My name is William Tempera. I am writing and sending this on July AUG 1 7n1n
30th, 2010. My wife, Susan, and I own and reside on lot 9 of the
Highland Farms development. Susan and I signed our approval of E E I V E D
AmPF-1045 after Mr. Balmes verbally dissuaded some concerns we had.
Our biggest concern was over the possibility of a dwelling or other
large structure being constructed directly south of lot 5 and/or lot
9, which could destroy a highly valuable view condor of ours.
Mr.Balmes assured us it was in writing that no dwellings or structures
would ever be allowed in this area.
Can you please confirm for us that this is true?

Hi Michelle,
"please accept my sincere apologies but, as I eluded to the possibility
of via voicemail earlier today, I will not be able to attend the
hearing at 10:00am, Aug 25th. I need to be in a meeting in Longmont at
11:00. I could come and speak with you earlier, but would have to
leave Greeley absolutely no later than 10:00am.
Again, please convey to the board:
The approval for the creation of the Estate Lot on the part of my
wife, Susan, and I, is with the understanding that no dwellings will
be permitted in the area directly south of any part of Highland Farms
lot S and lot 9.
Mr Balmes specifically told me that the county was not allowing him to
do this, before he obtained my signature. That information influenced
my decision. I have no doubt that Mr Balmes was sincere about this. My
wife and I would merely like to make sure that this can not be
re-opened for discussion in the future.
When meeting with the board you should find that all of this jibes and
makes sense. I would speculate that the land being referred to was
originally platted the way it is in order to provide a buffer between
Highland Farms and the Highview subdivision to the south. So it would
make sense for someone with the planning division to insist that it
remain that way. Also, on your own website, the drawing of the r w
oposal indicates two potential homesites, both to the east of
ighland Farms and neither of which are directly south of any parts of n ;;r
lots 5 or 9. So you should find that the Balmes' have been proceeding _r t;lir-
with the understanding that they will not be permitted to construct a

dwelling in the area being referred to.
If it should turn out that things are not making sense then I would
lie
ike to respectfully request that this matter be left open until I can
et with yourself and any other appropriate individuals to discuss
it. I do understand that your time and the time of each of the board
members is highly valuable and thus I do not make this request
lightly.
If everything goes as I expect, I would appreciate confirmation that
it has been documented as part of the creation of the Estate Lot that
no dwellings are to be permitted directly south of any parts of lots 5
or 9.
Again, I apologize for not being able to attend and very much
appreciate your assistance with this matter.
