Fourway Baptist Church, at 9966 CR 41 in Ft. Lupton, understands that our newly
permitted commercial well cannot be used to water the minimal landscaping on the site.
Irrigation for the trees on the property will be hauled from an agricultural well on a
neighboring farm. This letter will suffice to explain our intention, as discussed with Kim
Ogle of the planning department today.

6) A totalizing flow motor must be Installed on this well and maintained in good working Order. Permanent records of all
diversions must be maintained by the wall owner,and recorded on a monthly,and yearly basis. Copies of these records
are to be provided to the Water District 2 Water Commissioner following the and of each water year(concluding September
30th—To be forwarded no later than December 1st of the same calendar year).
7) The average annual amount of ground water to be appropriated shall not exceed one(1)acre-foot(325,850 gallons).

Dear Pastor Shelander:
The Water Quality Control Division (Division)has received and reviewed the series of packages
associated with the requested plans review submittals for the referenced facilities. The review was done
in accordance with Article 1.11.2 of the Colorado Primary Drinking Water Regulations. The design
meets or exceeds the requirements of the State of Colorado Design Criteria for Potable Water Systems
and is hereby approved.
This approval addresses the following items:
• Potable water well Permit No. 36705;
• Water treatment consisting of disinfection-- 10% sodium hypochlorite solution, 15 gallon
solution storage tank, Stenner solution metering pump (Model 45MHP2), 125 linear feet of 1.5-
inch diameter pipe and a 1,400-gallons buried concrete storage tank providing approximately 33
minutes of disinfection contact time at peak flow conditions in the distribution system; and
• Distribution system- a Jacuzzi jet pump (Model 7RM2),an in-line pressure tank(30 psi to 50
psi) and a flow meter, all contained in a buried concrete vault.
This approval is based upon the following information as provided by the public water system and/or.its
consultant:
Floodplain Certification—Based upon information presented in a "100-year Flood Plain
Certification"prepared by Eric W. Dunker, the well is not subject to flood damage by a 100-year
event (FIRlvt, Panel 080266 0900 C). •
• Plans and Specifications—.Design drawings, prepared by AGPROfessionals, LLC, submitted
July 28; 2004.

• Plans Review Form—A Plans Review form was submitted by your consultant, R. Wayne
Ramey, on December 11, 2002. The form was determined to be incomplete. A second Plans
Review form was submitted by Ms. Marcia Aiden on May 21, 2004. This form was also
• determined to be incomplete. A complete P1ans.Review form was received on October 15, 2004.
Inventory Foirn—A Public Drinking Water System Inventory Fonm was completed and
submitted by your consultant, R. Wayne Ramey, on December 11, 2002. The form incorrectly
identifies the water source as 80-foot deep well. Since submittal of the original.form, it has been
determined that the well in use is actually 475.feet in depth.
•
Please retain this approval letter in your permanent records for your water system.
Any changes to the approved design must be submitted to this office for review and approval prior to
implementation.
A written certification from your consultant stating the facilities were built as approved must be
submitted to this office. This written certification has been received from AGPROfessionals, LLC based
on verbal approval of the design by the previous District Engineer.
In accordance with the current Colorado Operators Certification Board Regulations, your water system
is required to be under the responsible control of a Class"D" Water Treatment Plant Operator and a
Class "1" Water Distribution System Operator. For additional information regarding the operator
certification requirements, please contact Betsy Beaver, of the Facility Operator Program, at 303-692-
3503.
Any point source discharges of water from your facility are potentially subject to a discharge permit
under Colorado's State Discharge Permit System. Any point source discharges to state waters without a
permit are subject to civil or criminal enforcement action. If this facility has any discharges without
permits, you are required to contact the Division. For additional information regarding the discharge
permitting process,please contact Gary Beers, of the Permits Unit, at 303-692-3524.
Approval of this project is based only on engineering design and the facility's ability to provide safe,
potable water meeting the Colorado Primary Drinking Water Regulations. This approval shall in no way
influence local planning, health or building department decisions on this project.
Please direct any future correspondence regarding this approval to my attention.

Condition 3C-Potable Water System Design Review- I am in receipt of a letter from Thomas Armitage, P.E.,District Engineer for
the Colorado Department of Public Health and Environment, Water Quality Control Division dated October 26, 2004. The letter
indicates that the water system design for the Fourway Baptist Church at 9966 WCR 41, Ft Lupton, CO meets or exceeds the
requirements of the State and is approved. This condition is satisfied and can be removed.
Condition 3B-Well designation -At this time, my records indicate that the well serving the Church is designated for domestic use
This condition requires that the applicant provide evidence that this well is appropriately permitted. I spoke, by phone, with David
Aiden, representative, for Fourway Baptist Church on November 3, 2004, regarding this issue. He said he will contact the State t
inquire about the designation and will send information to me via Fax as soon as possible. This condition is not satisfied.
Condition 3A- Septic System The septic system has been installed. The system has not been finalized. The applicant must cat
off a section of the leach field to meet the requirements of the State. When this is completed the system will be finaled and
approved. Conversation with David Aiden indicated that this will be completed in the near future (waiting for the contractor to
complete) This condition has not been satisfied.

Dear Applicant:
On May 9, 2001, your application for a use by special review was administratively approved by the Weld
County Board of County Commissioners with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should
you choose not to complete the use by special review process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision.
If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your
case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning
Staff will be recommending denial or your request at this hearing. If your application is denied by the Board
of County Commissioners, the decision could affect future land development applications located on this
parcel. Withdrawing applications will not generally affect future applications.

