RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV#0800229 AGAINST SUZANNE KIBEL FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Suzanne Kibel, ZCV #0800229, is allegedly in violation of the Weld County
Code, and
WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not
been corrected, and
WHEREAS, on the 9th day of March, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Suzanne Kibel, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners has determined the property is in
compliance with the Weld County Code and deems it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800229 be, and hereby is, dismissed due to the property being in
compliance with the Weld County Code.

under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding

REMEDY
While it appears as though you have made substantial progress since our last visit, additional clean-up is
necessary to bring the property into compliance. As we have previously discussed,while the presence of
a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES,wood, buckets and miscellaneous
debris is an allowed use within an Agriculturally zoned subdivision, such as Aristocrat Ranchettes, it must
be completely SCREENED from all adjacent properties and public rights-of-ways; otherwise, any Derelict
Vehicles shall be operational at all times and evidence of current registrations shall be submitted to this
office.
I also noted furniture, plastic, trash and miscellaneous debris. These types of items shall be removed from
the property as Screening is not an option.
Hopefully by pushing this hearing out until the March Violation Hearings, this will allow enough time for the
property to be brought into compliance thus cancelling the hearing and closing the violation; otherwise,
additional time will need to be requested from the Board of County Commissioners at the hearing.
RECOMMENDATION
The Department of Planning Services staff recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

08/20/2008 Property Inspected Upon a visual inspection of the property, the following items
were noted: derelict vehicles, carpet, plastic, trash and
miscellaneous debris. No pictures were taken during this
inspection.
09/11/2008 Property Inspected Upon a visual inspection of the property, the following items
were noted: derelict vehicles, furniture, plastic and
miscellaneous debris. No pictures were taken during this
inspection.
09/19/2008 Phone Call Suzanne Kibel (303-857-4970) called. She left 2
messages. I attempted to call her back and left her a
message.
09/22/2008 Phone Call Suzanne Kibel (303-857-4970) called and left another
message. She said she works graveyard shift and needs
return phone calls before 1pm. I called her back. We
discussed the violation. She was talking about how Dwane
had lost his license due to child support and therefore they
hadn't re-tagged the vehicles, but he was looking at getting
his license back and they would be re-tagging the vehicles.
She said they were re-carpeting inside the house and
therefore, they temporarily moved items outside. She
asked for specific items I had problems with, so I offered to
meet her on the property this Friday(09/26/08) at 11 am.
09/26/2008 Property Inspected During an on-site inspection with Dwayne&Suzanne Kibel,
the following items were noted: the truck is derelict, but
should be plated within a month or so. There is a derelict
white car, but it should be plated within a week or so.
There are several piles of fencing, iron/metal,

wood, chairs and miscellaneous debris. Most of the items
are related to"unfinished" projects. I advised them that I
would send them a 60 day letter instead of my usual 30
day. I explained the importance of them letting me know if
they needed additional time prior to the expiration of the 60
day notification; otherwise, I would be scheduling them for a
Violation Hearing (if they weren"t done) and once I
schedule a case, I do not vacate the hearing unless the
property is in compliance. They said they understood. No
pictures were taken during this inspection.

During our inspection, we discussed the majority of the violation pertains to the
Southeastern corner of the property, where iron/metal, wood, furniture (chairs), fencing, the
2 current Derelict Vehicles and miscellaneous debris is primarily situated.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
12/01/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.
