RE: ACTION OF THE BOARD CONCERNING ZCV #1000066 AGAINST DAVID
CAMPBELL AND LAURA GILL FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, David Campbell and Laura Gill, ZCV #1000066, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of October, 2010, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, David Campbell and Laura Gill were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed
with legal action against David Campbell and Laura Gill to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties.

23-3-30 Accessory uses.
23-3-30.K Cargo container as Accessory STRUCTURE. One (1) cargo container as an Accessory STRUCTURE
in the A(Agricultural) Zone District may be permitted for storage of goods inside the unit. A cargo container used
for storage shall require the issuance of building permits. The following conditions shall apply:
23-3-30.K.1 Electricity is the only utility which will be connected to the cargo container used for storage.
23-3-30.K.2 The cargo container used for storage will not be used on any basis as a DWELLING or as overnight
or temporary housing for any person.
23-3-30.K.3 The property upon which the cargo container is to be located must be a LEGAL LOT.
23-3-30.K 4 The applicant shall not remove any structural component of the cargo container used for storage
making it unmovable.
23-3-30.K.5 A cargo container used for storage shall not be allowed to fall into a state of disrepair. Such disrepair
may include a cargo container that is partially or totally damaged by fire, earthquake, wind or other natural
causes, or is in a state of general dilapidation, deterioration or decay resulting from a lack of maintenance,

VIOLATION REMEDY:
After our discussions, I understand you intend to have a home constructed from the multiple cargo containers.
However, the Department of Building Inspections has not received a building permit application for such
construction. I hope by scheduling this hearing out until the October Violation Hearings, this will allow enough
time for a building permit application to be completed and submitted to this office, so construction can begin
and the zoning issues regarding the presence of the cargo containers can be remedied.
RECOMMENDATION:
The Department of Planning Services recommends this case be forwarded to the County
Attorneys Office for immediate legal action.

These containers are part of a building project and will not remain
containers.
The project is in development and documentation is being generated
by Krueger Architects
in Loveland, Colorado.
Containers were purchased in anticipation of the project, and
because availability of these particular ISBUs has become very
limited, we needed to proceed with purchase before they became
completely unavailable.
I apologize that we were out of town over the long weekend and I did
not pick up mail until
this evening and thus I did not reply within the requested 5 day time
frame.
I will contact you tomorrow 6/2/2010 to see what documentation you
need as perhaps information from the architect would be most
appropriate.

her that I did. She asked if I understood what they were proposing. I
asked her to explain it to me. She said none of the cargo containers
were being utilized - simply stored on the property. She said all of
them with the exception of 2 are brand new and cost approximately
$5000 a piece. She said she has already hired an architect to draw
up plans for a container home. She said as soon as he finishes his
plans she will have him send them in. I explained what the code
says and that I sent a 30 day letter the day prior. She said she
would watch for it and get in touch with her architect in the mean
time.

Hello -we are the architect working on Laura Gills home. I have
heard you have issues about the storage containers on her property.
The containers are for her new home and not for storage. We have
designed her a storage container home that will begin construction in
this July. Attached are drawings showing the home and how the
containers go together to create her home. See sheet number
A101.1 showing the location and use of the containers for each
section of her home. We are in the process of getting a structural
engineer on board to design the foundation.
The container out on her site are for the construction of Laura's
home. We will be turning in drawings for permit container home
sometime this next month. Please review the drawings and get back
with me with any concerns.
This home will be the first container home in Weld county and
northern Colorado. Container homes have been built in California and
used for emergency disaster relief housing in many places across
the world. You can look up Container city on the internet and see the
project in London, England.

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre-Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre-submittal agenda, the request and required checklist items must be received one week prior to

Bethany,
I would like the zoning department to investigate compliance with the Weld County zoning regulations at 2
locations, 14066 CR 84 and 40734 CR 29, Ault. Both are zoned as agriculture. I believe that the occupants are
in violation of 23-3-30 part K, Cargo Container as accessory structures. The zoning codes states that "two (2)
cargo containers may be allowed on property of less than eighty (80) acres in size..." There are currently=>4
containers on each of these properties. The containers at 40734 CR 29 have been in place for over 2 years and
in discussion with the owner, we were told these were temporary storage facilities that were to be removed
following the completion of their home which occurred over 18 months ago. The containers at the other
location (14066 CR 84) have just arrived in the past month and there are at least 7 containers currently on-site.
I have not discussed this issue with this neighbor as attempts to contact her via telephone have not been
successful and messages not returned. Both lots are—16 acres in size and adjoin my property to the
West/Northwest.
