintenance of the 31 Disposal system after delivery of the produced water to lessor and 31 Disposal at the delivery point. There were several men at the site , o„L of which pointed out to me that the 3 tanks located directly west of the pits belonged to Amoco and not Rech. Pictures #1 and #2 will show these tanks. Picture #3 will show the 3 vertical tanks and 1 horizontal tank situated directly south of the pits. Pictures #4, #5, and #6 show the 2 pits which are located directly north of the 3 vertical tanks. The pit farthest to the west has pipe over the top. Picture #4 indicates the trench is directly beyond the uncovered pit in the background. Picture #7 shows a very small metal frame structure located southwest across the driveway from the pits and tanks_ Picture #8 was taken due to suggstun of one man I spoke to while on the _site- The field directly south of the aforementioned disposal site, accord .ng to this man, was the location of Rech' s previous disposal site. This photo shows how land has been restored.
