RE: APPROVAL OF INTER-GOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY,
COLORADO AND TOWN OF FIRESTONE, COLORADO, AND AUTHORIZATION
TO SIGN SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado., pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the County proposes to construct an extension of
the public highway known as County Road 13, said extension to
run along the western edge of the Town of Firestone, Colorado, and
WHEREAS, an Inter-Governmental Agreement has been submitted
between Weld County, Colorado and the Town of Firestone, Colorado
for the purpose of said construction, said agreement is attached
hereto and incorporated herein by reference, and
WHEREAS, it would be in the best interests of Weld County,
Colorado to authorize the Chairman of the Board of County
Commissioners of Weld County, Colorado, to execute said agreement
for and on behalf :of the County of Weld and State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, ,Colorado that the agreement-to :construct
an extension of County Road 13 by and between Weld County, Colorado
and_.the Town of Firestone, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED that- the Chairman of the Board of
County Commissioners be, and hereby is, authorized to sign the same.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of

INTER-GOVERNMENTAL AGREEMENT
THIS AGREEMENT entered into this 26th day of July , 1978,
by and between Weld County, Colorado, acting by and through its
Board of County Commissioners, hereinafter referred to as "County" ,
and the Town of Firestone, Colorado, acting by and through its
Board of Trustees, hereinafter referred to as "Firestone" ,
WITNESSETH:
WHEREAS the County proposes to construct an extension of the
public highway known as County Road 13 , south of the existing County
Road 18, said extension to run along the western edge of the Town
of Firestone, Colorado and,
WHEREAS it is in the best interest of the County and the Town
that said road be constructed and,
WHEREAS the County has been unable to acquire, through neg-
otiations with the land owners, certain properties located within
the limits of the Town of Firestone for the construction of said
County Road 13 and,
WHEREAS it is necessary to acquire said properties by con-
demnation due to the failure of negotiations and,
WHEREAS the Town of Firestone has jurisdiction over two of
the properties necessary.
In consideration of the mutual covenants contained herein
the parties agree as follows :
1) Firestone shall-condemn for public road purposes the follow-
ing described properties_:
(LePore, Richard and Virginia)
A parcel of land lying entirely within the Northwest Quarter (NWQ)
of the Northwest Quarter (NWq) of Section 30, Tbwnship 2 North,
Range 67 West of the 6th P.M., Weld County, Colorado, more parti-
cularly described as follows; Beginning at the Northwest corner of
said Section 30, thence, easterly along the north line of said Sec-
tion 30, a distance of 72.3 feet more or less to a point on the
westerly right-of-way line of the Union Pacific Railroad Company
as recorded in the office of the Weld County Clerk and Recorder at
Book 362, Page 29; thence, South 00°33'28" West along said westerly
right-of-way line, a distance of 1333.31 feet to a point on the
south line of said Northwest Quarter-. (NW1/4) of the Northwest Quarter
(WW1/4) of Section 30; thence, westerly along said south line, a dis-
tance of 65.45 feet more or less to the Southwest corner of said
• Northwest Quarter (NA) of the Northwest Quarter (NM) of Section
30; thence, North 00°15'28" Fast along the west line of said Section
30, a distance of 1333.29 feet to the point of beginning containing
2.108 acres more or less.

A parcel of land lying entirely within the Southwest Quarter (SW4)
of the Northwest Quarter (NWQ) of Section 30, Township 2 North,
Range 67 West of the 6th P.M., Weld County, Colorado, more parti-
cularly described as follows;, Beginning 'at the Southwest corner of
said Southwest Quarter (SWa) of the Northwest Quarter (NM) of Sec-
tion 30; thence, North 00°15'28" Fast along the west line of the said
Section 30 a distance of 1333.29 feet to a point on the north line
of said Southwest Quarter (SWa) of the Northwest Quarter (NM-) of
Section 30; thence, easterly along said north line, a distance of
65.45. feet more or less to a point on the westerly right-of-way line
of the Union Pacific Railroad Company as recorded in the office of
the Weld County Clerk and Recorder at Book 362, Page 29; thence;
South 00°33'28" West along said westerly right-of-way line, a distance
of 1333.31 feet to a point on the south line of said Northwest Quarter
(NW4) of Section 30; thence, westerly along said south line, a dis-
tance of 58.6 feet more or less to the point of beginning containing
1.898 acres more or less.
2) The County shall reimburse Firestone for any and all costs
incurred in said condemnation proceedings..._. _
3) Upon receipt of title to the above described properties
the Town of Firestone shall disconnect said properties from the
town and convey its interests in the properties to Weld County.
4) Prior to the conveyance of title as provided in clause 4
of this agreement, Weld County is authorized to enter upon the
subject property in the manner provided by law for a condemning
--- _ - authority in order to proceed with the preparation for and con-
struction of County Road 13 .

Dear Commissioners,
At the last meeting of the Tri - Area Planning Commission on March 16, 1977,
Victor Jacobucci and the Weld County Engineer were present.
They both spoke of the problems that have arisen pertaining to the construction
of Road 13, West of the Railroad Tracks in the Tri - Area.
The Tri - Area Planning Commission would like to suggest that the Tc31sns of
Frederick and Firestone both deannex this property in order that construction can
begin as soon as possible.
The Tri - Area Planning Commission feels that when Road 13 is constructed, it
will be an asset to the entire Tri - Area.
