RESOLUTION WHEREAS, a public hearing was held on slay 12, 1976, in the chambers of the Board o₹ County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of JJ!ts Stevens, Fort Collins, Colorado, requesting a conditional use permit for the construction of multi-family farm labor housing upon a tract of land located in the north- east quarter of Section 16, Township 7 North, Range 67 West of the 6th P.M., Weld County, Color-ado, being more particularly described as follows: Considering the North line of the NEq of the said Section 76 as bearing N 89° 58' 32" W and with all bearings contained herein relative thereto: Commencing at the NE corner of the said Section 16; thence along the said North line, N 89° 58' 32" W, 418.10 feet to the easterly right of way of County Road 19; thence along the said easterly right of way of said County Road 19, S 17° 09' 32" E, 946.97 feet to the True -?Dint of Beginning of the said tract of land; thence leaving said right of way -5 01° 18' 57" W, 120.94 feet; thence S 33° 26' 27" E, 158.00 feet; thence S 56° 33' 33" W, 84.75 feet; thence, N 33° 26' 27" W, 242.78 feet to a point on the south right of way of said County Road 19; thence along the said south right of way line, N 51° 08' 28" E, 154.38 feet to the True Point of -Beginning, containing two acres, more or less, being situate approximately 1/8 of a mile south of_Highway 14 on County Road 19, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of the petitioner for the location of said mobile have upon the aforementioned premises, and WHEREAS, the said requested location for the aforementioned mobile home is located in an agricultural zone as set forth by the Weld County Zoning Resolution, aria WHEREAS, according to Section 3.3 (A) of the Zoning Resolution of Weld County, said conditional use permit for the construction of multi- family farm labor housing may be authorizedupon the approval of the Board of County Commissioners of Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed: NOW, THEREFORE BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the application and petition of James Stevens, of Fort Collins, Colorado, for construction of multi-family farm labor housing on the premises indicated above be, and it hereby is granted under the conditions following: 1. That the whole area will be adequately chain link fenced and said fencing shall also include and encompass the present quonset buildings located thereon and considered to be a part -of said multi-family housing project for farm labor. 2. The use of these labor -houses shall be restricted to the months of May through September. 2. The method of sewage disposal shall be in conformance with all appli- cable State and County Health regulations. 3. All structures shall be built in conformance with the building code adopted by Weld County (Uniform Building Code). 4. All structures shall be set back a minimum of 50 feet from the edge of the right-of-way of County Road 19. 5. No struc shall to built on any easement on the property. 6. Driveways and the parking area shall be graveled. A minimum of 10,000 square feet of parking area shall be provided. Perkins Tape 629 (#1732-1780) CASE NUMBER: VI-29 SUBJECT: Mobile Home Violation APPEARANCE: None LOCATION: W' Lot 5 Wiesner Subdivision DISCUSSION: Tom Honn read a summary of what has taken place into record. On February 28, 1974, Board of Adjustments granted a variance for one mobile home. March 17, 1976 a complaint was received from a neighbor that Mr. Perkins had moved a second mobile home onto the property. On March 24, 1976 the Zoning Inspector inspected the property and learned that the two mobile homes were going to be attached . A violation notice was issued for the 2nd mobile home. A violation letter was sent certified to Mr. Perkins on April 5, 1976. A second inspection was make on April 12, 1976. On April 5, 1976 the electrical inspector was asked to leave property and was threatened with dogs. The certified violation letter was returned by Post Office unclaimed on April 23, 1976. Mr. Wilbur (Attorney for Stonebrakers) explained that he felt the zoning application was in error and that it is beyond the jurisdiction of the Plan- ning Commission to rule on it. The application has not been signed by all the owners of the property concerned and he questions Amoco's legal right to drill on the property. Mr. Hickman stated for the record that Amoco Production Company was present for the purpose of a hearing . Other legal documents have been filed but have not been served yet. They will be used for pickle and sugar beet workers from the middle of June to the beginning of the frost season each year. These complexes are to be located on State Highway 14 and about 1/8 mile south on County Road 19. One complex will be built now and the other will be built at a later date. The Weld County Planning staff recommended approval for the following reasons: 1 ) The request is in conformance with the Weld County Comprehensive Plan and the intent clause in the Agricultural District, Section 3. 3(A) of the Weld County Zoning Resolution, since it is promoting agriculture as the predominant land use; 2) the Weld County Health Department recommends approval ; and 3) the Weld County Engineering Department identified no engineer- ing problems with the request and stated the existing access is satisfactory. Glen Paul stated that the bath facilities meet the State Plumbing Code requirements . Mr. Stevens represents Western Food Products Company. TAXI : Lessee shall pay all taxes assessed and levied against the improvements constructed by Lessee during the term of this Lease and any extension thereof. G. In URANC : The Lessee shall ply such insurance and in such amounts as Lessee shall determine, covering said improve- ments during the term of this Lease end any extension thereof. 7. MAIUTENA CE: Lessee shall perform, or cause to be performed, all maintenance that Lessee shall determine is necessary or advisable during the term of this Lease and any extension thereof 8. UTILITIES: Lessee shall pay all utilities expense incurred and pey ble by reason of utilization of said utilities upon said premises during the periods of time, or times, that Lessee shall be utilizing said premises for the purposes herein provided, and during the tims that the improvements upon said premises are not being utilized. Lessor shall pay all utilities utilized upon said premises during the times and to the extent of utilization of said premises and improvements by Lessor, as herein- before provided. 9. 0, r;.x.siiiP: All improvements constructed upon the above described premises by Lessee, upon the termination of the primary term of this Lease as provided in paragraph 1 hereof, or the termination of any extension thereof as hereinafter provided, shall beccmo the sole property of Lessor. , 10.
