Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: N 25th Ave is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of- way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1- 90), the required setback is measured from the future right-of-way line. REQUIREMENTS: The applicant shall utilize the existing accesses to the site. No new accesses will be granted. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become •tablished as a result of the proposed development, the applicant/landowner shall be responsible for controlling the xious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. FLOOD HAZARD DEVELOPMENT STANDARDS: This area IS in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). All of the property lies in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency Management Agency (FEMA). This SFHA is delineated on the current effective Flood Insurance Rating Map (FIRM), panel numbers #080266 1528E and #080266 1529E, dated June 10, 2005. Portions of lots located in the current effective FEMA 100-yr floodplain may not be buildable. A large portion of the property is within the floodway. Weld County Code prohibits the construction of buildings within the floodway. The applicant has indicated that no new structures or grading is to take place; if, in the future, the property owner proposes to construct any type of building or place fill within the FEMA designated floodplain, a FHDP will be required showing that the proposed activity is not located within the floodway (Planning Policy No. 2010-07). Additionally, the FHDP application must show that the development activity is in compliance with all floodplain regulations in effect at the time of application. Please show and label on the plat the 2003 Army Corps of Engineers Study floodplain and floodway boundaries. Please add the following notes to the Plat: 1. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: WCR 22 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Our most recent traffic count for this portion of WCR 22 was taken in April 2009 and showed an MDT of 1209. • Site Plan: The applicant will utilize an existing access off of WCR 22. The security gate is shown far enough off of the roadway to allow trucks to completely exit the County road before stopping to open the security gate. The access drive is shown as being surfaced with recycled asphalt. 1. The applicant must provide access for the existing oil and gas access road through the property. The Weld County Code, Oil and Gas Policies (Sec 22-5-100. B. 3.) states "Existing service roads should be used to provide access for oil and gas and other mineral extraction activities." 2. The access drive shall be surfaced with gravel, recycled asphalt or the equivalent and shall be graded to prevent drainage problems. 3. There shall be no staging of vehicles/trucks on Weld County roads. 4. The security gate is shown within the future right-of-way for WCR 22. If, in the future, WCR 22 was to expand the applicant would be responsible for moving the security gate outside of the right-of-way. 5. Title: • -9- a MEMORANDUM wiI TO: Kim Ogle, Planning Services CFROM: Lauren Light, Environmental Health SUBJECT:USR-1746 Polar Gas Front Range COLORADO DATE: 6/30/2010 Environmental Health Services has reviewed this proposal for propane storage. The site will consist of eleven 30,000 gallon storage tanks at full build out. There will not be any full time employees located at the facility. Drivers will access the property to fill their propane trucks as well as replenish the storage tanks. The application does not propose any sanitary facilities for drivers and indicates they will be on site for approximately 45 minutes. The Environmental Health Department consistently requires permanent water and sanitary facilities for facilities that operate on a full time basis. • It is the policy of this Department that portable toilets are only allowed when a use is temporary or seasonal for a time period of six months or less. This Department will require the installation of a permanent restroom facility. The installation of the restroom will require a septic permit through this Department. As this is a commercial facility the septic system must be designed by an engineer and approved by the Board of Health. A composting toilet would be acceptable. A waste handling plan is required and should include the name, address and phone number of the waste removal and disposal companies. The plan should indicate how any waste associated with the facility, such as trash from truck drivers, is contained and disposed of. A dust abatement plan, for on-site dust, is required. Noise will be restricted to the level allowed in the commercial zone district. • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. Evidence of an application submitted to the Colorado Department of Labor and Employment Division (CDL&E), Oil and Public Safety in accordance with the Liquefied Petroleum Gas (LPG) rule 7 ccr 1101-15 (Effective September 1, 2005) shall be submitted to Environmental Health Services, Weld County Department of Public Health & Environment. Alternately, the applicant can provide evidence from the CDL&E, Oil and Public Safety Section that they are not subject to these requirements. 3. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the CDL&E, Oil Inspection Section that they are not subject to these requirements. • 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend the following requirement be met prior to operation: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. • 2 We recommend that the following requirements be incorporated into the permit as • development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved waste handling plan, at all times. 5. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14), as applicable. • 6. The applicant shall comply with all provisions of the Liquefied Petroleum Gas Regulations (7 ccr 1101-15), as applicable. 7. The facility shall be operated in a manner to prevent odors. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan, at all times. 