RE: APPROVE REQUEST TO MODIFY DEVELOPMENT STANDARD #9 OF SECOND
AMENDED USE BY SPECIAL REVIEW PERMIT #247 - LAFARGE NORTH
AMERICA, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 24, 1974, the Board of County Commissioners approved the
application of Greeley Sand and Gravel Company,for a Site Specific Development Plan and Use by
Special Review Permit#247, for open-pit mining and materials processing, and
WHEREAS, on November 4, 1987, the Board of County Commissioners approved the
application of Greeley Sand and Gravel to amend Use by Special Review Permit#247 to add an
asphalt batch plant and to update the extraction schedule, and
WHEREAS, on September 11, 1996, the Board of County Commissioners approved the
application of Western Mobile Northern, do John Pinello,fora Site Specific Development Plan and
Second Amended Use by Special Review Permit#247 for a wet sand and gravel mining operation in
the A (Agricultural) Zone District, on the following described real estate, to wit:
A tract of land located in Sections 34 and 35, Township 6 North,
Range 66 West of the 6th P.M., Weld County, Colorado
WHEREAS,through 2ndAmUSR#247, Development Standard#9 was approved,to read as
follows:
"Hours of operation shall be from 6:00 a.m. to 10:00 p.m."
WHEREAS,on August 16, 2010,the Board of County Commissioners held a public hearing
for the purpose of hearing the request of Lafarge North America, Inc., 925 North 35th Avenue,
Greeley, Colorado 80631, to modify Development Standard#9 of Second Use by Special Review
Permit#247, to read as follows:
"Hours of operation shall be from 5:00 a.m.to 10:00 p.m. Hours may
be extended beyond this timeframe with written notification provided
to the Department of Planning Services."
WHEREAS,the Board of County Commissioners heard all the testimony and statements of
those present studied the request of the applicant and the recommendations of the Weld County
Department of Planning Services and, having been fully informed, finds Development Standard#9
shall be amended, as requested.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Development Standard #9 of 2nd AmUSR #247, on the hereinabove
described parcel of land be, and hereby is, amended as follows:
"Hours of operation shall be from 5:00 a.m.to 10:00 p.m. Hours may
be extended beyond this timeframe with written notification provided
to the Department of Planning Services."
BE IT FURTHER RESOLVED that all other Conditions of Approval and Development
Standards for 2nd AmUSR #247, included in Resolution #961583, approved on September 11,
1996, remain in full force and effect.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 16th day of August, A.D., 2010.

• RE: Lafarge Gravel Operation located at 35th
COLORADO Avenue and "F" Street.
On Monday August 16,2010 the Commissioners will be hearing a request from Lafarge concerning a
modification to 2AmUSR-247 (AKA Western Mobile). More specifically,the request is to modify
Development Standard No.9 regarding the hours of operation. The current hours of operation at the
pit mentioned herein are from 6:00 A.M. to 10:00 P.M. Lafarge is requesting to extend the hours
from 5:00 A.M. to 10:00 P.M. In addition,Lafarge would also like to request that the pit be open for
extended hours beyond the specified time to accommodate special projects,e.g.projects that require
24-7 demand on a short-term basis. The latter request will require notification,in writing,and within
a reasonable time, to the Planning Services Director who will either approve or deny the request.
At the request of Planning Staff, Lafarge hosted an open house and notified all property owners
within 500 feet and to surrounding subdivisions not within 500 feet,but within close proximity. The
open house was held from 7:00 A.M.to 8:30 A.M. on Monday August 2'"on Lafarge's property.No
surrounding property owners were in attendance. As a result, staff required Lafarge to send out
additional letters to surrounding property owners to notify them about the BOCC hearing date and
time which was mailed via first class postage on Friday, August 6, 2010.
As of August 12,2010 staff has received one compliant from a Weld County resident regarding the
proposed change in hours of operation who lives in a nearby subdivision. Staff hereby recommends
approval of the change in hours of operation and to modify development Standard No.9 to now read
"5:00A.M. to 10P.M."

Lafarge respectfully requests a modification to Development Standard 9, "Hours of operation shall be

Planning Services."
This request is being made to accommodate our customer's requests so that we can remain competitive.
Concrete is a perishable product that is reactive to heat and humidity. In order to provide a quality
product during the coolest part of the day, Lafarge needs to be able to deliver our products early in the
morning. When the original permit was granted, the production requirements were not as demanding as
in today's business climate. Lafarge's production schedule can be determined by specifications or
project requirements implemented to reduce safety hazards to the public.
Attached to this letter is a 500' Surrounding Property Owner Affidavit dated July 15,2010. As we have
been contacted by a resident in the River View Subdivision, each resident was been added to this list.
A meeting was held on Monday, August 2, 2010 from 7 — 8:30 a.m. at the Greeley 35th Avenue site.
The attached invitation to this meeting was mailed on July 27, 2010 to all on the mailing list, including
residents of the River View Subdivision. Weld County Planners, Kim Ogle and Tom Parko attended
the meeting. No other invitees were present.

Lafarge has been operating a Gravel Mine as well as Ready-Mix Concrete and Asphalt Batch Plants at
our 35th Avenue site since 1986 (Western Mobile). Prior to our ownership, Cowan Construction
operated the Mine since the 1970's.
Lafarge will be requesting a one-hour extension to our Hours of Operation to the Weld County Board of
Commissioners. Our current hours of operation are 6 a.m. - 10 p.m. We will request a 5 a.m. - 10 p.m.
time frame to accommodate our customer's needs.
You are being sent this notice as you are either a property owner within 500 feet of the parcel
containing the batching operations or you are a resident of the River View Subdivision. Prior to
making a request to the County, Lafarge would like to hear from you. Lafarge representatives will be at
the 35th Avenue site on Monday, August 2 from 7 — 8:30 a.m. and hope to see you there. We would
like to get your input prior to submitting a formal application to Weld County.
We are located on the west side of 35th Avenue, south of the Poudre Trail and north of F Street. Please
enter the site and park on site south of the entrance. Light refreshments will be provided.
