RESOLUTION
WHEREAS, a public hearing was held on slay 12, 1976, in the
chambers of the Board o₹ County Commissioners, Weld County, Colorado, for
the purpose of hearing the petition of JJ!ts Stevens, Fort Collins,
Colorado, requesting a conditional use permit for the construction of
multi-family farm labor housing upon a tract of land located in the north-
east quarter of Section 16, Township 7 North, Range 67 West of the 6th
P.M., Weld County, Color-ado, being more particularly described as follows:
Considering the North line of the NEq of the said
Section 76 as bearing N 89° 58' 32" W and with all
bearings contained herein relative thereto:
Commencing at the NE corner of the said Section 16;
thence along the said North line, N 89° 58' 32" W, 418.10
feet to the easterly right of way of County Road 19;
thence along the said easterly right of way of said County
Road 19, S 17° 09' 32" E, 946.97 feet to the True -?Dint of
Beginning of the said tract of land; thence leaving said
right of way -5 01° 18' 57" W, 120.94 feet; thence S 33°
26' 27" E, 158.00 feet; thence S 56° 33' 33" W, 84.75
feet; thence, N 33° 26' 27" W, 242.78 feet to a point on
the south right of way of said County Road 19; thence
along the said south right of way line, N 51° 08' 28" E,
154.38 feet to the True Point of -Beginning, containing
two acres, more or less, being situate approximately
1/8 of a mile south of_Highway 14 on County Road 19,
and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the petitioner
for the location of said mobile have upon the aforementioned premises, and
WHEREAS, the said requested location for the aforementioned mobile
home is located in an agricultural zone as set forth by the Weld County
Zoning Resolution, aria
WHEREAS, according to Section 3.3 (A) of the Zoning Resolution of
Weld County, said conditional use permit for the construction of multi-
family farm labor housing may be authorizedupon the approval of the Board
of County Commissioners of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all the testimony
and statements of those present; has studied the request of the petitioner
and studied the recommendations of the Weld County Planning Commission, and
having been fully informed:
NOW, THEREFORE BE IT RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, that the application and petition of James Stevens,
of Fort Collins, Colorado, for construction of multi-family farm labor housing
on the premises indicated above be, and it hereby is granted under the
conditions following:
1. That the whole area will be adequately chain link fenced and
said fencing shall also include and encompass the present quonset buildings
located thereon and considered to be a part -of said multi-family housing
project for farm labor.
2. That permitee be granted the privilege of having a person
live on subject property the year round for maintenance and security purposes.

3. That the permit herein granted shall remain in full force
and effect so long as subject property is used for multi-family housing for
farm labor; otherwise, for good cause shown, the Board may revoke the permit
and said structures shall be moved off the premises within 90 days.

DEVELOPMENT STANDARDS (PROPOSED)
1 . The uses permitted under this Conditional Use Permit are two ten-
unit migrant farm labor houses with two unattached bath houses. The
use of these labor -houses shall be restricted to the months of May
through September.
2. The method of sewage disposal shall be in conformance with all appli-
cable State and County Health regulations.
3. All structures shall be built in conformance with the building code
adopted by Weld County (Uniform Building Code).
4. All structures shall be set back a minimum of 50 feet from the edge
of the right-of-way of County Road 19.
5. No struc shall to built on any easement on the property.
6. Driveways and the parking area shall be graveled. A minimum of 10,000
square feet of parking area shall be provided.

room, second floor, Public Health Building, Greeley, Colorado.

DISCUSSION: Tom Honn read a summary of what has taken place into record.
On February 28, 1974, Board of Adjustments granted a variance for
one mobile home. March 17, 1976 a complaint was received from
a neighbor that Mr. Perkins had moved a second mobile home onto the
property. On March 24, 1976 the Zoning Inspector inspected the
property and learned that the two mobile homes were going to be
attached . A violation notice was issued for the 2nd mobile home.
A violation letter was sent certified to Mr. Perkins on April 5, 1976.
A second inspection was make on April 12, 1976. On April 5, 1976
the electrical inspector was asked to leave property and was threatened
with dogs. The certified violation letter was returned by Post Office
unclaimed on April 23, 1976.

