WHEREAS,the Department of Public Works has recommended denial of said request since that portion of right-of-way is needed for the safety and welfare of the traveling public, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the Board of County Commissioners deems it advisable not to vacate said portion of road right-of-way. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Road Petition from Victor and Gregory Hanson and Vickie Green be,and hereby is, denied. That same property owner is using the west 30-foot right-of-way to access their property and not utilizing the east 30-foot right-of-way as their own access. The County is being placed in the middle to resolve this fence and gate access issue. By vacating only one-half mile of CR 137 between Sections 8 and 9, T7N, R57W does not benefit the County. There appears to be a dispute between neighbors on the location of the fence and gate placement on the section line. Obstructions within right-of-way: Susie Kester who owns the fence and gate in the right-of-way, which physically fenced out the old trail traveled portion, relocating the travel lane portion to the opposite side of the fencing and gating the north end. Obstructions shall be removed from the County road right-of-way upon request by the Department of Public Works. We are requesting that Susie Kester relocate the fence and gate out of the County right-of-way. The right-of-ways are being use by Seismograph crews and oil/gas groups for access through and across parcels. RECOMMENDATION: Public Works recommends retaining any existing right-of-way associated with the road petition as it is very costly and difficult to replace these in the future. Susie Kester should be directed by the County Attorney to remove the fence from the section line and to access her property east of the section line. Summary: Public Works requests that Susie Kester relocate the fence and gate out of the County right-of-way. Box 758 Greeley,CO 80632 RE: Weld County West Half of Right of Way on undeveloped WCR 137 Section Line between Sections 8 and 9,T7N, R57W,for approximately%mile north from WCR 82 Dear Ms. Gesick: This letter addresses items one and two that you attached to your August 30, 2010 letter regarding the right-of-way vacation petition on the undeveloped WCR 137 section line between sections 8 and 9. It is difficult to identify this as WCR 137 between sections 8 and 9 as you requested since this is not a currently maintained county road. Directly to the south of these two properties and south of CR 82 between Sections 16 and 17,T7N, R57W,you can still see where the right-of-way is still present as it was in the early 1900's. As a matter of fact,WCR 137 doesn't even exist between Highway 14 and the Morgan County Line. First of all,this is not to be considered a boundary dispute. The adjacent property owner,Susie Kester, always informed me of how she was going to proceed without allowing any conversation or proactive interaction,just literally telling me what she was going to do. When I was initially told that she was going to put a fence down the section line, I informed her that this was fine as long as she used her own property for her own driveway or access. Now,she wants to use my farmland side as her access to her north gate which she installed coming directly onto the west 30'of right-of-way between sections 8 and 9, at the 34 mile point north of CR 82 approximately one year ago. She also told me that she was going to put road base on my side and said "You don't care,do you?" I told her that I most certainly did object because she could put road base down on her own side. Please note that her land is definitely not landlocked as she currently has access to her own private residence along CR 82. By her actions of wanting to put road base on my side, I have several points that I am requesting you to answer for me. • How do you clearly define "public use" and "private use" as it appears that the term "public right-of-way" and "private access" are being used synonymously by the county? Her intention is to use my 30 foot right-of-way side for her own private and subcontractor use by installing the gate at the%mile point on the north end approximately one year ago. I am definitely not in Page 2 disagreement of where the fence/property line is currently established by her fence,which she erected within the past two years. When she definitely considers my 30 foot right-of-way a "public use" road,then it would be in violation of"The road cannot be fenced or gated" per County Code, Article III, Section 8-6-150 H. Also,"If a fence exists along the section line on which the road is to be built, relocation of the fence to the road right-of-way lines shall be the responsibility of the sponsor(s)of the roadway project" per County Code,Article III,Section 8-6- 150 I. • With regard to Weld County Right-of-Way Code,does either party have special rights beyond his or her own property line? Typically, I would assume that adjoining landowners should agree to establish a trail centered on this line for shared usage of the entire 60 feet, but this was never an option. • The adjacent property owner is actually the one trying to justify use of my side of the property line for her own private use. The term "public" and "private" are being interpreted