Dear Applicant:
On November 9, 2005, your application for a use by special review was administratively approved by the
Weld County Board of County Commissioners with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should
you choose not to complete the use by special review process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision.
If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your
case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning
Staff will be recommending denial or your request at this hearing. If your application is denied by the Board
of County Commissioners, the decision could affect future land development applications located on this
parcel. Withdrawing applications will not generally affect future applications.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of
Approval normally associated with land use cases, and is willing to work with you in completing your
request. Please notify the Department of Planning Services, in writing, within 10 working days of your
decision. Planning Services Staff can be contacted at the above address or phone number.

Jacqueline, I met with Karen and Herbert Legg, regarding USR 1516, this afternoon and sorted out the septic
permit confusion. The following are my comments for conditions required prior to recording the plat:
Condition 1D Dust abatement plan This was approved by prior e-mail dated July 27, 2005. Condition met.
Condition 1E Kennel Eval. Not applicable. The kennel is dry cleaned. No septic system required. Condition
met.
Condition 1F Home Septic Eng Eval. Family business. Registered Engineer Evaluation is not required.
Condition met.
Condition 1G Stormwater discharge Not applicable. No new construction on property. Condition can be
removed.
Condition 1H Waste Handling plan. A plan has been submitted, reviewed and is approved. Condition met.
All Health Related condition prior to recording the plat have been met.

Pertaining to my USR-1516 at 15377 WCR 18 Fort Lupton CO 80621 and the issue of dust
abatement and Septic tank.
On July 18th 2005 I had a meeting with Ms. Char Davis of the Greeley, Co Dept. of Health and
Environment. She specified what should be in my proposal. I completed it as asked and faxed it
to her on the 19th of July 2005.
I've attached a copy of the proposal with this letter.
As for the septic tank system I also completed a Statement of Existing Septic System and will
deliver it to the Health Department as it has to be delivered and not faxed. There is a septic
system but it pre dates permitting.

Ms. Char Davis:
Pertaining to my USR-1516 at 15377 WCR 18 Fort Lupton, CO 80621. The following
maintenance is done to address our dust abatement.
All of the land not currently covered by our greyhound raising operation is kept planted in
reedgrass. This was suggested by the Soil Conservation office in Brighton, CO.
The dog runs have trees planted along them to break the wind and help keep dust down. These
are mostly sand as this is he best to produce strong dogs with stamina.
When we use the training track we bring in water and moisten the soil to keep dust down before
each use.
The drive-way and small parking area are dirt. This dirt has been compacted over 20 years of
use and produces very little dust. We also keep this moistened when need be. To keep it from
eroding with weather conditions we have farm equipment on the farm and see that it is
maintained.

In reference o USR-1516 pertaining to waste control management. On July 18`h 2005 I gave to
Ms. Char Davis of Weld County Dept. of Health and Environment the following plan. To which
she specified that I should be completely acceptable.
The only waste generated is collected daily in plastic garbage bags and deposited into covered
trash bins. These are removed weekly.
The company doing our removal is Waste Management of Denver P.O. Box 1238 Englewood,
CO 80150 (303)797-1600.
All major cleaning is completed and removed by large trash bins brought in for this specific
reason and removed upon completion of work.

In reference to USR-1516 pertaining to maintenance of the property at 15377 WCR 18 Fort
Lupton, Co 80621.
All maintenance is completed by my family. We have numerous farm implements and tractors.
We keep the property trash free and mowed on a regular bases.
The buildings are maintained and kept in good condition.
The trees are kept trimmed and away from all power lines.
As far as maintenance we keep the property as maintained as well and in most cases better than
most of the property in this area.
