HomeMy WebLinkAbout20100039.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV#0900139 AGAINST FREDERICK AND ELIZABETH DEERING FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Frederick and Elizabeth Deering, ZCV#0900139, are allegedly in violation of the Weld County Code, and WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not been corrected, and WHEREAS, on the 12th day of January, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Frederick and Elizabeth Deering, property owners, were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to refer said matter back to the Department of Planning Services, due to an application for a Use by Special Review (USR) permit for a welding shop/custom fabrication being submitted. In order to cancel the above mentioned Violation Hearing, the USR application shall be assembled and 4 packets be submitted to the Department of Planning Services as soon as possible. Planning Department Staff will review your packets and respond within 7 working days outlining any missing paperwork or necessary corrections. The remaining packets and any other requirements as outlined in Staff's follow up 7 Day Completeness Review memorandum and fees shall be submitted prior to the hearing in order to cancel the Violation Hearing. If you are unable to meet this timeline, I recommend you or a representative attend the January 12th Violation Hearing to request additional time from the Board of County Commissioners. Please keep in mind that we do have Planners available Monday thru Thursday from 7:30 am to 4:30 pm. No appointment is necessary for walk-ins as individuals are seen in the order in which they arrive. You can also call for the On-Call Planner at (970)353-6100, 3540. No pictures were taken during this inspection. 09/08/2009 Phone Call Elizabeth Deering (303-629-1611)called. She said her son and his wife live at this property. She said the barrels, iron/metal and miscellaneous items will be relocated inside the shop. She stated he does not do welding for the public, but instead operates MacMillan Metalworks, Ltd (www.rockyforge.com). I explained that this would probably fall within the fabrication category which typically requires a Use by Special Review (involving a public hearing process). I told her I would go ahead and present this at staff this Friday to be sure. I told her I would call her after staff Friday morning. She said she thought he obtained a permit when he built the building. I explained that a building permit is different than a Use permit. The building department reviews the plans for the building not necessarily the use of the building. 09/11/2009 Phone Call I called Elizabeth Deering (303-629-1611) back and explained that a USR would be required and that the first step in that process was the Pre-Application Review Request form. She asked me to send it to Susan MacMillan (18690 CR 17, Johnstown, Co 80534). I asked if she had an e-mail address and I would just e-mail it to her directly. He met with Brad Mueller. Brad stated his application was missing a substantial amount of items (such as signatures, etc). Bruce asked where he stood with the violation case. Brad asked me to call Bruce. I called him (303-913-0897) and advised him that I had sent an e-mail to his wife on Monday. Currently the property is scheduled for a Violation Hearing on January 12. I explained that the only way to cancel that hearing was to have the application submitted probably sometime this week so the Completeness Review could be completed. Pre-application reviews are required prior to beginning the application process; however, this review is not an application. Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and and Environment.