9. The surrounding property is primarily agricultural with oil and gas encumbrances, several residential structures and oil and gas support and service facilities approximately two (2) miles to the east of the proposed facility (3rdAmUSR-1002—Cannon Land dba Encana Midstream; AmUSR 1353 and AmUSR- 211 for Kerr McGee Gathering, LLC). There are eight properties within five hundred feet of the proposed facility. • The Department of Planning Services reviewed the above referenced Use by Special Review documentation and drawings and offers the following comments: The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code. In addition to these requirements, the plat scale shall be 1" =40 feet. The Vicinity Map scale of 1" = 2000 feet scale shall be accurately delineated on the plat. This application shall be in compliance with Section 23-3-250 A. and B and is address in the following comments. Section 23-3-250.A.2 Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the requirements of employees and company vehicles. Appendix 23-A describes the design requirements for parking spaces and Appendix 23-B delineates the number of parking spaces required by use for this property. The proposed facility will accommodate 24 truck drivers at full buildout. Within the initial 24- hour period, 4 drivers will be present; looking to the long term 24 drivers within any given twenty-four hour period, No employees will be parking their vehicle at this property, however, there will be propane tanker trucks arriving and departing from this facility. The applicant shall provide spaces for off-load of supplies and download of product for delivery Section 23-3-250.A.4 Required Yards -Setback No use or accessory use may be located closer than twenty (20) feet to the existing or proposed (whichever represents the greater right-of-way width) street right-of-way. Fences over six (6) feet in height are not required to comply with the minimum setback and may be located on the property line. Fences located on corner lots abutting public • right-of-way shall not obstruct the view of vehicular traffic at an intersection. There was not a scaled elevational drawing of the proposed facility, therefore, prior to the release of building permits, the set back shall be verified given the existing proposed site conditions, specifically addressing the screening component that is within the County Road 22 future right-of-way. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.4 Required Yards - Offset No use or accessory use may be located closer than ten (10) feet to its lot line. Fences over six (6) feet in height are not required to comply with the minimum Offset and may be located on the property line. The plans submitted with the application materials have not delineated the offset. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.5.A Required Landscaped Areas No more than eighty-five percent(85%) of the total area of a lot shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was a schematic Landscape Plan submitted with the application materials. The applicant appears to be in compliance with the landscape component to meet this section of the Weld County Code. Staff will require an approved weed management plan and a reseeding/post construction plan to facilitate soil stabilization and plant material growth. Further, staff will require an updated Landscape and Screening Plan that addresses the issue of the landscape and screening component for the buffer between the outdoor storage component and the adjacent properties for this proposed facility. Written evidence of compliance shall be submitted to the Department of Planning Services. • Section 23-3-250.A.6 Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind-or animal-scattered trash. The application materials did not identify the location of the dumpster for waste on the plat, including no evidence of screening or other control device employed to control this issue. Future submittals shall address this issue as outlined in this Section of the Code. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.9 Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of employee vehicles) equipment or materials when permitted shall be screened from public rights-of-way and all adjacent properties. The applicant shall submit documentation as to how the outside storage will be screened during the construction period, and for periods thereafter as applicable. Section 23-3-350.B. Operation Standards. Uses shall demonstrate conformance with the following operation standards to the extent that they are affected by location, layout and design prior to construction and operation. Section 23-2-250.6.6 Light. Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices. The application materials did not include a Lighting Plan. Should exterior lighting be a part of this facility, all light standards shall be delineated on the USR Plat. • Polar Gas Front Range,LLC Propane Storage and Service Yard USR 1746—Page 2 Section 23-2-250.6.7 Property Maintenance. Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. The application materials do not address property maintenance. Future correspondence shall identify how the property will be in compliance with this Section of the County Code. Section 23-4-50. Off Street Loading. The applicant shall delineate on the plat the location of the loading zone that is in compliance with this Section of the Code. There shall be no parking or staging of vehicles within the public rights-of way. Further, the applicant shall meet all requirements of the Department of Public Works concerning access and internal circulation of vehicles for this proposed facility. Section 23-4-90 Signs. The application materials did not address the issue of on-site signs. The applicant shall provide written evidence that all proposed signs are in compliance with this section of the Code. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera) and non-transportation (fencing, screening, et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide • comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements.