as interchangeable by her. Communication has always been extremely difficult and there is no possibility that she would sign a vacation petition when she would lose what she intends to totally control. Can the county explain to her the difference between"public" and "private"? The county explained to us that if there is no road,just"enjoy it!" Does that mean that each adjacent owner gets to"enjoy"their own 30 feet of right-of-way? • Who would maintain her presumed "public access" road? Would it need to be her,the county or me,especially when she lays road base down on OUR 30 foot right-of-way farmland side? • If the county has no intention of installing a maintained road on this county right-of-way,why is it justifiable for her to fence AND prohibit use of the 30' right-of-way on her side,yet turns around to develop a road on my 30 foot side of the right-of-way,which IS NOT centered on the section line? No one can even use her 30'side of the right-of-way now because of the fence! She is bound and determined to put down road base and develop this 30' right of way on my farmland side for her own private use! In essence, she is trying to change the Weld County right-of-way from 60'to 30' by her defining this as a "public road"which is in direct violation of County Code,Article III, Section 8-6-150 C which states that"The width of the right-of-way cannot be less than 60 feet." Also,this"private road"for her own exclusive use does not serve "a minimum of 3 legal lots which must have residential dwellings,to be considered for acceptance" per County Code,Article III,Section 8-6-150 D as well. Therefore,we,as joint owners,of Weld County SE Y 8-7-57,are requesting you to vacate the right of way of the 30 feet to the east side of our property for approximately%3 mile north on the undeveloped WCR 137 section line which is directly west of the fence that was installed within the past two years by the adjoining owner of the SW'/.9-7-57, since the adjacent land owner is not landlocked and is utilizing Page 3 the entire east 30 feet on our property for her own private access and exclusive benefit. Once again, this is definitely not a dispute over where the fence was originally placed! We,Victor Hanson,Greg Hanson and Vickie L.Green, have been the joint owners of that land since the purchase date of August 24, 1988 with me,Victor, being the leaseholder of that same land for approximately 40 years previously. This entire 60 feet of right of way was used exclusively by me, Victor, as tenant and owner for a total of over 50 years because it was originally fenced on the east side of the entire 60' right-of-way. As an occupant for over 86 years and as a landowner in Weld County for over 50 years, it seems that my age and deteriorating health condition over the past year and a half are definitely being taken advantage of by her total disrespect and forceful disregard to rational communication regarding this situation from the very beginning! Please note that I am currently a resident of The Bridge Assisted Living,4750 W.25th Street,Apartment#219,Greeley,Colorado,80634. Please understand that this is a diligent and reputable attempt to make sure that our Hanson 30 foot right-of-way on the east side of SE Y.8-7-57 between sections 8 and 9 be kept intact with the entire Hanson section and NOT BE ALLOWED to become a future part of SW'/.9-7-57! It is apparent that by installing a gate at the Y mile point on the undeveloped WCR 137 point,that she is clearly trying to gain total control of the entire 60 foot right of way. This is exactly what has already occurred to the north between NE Y,8-7-57 and NW Y.9-7-57. First of all, Susie Kester is now putting barbed wire fence, concrete, paving materials and other waste materials on her 30 foot right of way next to the fence she erected and has now mowed down part of our farmland stubble on the west edge of our 30 foot right of way to claim more ground for her road. Again,she is not allowing any access to the Weld County's east side of the right-of-way and is independently claiming abandonment by dumping trash there! Again,we are not questioning property line by the location of Susie Kester's fence. It appears that what she is trying to accomplish violates Weld County codes! This petition is not ready to be scheduled. • The road petition is identifying WCR 82 between WCRs 135 and 139 for the portion being abandoned or vacated. This is a county maintained road. The petition should identify WCR 137 section line between Sections 8 and 9, T7N, R57W for approximately one-half mile north. • The adjacent property owners are listed, but are not a signature party to the road vacation petition. • An in-house email from Bruce Barker informed me that the landowner on the east of the section line has placed a fence right on the section line, using the designated 30-foot right-of-way as pasture. That same property owner is using the west 30-foot right-of-way to access their property and not utilizing the east 30-foot right-of-way as their own access. Summary: There appears to be a dispute between neighbors on the location of a new fence placed on the section line where the adjacent neighbor is utilizing the opposite side of the section line to access an opposite parcel. The County is being placed in the middle to resolve