Staff reviewed three recorded documents,Z-478,the Change of Zone Plat for Dos Rios, Inc.changing the existing zoning from R-1, Low Density Residential to E, Estate. This document was recorded in July 1993. Document two is the Final Plat, Dos Rios Estates Second Filing delineating the areas for secondary structures to be north of the Building Envelope. The drawing set was recorded on April 8, 1996. Document three is a resubdivision of Lots 1-4, Block 1 Dos Rios Estates,Second Filing(Phase II). The areas for secondary structures per this plat recorded August 23, 2006 delineates areas to the west of the building envelope,south of the oil and gas setback,and to the north of the building envelope. Attached is a diagram delineating these two areas allowing construction of secondary structures. The size of the structure is also restricted as the property is within a subdivision. Setbacks and offsets will be required and are restricted to 25 feet minimum per Final Plat Note"M." Further, Final Plat Note"O"states, "All lot owners within the subdivision shall strictly adhere to Section C-8 of Dos Rios Estates,Second Filing, protective covenants regarding pipelines, drainage, and utility easement restrictions." As a suggestion, as property owner it is beneficial to understand the protective covenants pertaining to secondary structures, prior to applying for building permits with Weld County.
