RE: ACTION OF THE BOARD CONCERNING ZCV #1000037 AGAINST JAMES AND
LORI MEINING FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, James and Lori Meining, ZCV #1000037, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of August, 2010, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, at the request of Planning staff, the Board deems it advisable to refer the
matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV#1000037 be, and hereby is, referred back to the Department
of Planning Services.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of August, A.D., 2010.

VIOLATION REMEDY:
Since you have submitted the 7 day completeness packets for review, I have pushed out your Violation Hearing
to August 10, 2010. Please keep in mind the August 10th hearing will be cancelled if all corrections are made
which are discovered through the 7 day completeness review and the Use by Special Review process is
initiated. As I have previously indicated, the presence of more than 4 (four) dogs requires a Use by Special
Review (USR)for a KENNEL. To bring the property into compliance, a complete USR application shall be
submitted to the Department of Planning Services.

primate or bird over the age of six (6) months; provided, however, that members of the order crocodilia (e.g.
crocodiles, alligators, etc.), gorillas, orangutans, baboons, chimpanzees, member of the class apes, order
falcons (e.g. hawks, eagles, vultures, etc.), and animals defined as LIVESTOCK herein, shall not be considered
to be HOUSEHOLD PETS for the purpose of this Chapter. (Note: See definitions of EXOTIC ANIMALS,
LIVESTOCK and KENNEL.)
KENNEL: Any place other than a PET SHOP or veterinary clinic or HOSPITAL, where five (5) or more
HOUSEHOLD PETS of one (1) species, or a total of eight(8) or more household pets of two (2) or more
species, are kept or maintained. Property that is zoned (A)Agricultural and not part of a platted subdivision or
unincorporated town and which is larger than ten (10) acres shall be permitted to keep or maintain eight(8)
HOUSEHOLD PETS of one (1) species or sixteen (16) HOUSEHOLD PETS of two (2) or more species without
being considered a KENNEL.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County Attorney's Office for
immediate legal action.

OTHER CASE HISTORY:
03/19/2010 Phone call Anne Backstrom (970-396-3186) called. She said she had spoken
to her neighbor(Patricia Compton) and she advised her that I was
working on a violation for all the properties. She said she currently
has 10 dogs and is working on getting rid of at least 2. She said her
daughter Lori (970-785-6226) has several more and knows that she
needs a USR for a Kennel. She said they had already applied for a
State license. She said she thought she had to wait until she had
her state license before she could apply for her county one. I said
that was incorrect. The state license will be a Condition of Approval,
so it is good that she's already applied for it, but it isn't needed for
submittal. She said Lori was currently out of town. I told her that I
would be getting letters out to both of them early next week.

Commissioners authorize the County Attorney to proceed with legal actions to remedy the violation. Our
records indicate that your were made aware of the nature of the violation including the action necessary