this fence and access issue. By vacating only one-half mile between Sections 8 and 9, T7N, R57W does not benefit the County. Box 758 Greeley, Colorado 80632 This correspondence is in reference to the Petition filed by Hansen's to vacate the public road right- of-way lying 30 feet on the west side of the section line (WCR 137) between sections 8 and 9, Township 7 North, Range 57 West of the 6'" P.M., Weld County, Colorado, subject to dedicated and recorded easements and rights-of-way. From 1993 to the present time, my family has used the right-of-way on section line 137 in a limited and respectful manner to access our land for agricultural practices. Since most of my travel is in a golf cart it is typically nearer to access our land directly from the yard. However, there are times when it is necessary and reasonable for individuals to access the west and back pasture down the right-of-way for road 137. These times typically include the use of heavy equipment or farm machinery requiring a straight on or larger gate access. The following list indicates typical uses: • MCREA: to maintain and repair the power line from WCR 82 to my stock/house well. • New Raymer Fire Department: to control the burning of weeds in fence line and in case of fire. • Gas/Fiber Optics Line: To monitor pipelines. • Local farmers/ranchers: Scott Northrup, Wes Johnson and Jim Walker to access livestock, check water and/or fence. • Kester Pump Service: to service the pump, well and install water tanks. • Younglund Backhoe Service:to install water tanks and haul hay. • Sub-Contractors: o Hay operations: Steve Kugler, Jim Walker, Jimmy Krager. o Plant trees: Jim Mertens, Jim Young. o Build fence: Larry Hoozee, Gene Nelson. o Vehicle maintenance: KAYJAN, Tim Wunce, Justin Mertens. • Kester Family: To access the well; check water for livestock; maintain fence;water trees; mow for weed/fire control and drifting snow; swath, bale, stack and feed hay; planning and development of a retirement home/shop for my father. Since we purchased the West half of Section 9 nearly 17 years ago, we have been good neighbors to Hansen's tenant, Delwyn Northup. We have always allowed him to use our corrals and pastures when he brings cattle into Hansen's East half of Section 9 and again when he moves them out, because there are no loading facilities on their side. Delwyn was given, and still has, the keys to my house and shop in case he has trouble in the field. I have kept the weeds mowed between us in the spring and fall, and again prior to harvest. Delwyn in turn has kept a watchful eye on my property during the week when I'm not there. He has called my cell phone if he notices lights or activity at unusual times. He has driven from his field, across mine to see if the weeds I was burning were out of control. He drove his tractor nearly 20 EX= ?hi, G/p , Zr • •Page 2 Cecernber 62010 miles to pull my Dad out when our front end loader was washed down the creek and buried in sand. He loaned me his Father's old tractor to finish mowing my field when mine broke down. Together we helped an aging neighbor poison prairie dogs so they did not destroy his entire pasture or move across the county road into our fields. We have spent various occasions getting our livestock back into our respective pastures and have always cooperated in fence maintenance. In 1995 my father installed 2 pipe comer braces and a dozen line markers directly on the section line between 8 and 9. At that time Vic was driving out almost daily from Ft. Morgan and stopped one afternoon to visit with my father. Looking at the cement going into the post hole, Vic said to him, "Well, that ought to hold it." Because that pasture was in CRP, my father never completed the entire section of fence, but the primitive markers stood for over a decade. Then, in 2007 the NRCS planned to allow emergency grazing of CRP fields. As we prepared to complete the fence line started years earlier, we talked about the possibility of moving it from the section line west 30'. This would line up our fence with the existing fences to the north (N ' S8) and south (NE % S17) of us. It would also move the fence line away from the blow ridge and washouts that were present. I saw Vic in the restaurant one day and explained all this to him and asked if I could put the fence in line with the power poles and the two fences to the north and south of us. We would leave a 60' entrance from the county road so that farm implements could easily access his field. He said, "I don't care where you put it" and joked he was glad he wasn't the one having to build fence. A couple days later I shared this conversation with Delwyn and he was not happy with Vic's decision. Being Hansen's tenant he asked me to reconsider this decision and put the fence back 60' from the power line. I asked him if we did that, "Would you farm right up the fence line" and he responded, "Probably." I later received a call from Vic insisting that I put the fence 60' east of the power line. I told him I wouldn't move it back that far, but I was willing to put it on the section line where we'd initially started. That line had been established many years earlier with a buried fence as proof; and by the corners and line markers my father had placed in that fence line 13 years earlier. Although the