Re: L.G. Everist Inc. Lohmann Sand & Gravel, French Pit, Permit No. M-2001-017
Dear Mr. Scott,
On May 25, 2010, L.G. Everist provided an As-Built drawing of the French Pit. Maps and permits (FHDP-
400 and USR-1326) on file with Weld County show that the St. Vrain Creek Floodplain extended
approximately 100 feet onto the north edge of the French Pit property. These permits show a series of
screening berms located in the floodplain. The as-built drawing provided by L.G. Everist shows that the
screening berms have been removed. The as-built drawing also provided contour mapping which shows
that the as-built topography is at or below the pre-mining topography.
Based on the information provided by L.G. Everist, it appears that the screening berms have been
removed from the floodplain and the ground surface elevations have been returned to pre-mining
elevations. As such, it is reasonable to assume that the water surface elevations in the floodplain have
not been adversely impacted by the mining activity. In this case, it appears that L.G. Everist has satisfied
the concerns expressed by the Weld County Department of Public Works in the May 5, 2010 letter.
One item to note is that the reclamation plan shows the pit is to become a water storage reservoir. L.G.
Everist should be made aware that a Use by Special Review(USR) permit allowing the pit to be used for
water storage may be required by the Weld County Planning Department. L.G. Everist should contact the
Weld County Planning Department to determine if a USR permit will be required for such a use.

Re: Partial Assignment of Road Improvements and Maintenance Agreement
Dear Ms. Shults:
I received your response of June I, 2010.
Because L.G. Everist, Inc., does not consent to the assignment of Weld County's rights and
obligations under the Road Improvements and Maintenance Agreement to the Town of Firestone,
no such assignment shall occur. It is the County's position that the Agreement remains in full force
and effect. Therefore, L. G. Everist remains responsible for its maintenance obligations of County
Road 26, irrespective of the annexation by the Town of Firestone.