Re: REQUIREMENTS for a Transient Non-Community Drinking Water System
Ground Water Source,Weld County
Dear Pastor Shelander:
Pursuant to Article 1.2.2 (62), a transient non-community water system is defined as a non-community
public water system which does not serve 25 or more of the same people for 60 or more days per year.
As a public water system, you are, therefore, subject to the laws set forth by the above regulations.
The Public Water System ID# (PWSID#) assigned to your water system is 262284.
This number is used to identify your system and must be used on all samples and correspondence
concerning your drinking water system.
Pursuant to Article 5 of the Colorado Code of Regulations (CCR) 1003-1, Section 3.1.1(1), a system
must collect total coliform samples at sites, which are representative of water throughout the distribution
system at a frequency based on population served and the system is required to submit the results of all
routine microbiological sampling and analyses to the Department for review. This water system must
collect and have analyzed at least one bacteriological sample each calendar quarter while opened for
business.
Pursuant to Article 5.3.1 (9), each transient non-community water system, whether supplied by surface
or ground water sources, shall monitor for nitrate annually. You must contact a laboratory that is
certified with the State of Colorado for all sampling procedures.
All drinking water supplied from public water systems must be disinfected by methods approved by this
Department and are effective in the killing or removal of pathogenic organisms. Disinfection equipment
must be in place and operating within sixty days from the date of this letter. Changes in treatment
should be submitted to and approved by this office before installation.

Here is a follow-up regarding USR-1319 water situation Condition 3c.
Connie O'Neill spoke with Brad Simmons representative from CDPH&E District Engineers office regarding
this application. Mr. Simmons indicated that plans have been submitted, reviewed and a letter has been
sent to the applicant noting deficiencies and requesting more information. When the applicant responds
Mr. Simmons will send a letter to us informing us of compliance or non-compliance. I would assume the
applicant will be receiving this information as well. When acceptance by the District Engineers office is
completed the applicant should send a copy to us. At that time I will be able release this condition.

Condition 3.a (Septic system) has been resolved. The Septic system was finaled on 8-23-02.
Condition 3.b (Properly permitted well) The well is permitted as a domestic well dated 7-14-1961.
Documentation to show if a domestic well is suitable for this use has not been submitted to this office. I
am unable to release this condition without information from the Colorado Division of Water Resources
that this well designation is appropriate for this use.
Condition 3.c The applicant has submitted a letter of requirements for a Transient Non-Community
Drinking Water System. At this time, Connie O'Neill, WCDPHE Laboratory Director, from this department,
has a left avoice mail message with a representative of CDPHE to inquire about the the submitted
documentation. At this time the submitted documentation indicates only the requirements (testing, etc)for
this use. I hope to have the information necessary to answer this concern by 1-10-03.

Dear Sharyn:
The Department of Planning Services forwarded the information provided by your office concerning the
public water supply and sewage disposal system to the Department of Public Health and Environment
for their review and comment. Each Health Department condition is outlined and discussed as follows:
3.a The facility shall install an engineer designed septic system to handle the hydraulic load for a
congregation of 450 people. The system design shall comply with all County and State Laws,
Regulations and Policies(specifically Colorado Department of Public Health and Environment,
Water Quality Control Division Policies WQSA -6 and WQSA-8). Evidence of approval by the
Weld County Department of Public Health and Environment shall be submitted to the
Department of Planning Services.
The septic system has not been finaled. It is my understanding that the system was red-tagged
in February 2002 by the Department of Public Health and Environment.. ?k- 4 •2 i '&z
3.b The applicant shall provide evidence to the Weld County Department of Public Health and
Environment, and the Department of Planning Services, that the well has been appropriately
permitted/registered with the Colorado Department of Public Health and Environment, Water
Quality Control Division.
Application materials indicate this is a domestic permitted well, hat more than likely will require
re-permitting as a commercial well. It is suggested that the applicant contact the Division of
Water Resources at 303 866 3587 for more information
3.c The facility shall comply with the Colorado Primary Drinking Water Regulations(5 CCR 1003-1).
Evidence shall be provided to the Weld County Department of Public Health and Environment
and the Department of Planning Services that indicates the system complies with the
Regulations. Evidence of approval by the Colorado Department of Public Health and
Environment, Water Quality Control Division shall be submitted to the Department of Planning
Services.
The applicant should contact the Colorado Department of Public Health and Environment, Water
Quality Control Division at 303 692 3500 for more information on how to meet this standard.
As noted previously, there remain several outstanding issues to be addressed. Several items require
delineation on the Use by Special Review Plat, and, the appropriate documentation from the referring
agencies shall be submitted to this office for review and approval.

I would like to reiterate our conversation this afternoon.
Condition 3a-Septic system, has not been finaled, it was red tagged in February by this Department.
Condition 3b-appropriately permitted well, the information submitted reports that the well is "domestic".
More than likely, this well will need to be permitted as Commercial. I spoke with the Division of Water
Resources staff and they suggested that the applicant call them at 1-(303)-866-3587 for more information.
Condition 3c-Colorado Primary Drinking Water Regulations-The applicant should contact the Colorado
Department of Public Health and Environment, Water Quality Control Divison at 1-(303)-692-3500 for

I received your request for early release of the building permits for the expansion of the Fourway
Baptist Church. The Planning Commission of April 3, 2001, voted unanimously for approval of this
application. However, as a condition of their approval, as referenced in Condition of Approval 3.d,
submittal and approval for a storm water drainage plan is required. It would be appropriate to
release building permits early under the condition that the storm water drainage plan had been
reviewed and approved by the Department of Public Works.
I understand and appreciate the uniqueness associated with the construction of a church and wish
