HomeMy WebLinkAbout20100030.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 6, 2010 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, January 6, 2010, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner William F. Garcia Commissioner David E. Long Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Controller, Barb Connolly MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of January 4, 2010, as printed. Commissioner Long seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Long moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated Bruce Barker, County Attorney, filed the County's Notice of Status yesterday for the Air Quality Control Commission meeting to be conducted on March 18, 2010, at Island Grove Park in the City of Greeley. He stated the meeting is scheduled for 9:00 a.m.; however, the Board requested the meeting to be scheduled in the evening, in order to allow more members of the public to be able to attend. He stated the Metropolitan Planning Organization (MPO) will be meeting tomorrow evening and he will inquire as to why the Air Quality Control representative on the MPO chose not to support the MPO's request to delay the Air Quality Control Commission hearing. Commissioner Conway stated there will be a meeting on Friday afternoon to discuss the resettlement of immigrants, and Paul Stein, Lutheran Family Services, various elected officials, and members of the community will discuss the unmet needs of the immigrant population. Minutes, January 6, 2010 2010-0030 Page 1 BC0016 ,aj / ID Commissioner Garcia stated he participated in his first meeting as the Commissioner Coordinator for the Department of Public Works with the Director, Pat Persichino, and he learned there has been more snow plowed in this winter cycle than in the years 2006 and 2007, which were years with particularly high levels of snowfall. He commended the Department for doing a great job of keeping the roads clear. Chair Rademacher stated he attended a meeting with Senator Michael Bennet last Monday where he was able to express his opinions regarding how the lack of regulations being applied to the agriculture and dairy industries will hamper the County in the future. NEW BUSINESS: CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY AND APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES: Barb Connolly, Controller, stated construction equipment was submitted for replacement throughout the year 2009, and the replaced equipment will be auctioned by Roller and Associates at the Adams County Fairgrounds on January 13, 2010. Commissioner Garcia moved to declare certain equipment as surplus property and approve sale of same at auction with Roller and Associates. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. PLANNING: CONSIDER PARTIAL RELEASE OF COLLATERAL CONCERNING LONG-TERM ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT AND AMENDED LONG-TERM ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT (COUNTY ROADS 30, 32, AND 43) FOR USE BY SPECIAL REVIEW PERMIT #1614 - SEMCRUDE, LP: Richard Hastings, Department of Public Works, stated the facility is located at the northwest corner of the intersection of County Roads 30 and 49. Mr. Hastings stated the improvements included acceleration, deceleration, and turn lanes on County Road 49, and the intersection has become much safer for the travelling public as a result of the improvements. He stated there will be a one-year warranty period for the off-site improvements and the Departments of Public Works and Planning Services recommend the partial release of the collateral. In response to Chair Rademacher, Mr. Hastings stated the amount of the collateral to be retained for the warranty period is $27,000.00, and $153,000.00 will be released. Commissioner Conway moved to approve said partial release of collateral for Use by Special Review Permit #1614. Seconded by Commissioner Garcia, the motion carried unanimously. CONSIDER REPLACEMENT COLLATERAL CONCERNING IMPROVEMENTS AGREEMENT FOR PRIVATE ROAD MAINTENANCE FOR USE BY SPECIAL REVIEW PERMIT #1614 - SEMCRUDE, LP: Mr. Hastings stated this collateral is for the same facility as the last item of business; however, it is for on-site improvements, which include roadways and detention ponds. He stated staff is requesting that the full amount of the collateral be retained by extending the termination date of the bond, since there are several outstanding items which need to be corrected, including a fence which was built in the County right-of-way on County Road 30. He stated SemCrude, LP, agreed to the County retaining the full collateral amount and when the outstanding items are corrected, staff will recommend partial release of the collateral. Commissioner Kirkmeyer moved to accept said replacement collateral for Use by Special Review Permit #1614. Seconded by Commissioner Long, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
