RE: ACTION OF THE BOARD CONCERNING ZCV #1000064 AGAINST JOSE AND EVA
MARQUEZ FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jose and Eva Marquez, ZCV #1000064, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of August, 2010, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Jose Marquez, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 10, 2010, to allow adequate time for the property
owner(s) to bring the subject property into compliance by removing the miscellaneous debris
items from the property, and for an additional inspection to be completed by the Department of
Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000064 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Jose and Eva Marquez to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until September 10, 2010, to allow
adequate time for the property owner(s) to bring the subject property into compliance by
removing the miscellaneous debris items on the site.

business day before or as soon as possible to the above mentioned violation hearing date.

West of the 6th P.M., Weld County, Colorado, except two parcels described as
follows:
Commencing at the Northeast Corner of said Lot 6, thence South 155 feet along
the East line of said Lot 6, thence West 110 feet on a line parallel to the
North line of Lot 6, thence North on a line parallel to the East line of Lot 6
155 feet to a point on the North line of Lot 6, thence East on the North line
of Lot 6 to the Point of Beginning; and another parcel commencing at the
Northeast Corner of said Lot 6 west 110 feet along the North line of said Lot
6 to the Point of Beginning; thence South 100 feet on a line parallel to the
East line of Lot 6; thence West on a line parallel to the North line of Lot 6
to the West line of Lot 6; thence North to the Northwest Corner of Lot 6;
thence East along the North line of Lot 6 to the Point of Beginning; and
except that parcel conveyed to Christina Dominguez by Deed dated July 20, 1960
and recorded August 2, 1960 in the Weld County records under Reception No.
1334930 in Book 1563 at Page 260.