erection of the fence three and a half years ago seemed to win all prior relationships, my family has remained respectful of the land, the crops, the livestock and every other aspect of the agricultural operations taking place in rural Weld County. It was frustrating when the letter came from Hansen's lawyer 16 years after the fence line had been started, threatening "further action" if I continued my legal use of the right-of-way. It was even more disturbing when Vicki Green and Delwyn Northup called the Sheriff and demanded I be arrested for trespassing in August of 2010. Although I wasn't the one driving at the time, the thought of my 69 year old step-mother being arrested was a little disconcerting. She had been the one driving my pickup and flatbed trailer down the right-of-way for road 137 while we were picking up bales out of the field. When I received a "Notice for Petition to vacate the right-of-way" I realized this situation was going to continue to be contentious. The Weld County Right to Farm Code (Section 35-3.5-102), "Provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that am commonly or reasonably associated with agricultural production." Kester's have been ranching in this community for 5 generations and Northup's farming for 4. All three members of the Hansen family are absentee land owners with no active commitment to our community or the agricultural practices that occur here. They've alleged that I am trying to gain possession of their land by traveling on the west side of the fence. That is simply not the case. Nor •Pixie OttmYeB.AtU would I presume it Vic's intention during the years that he enjoyed "exclusive use" of the entire 60' of easement. With all that said, I would be willing to sign the petition to vacate the west half of the easement if it were possible for vehicles to travel entirely within the 30' right-of-way on the east side. Currently, that is not feasible for several reasons. First, 500' north of the county road is a washout about 10' wide and 4' deep. This draw meanders east halfway through my pasture before leveling out at my yard. The problem was so bad that the Logan County ASC office re-wrote my contract allowing trees to be planted down through the draw to help with flood mitigation. The erosion continued, washing out three different years of tree plantings. Since you can't drive over the washout, one would have to travel about 1500' through my hayfield to get around it and back next to the fence line. Secondly, in some places east of the section line, there is only an average of 15-20' between the line and a slight change in the geography. Although I say"slight" if you were pulling a trailer with hay and hit the lip of this ridge it would no doubt spill your load. To me, the most reasonable solution would be for the county to do the dirt work necessary to create a gravel surfaced roadway on the east half of the right-of-way and for me to install a gate between the county road and the pasture to allow individuals the opportunity to travel down both sides of the section line. However, in this day and age of limited budgets that might not be the most practical. Vic claims he had exclusive use of the entire 60' right-of-way for some 50 years. I've used the east side exclusively for 35 days since dosing the gate on the north end to keep 4 bulls in the hay field. Maybe the simplest solution is for me to open the gate back up so that I am not violating the County Code, Article III, Section 8-6-150 H and simply move the bulls to another pasture since they haven't been all that much fun anyway. As I look forward to retirement in New Raymer, it is my hope to find a reasonable solution for all parties without further legal ramifications, expenses, time and energy. Your having erected a fence up to and generally along the section line between Sections 8 and 9 does not give you the authority to use the field frail on the Hanson property to the West for access to the North Half of your land in Section 9. That is not a right-of-way available for your use. It is a private access road to the Hanson farm ground in the Southeast Quarter of Section 8. Your use of this private trail for your convenience violates the Hanson's property rights and such use must stop immediately. The gate that you have installed along the half section line, at the North end of the Hanson field frail, dearly indicates that you intend to use the Hanson frail as access to the North Half of your property. As stated once already, you have rio right of use to that field trail. Your gate should therefore be moved to the East side of the section line to your property on the West Half of Section 9, to provide you lawful access to the land behind that gate. Your land in the West Half of Section 9 is not land-locked, having access to a constructed and maintained county road, Weld County Road 82, on the South side of your property. Therefore, there is no need for your use of the Hanson field trail in Section 8. The Hansons hope that this matter is resolved by your willingness to recognize their ownership of that strip of land on which the Hanson field trail lies; however, they will be left with no choice but to take further action to protect their private property rights if your unlawful use of the Hanson field trail continues.
