RE: LOT SIZE VARIANCE - DEROY F. SHARP and JOANN T. SHARP -

WHEREAS, at a public meeting held in the Chambers of the
Board of County Commissioners of Weld County, Colorado, on the
24th day of January, 1977, the Board of County Commissioners
of Weld County, Colorado, did hear the application of Deroy F.
Sharp and Joann T. Sharp for a Lot Size Variance from the
minimum lot size requirements of the Weld County Zoning Reso-
lution, and
WHEREAS, the Board of County Commissioners determined at
said public meeting that an on-site inspection of said premises
was in order to properly inform the Board of County Commissioners
of the facts concerning said application, and
WHEREAS, Section 9-4A(6) of the Weld County Subdivision
Regulations requires that a Lot Size Variance be obtained before
a recorded exemption is granted to an applicant if the original
lot is less than the applicable minimum lot size requirements
of the Weld County Zoning Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, having heard the testimony of those present and having
considered the recommendations of the Planning Commission' s staff,
and having personally inspected the premises in question, finds
that the applicants have not shown good cause for granting a
Lot Size Variance under Section 9-4A(6) of the Weld County
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED that the application of
Deroy F. Sharp and Joann T. Sharp for a Lot Size Variance on a
parcel of land located in the East Half of the West Half of the
Southeast Quarter of Section 27, Township 4 North, Range 66 West
of the 6th P.M. , Weld County, Colorado, be and hereby is , denied
as being inconsistent with the provisions of the Weld County
Zoning Resolution, the Weld County Subdivision Regulations, and
the Weld County Comprehensive Plan.

The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 31st
day of January, 1977.
The above and foregoing Resolution was read into the
record and signed on the 2nd day of February, A.D. , 1977.

Dear Commissioners:
The attached letter and related materials are in reference
to a request by Deroy F. Sharp for a Lot Size Variance.
The subject property is described as the EA WZ of the SE4
of Section 27, T4N, R66W of the 6th P.M. , Weld County,
Colorado containing approximately 40 acres. The location
is 1 mile east of Gilcrest on the north side of County Road
40. The request is to obtain a variance from the minimum
lot size requirement (Section 9-4 A. (6) ) so he may make
application to apply for a Recorded Exemption. Section
9-4 A. (6) states:
"The Board shall not approve the exemption of the
proposed land division unless it finds that the
original tract or parcel of land to be divided
under this Section meets the minimum lot size
requirements established by the Weld County Zoning
Resolution; variance from this requirement being
allowed only upon good cause being shown to the
Board of County Commissioners or where said tract
or parcel of land lies within the comprehensive plan
area of an existing incorporated town of Weld County.

If the variance is granted, Mr. Sharp will proceed with his
application for Recorded Exemption to divide the parcel into
two lots. One is proposed to contain approximately 5 acres
with existing improvements and the other lot is proposed to
contain approximately 35 acres which will not contain existing
improvements.

Based on the information submitted, the policies established
in the Comprehensive Plan and Weld County Regulations, the
staff recommends the request be denied for the following
reasons:
1. Good cause has not been shown why variance from
the minimum lot size be allowed as required in
Section 9-4 A. (6) ;
2. The proposed split would not be in compliance with
the Intent Clause of the Agricultural District be-
cause it would encourage encroachment of incompatible
urban land use upon the Agricultural District, would
not encourage agriculture as the highest and best
use, and would not provide for orderly urban growth
which would therefore be in conflict with the Weld
County Comprehensive Plan;
3. The request is not in compliance with the intent
clause of the Recorded Exemption procedure (Section
9-2 of the Weld County Subdivision Regulations)
because the soils on the parcel in question are
prime irrigated soils (Class I and IV) and because
of the potential incompatible urban land use if the
property is split .
It should be pointed out that the Town of Gilcrest did not
have any particular problems with this Lot Size Variance
request .

Gentlemen:
We, Deroy F. and Joann T. Sharp, are requesting a lot exemption
of a 6. 5 acre farm (more or less) from a 40. 5 acre farm (Eli of W1/2 of
SEA of Sec 27-4-66) leaving 34 acres (more or less) for the
purpose of land exchange (trade) . Reasons for the lot exemption:
1. The land that is being traded for has no improvements.
We need the 6. 5 acres with building site for a
residence as well as for our livestock until such
improvements can be made on the land exchanged.
2. The 6. 5 acres with building site can be separated from
the 40. 5 acres without impeding or imparing road and
water accessability and farming ease.
3. The 6. 5 acres with building site is fenced pasture
because of its low terrain and high water level.
We thank you for your consideration and close examination of this
lot exemption.
