RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 52 - COAKLEY COWHERD.
rn WHEREAS, the Board of County Commissioners of Weld County,
r- Colorado, pursuant to Colorado statute and the Weld County Home

CD Rule Charter, is vested with the authority of administering the
,-..l affairs of Weld County, Colorado, and
e WHEREAS, the Board of County Commissioners of Weld County,
a° Colorado, has reviewed the request of Coakley Cowherd for an

exemption from the definition of "subdivision" and "subdivided

land" in Section 30-28-101 (10) , CRS 1973, as amended, and
Section 2-1 of the Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that
Coakley Cowherd is the owner of Part of the Southwest Quarter
of Section 28, Township 6 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, containing 1. 799 acres more or less.
Mr. Cowherd desires to separate this 1. 799 acre parcel which
contains the existing onion and farm machinery storage building
from the remainder of his contiguous property so that he can
transfer title to his son. Said parcel, being more particularly
described as follows, is not to be utilized as a residential
site.
Part of the Southwest Quarter (SW/,) of Section
28, Township 6 North, Range 65 West of the 6th
P.M. , Weld County, Colorado, being more particu-
larly described as follaas:
Beginning at the Southwest Corner (SW Cor) of said
Section 28, and considering the West line of the 5Wi
of said Section 28, as bearing North 00°00'00" East,
with all other bearings contained herein relative
thereto;
Thence North 00°00'00" East, along said West line,
539.37 feet;
Thence North 90°00'00" East, 30.00 feet to the True
Point of Beginning;
Thence continuing North 90°00'00" East, 248.00 feet;
Thence North 00°00'00" East, 309.00 feet;
Thence North 85°26'46" West, 113.40 feet;
Thence South 90°00'00" West, 135.00 feet;
Thence South 90°00'00" West, 318.00 feet to the True
Point of Beginning.
Said described parcel of land contains 1.799 acres,
more or less, and is subject to any rights-of-way or
other easements as recorded by instruments of record
or as naa existing on said described parcel of land.

WHEREAS, the Board of County Commissioners finds that
the intent of the applicant to separate this 1. 799 acre parcel
from the remainder of his contiguous property does not con-
flict with the intent of the Weld County Comprehensive plan,
and will not have an adverse impact on the existing use of
the land, and
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the 1. 799 acre
tract of land owned by the applicant, as described above, be,
and hereby is, declared to be exempt from the definition of
"subdivision" and "subdivided land" as set forth in Section
30-28-101 (10) , CRS 1973, as amended, and in Section 2-1
of the Weld County Subdivision Regulations, and further finds
that siad 1. 799 acre tract shall be considered a single lot.
BE, IT FURTHER RESOLVED by the Board that the remaining
tract of land owned by the applicant, Coakley Cowherd, being
described as a parcel of land located in the Southwest Quarter
of Section 28, Township 6 North, Range 65 West of the 6th
P.M. , Weld County, Colorado, be, and hereby is , declared to
be exempt from the definition of "subdivision" and "sub-
divided land" as set forth in Section 30-28-101 (10) , CRS 1973 ,
as amended, and in Section 2-1 of the Weld County Subdivision
Regulations, and further finds that said parcel is also con-
sidered as a single lot.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 19th
day of December, A.D. , 1977.

Description of property to be exempted under Section 2-la (3) of
the Weld County Subdivision Regulations is contained in the attached
legal description and plat, said property containing approximately
1. 799 acres.
Location of Property on Weld County Road #41, north of Weld County
Road #64 .
Current Use: The property currently is used for the storage of
ensilage in high moisture pits and for onion storage in a currently
existing steel warehouse.
Current Zoning: A-I Agricultural Zoning District. This zoning
was changed upon Mr. Cowherd' s application on August 4 , 1976 from
Estate to the current zoning to permit the construction of the
onion warehouse.
Property History: The application has owned the Southwest Quarter
of Section 28, Township 6 North, Range 65 West since December 28 ,
1937. He still owns this entire portion except for two parcels,
each approximately four-tenths of an acre, which are located
approximately 857 feet north of Weld County Road #64 on Weld
County Road 41. Both properties were deeded out on April 30, 1962 .
One parcel is owned by Katherine Cowherd, the applicant's wife,
and upon which is the home of the applicant and his wife. The
other parcel is owned by the applicant' s daughter and son-in-law.
The remainder of the quarter section is farmed by Robert Cowherd
as lessee.
Reason for Application: It is the applicant' s desire to transfer
the above described parcel to his son, Robert Cowherd, who leases
the quarter section and who is involved with the applicant in farming
the land. The farm is basically a family operation and would continue
to be operated as such.
In August of 1976 , the applicant had the property in question
rezoned from E-Estate to A-I Agricultural Zoning District. This
was done to permit the construction of a steel storage shed to be
used in storing onions . The building was constructed by Robert
Cowherd who owns and operates the building under his lease. The
applicant wishes to transfer legal ownership to the land upon
which the structure sits to Robert Cowherd.
If the exemption is granted, the use of the property would
remain the same. It is not the intent or the purpose of the
applicant or his son to evade the zoning or subdivision laws of
this County. The applicant and his son expressly disclaim any
intent to use the exempted parcel as a lot for a residence. The
property currently has electrical service, and no additional utilites
will be required.
By granting this application, the orderly, efficient and
integrated development of the area would not be frustrated. The
land would be put to its ' highest and best use consistent with
its ' current zoning, and it would not be contrary to the interests
of the public to grant this exemption.