DISCUSSION: The Planning Commission received a temporary restraining
order at 10: 15 A.M. before the meeting . Mr. Wilbur (Attorney
for Stonebrakers) explained that he felt the zoning application
was in error and that it is beyond the jurisdiction of the Plan-
ning Commission to rule on it. The application has not been
signed by all the owners of the property concerned and he questions
Amoco's legal right to drill on the property. Mr. Hickman
stated for the record that Amoco Production Company was present
for the purpose of a hearing . Other legal documents have been
filed but have not been served yet. Gary Fortner read the
restraining order into record.

DISCUSSION: Mr. Stevens explained that these structures will be
two ten-unit complexes with outside bath houses. They will be
used for pickle and sugar beet workers from the middle of June
to the beginning of the frost season each year. These complexes
are to be located on State Highway 14 and about 1/8 mile south on
County Road 19. One complex will be built now and the other will
be built at a later date. The Weld County Planning staff recommended
approval for the following reasons: 1 ) The request is in conformance
with the Weld County Comprehensive Plan and the intent clause in
the Agricultural District, Section 3. 3(A) of the Weld County Zoning
Resolution, since it is promoting agriculture as the predominant
land use; 2) the Weld County Health Department recommends approval ;
and 3) the Weld County Engineering Department identified no engineer-
ing problems with the request and stated the existing access is
satisfactory. Glen Paul stated that the bath facilities meet the
State Plumbing Code requirements . Mr. Stevens represents Western
Food Products Company.
RESOLUTION: De it therefore resolved to recommend to the Weld County
Commissioners approval of this request for multi-family labor
housing (CUP 17) on property described as the NE'a Sec . 16 T7N R67W.
Motion by Chuck Carlson. Seconded by Harry Ashley. A vote of "aye"
by Elliott, Yost, Weigand, Heitman, Ashley, and Carlson. Motion Carried.

strip and to trim and to cut down and clear away any trees on either
side of said strip which now or hereafter in the opinion of second party
may be a hazard to said towers, poles and/or other structures, wires or
cables , by reason of the danger of falling thereon, or may interfere
with the exercise of second party's rights hereunder; provided, however,
that all trees which second party is hereby authorized to cut and remove,
if valuable for timber or wood, shall continue to be the property of
first party, but all tops, lops, brush and refuse wood shall be burned
or removed by second party;
(c) the right from time to time to enlarge, improve, reconstruct, relocate
and replace any poles, towers or structures constructed hereunder with
any other number or type of poles or towers or structures either in
the original location or at any alternate location or locations within
said strip;
(d) the right to install , maintain and use gates in all fences which now
fl cross or shall hereafter cross said strip;
(e) the right to mark the location of said strip by suitable markers set
in the ground; provided that said markers shall be placed in fences or
other locations which will not interfere with any reasonable use first
party shall make of said strip.
Second party hereby covenants and agrees:
(a) second party shall not fence said strip;
(b) second party shall promptly backFill any excavations made by it on said
strip and repair any damage it shall do to first party's private roads
or lanes on said lands;

(c) second party shall indemnify first party against any loss or damage
which shall be caused by the exercise of said ingress and egress or by
any wrongful or negligent act or omission of second party or of its
agents or employees in the course of their employment.
First party reserves the right to use said strip for purposes which will not
interfere with second party's full enjoyment of the rights hereby granted;
provided that first party shall not:
(a) erect or construct any building or other structure, or drill or operate
any well , or construct any reservoir or other obstruction, or add to the
ground level in said strip; provided that first party may install fences
and underground pipelines with the written consent of second party, which
consent shall not be unreasonably withheld;
(b) deposit, or permit or allow to be deposited, earth, rubbish, debris, or
any other substance or material , whether combustible or noncombustible,
on said strip, or so near thereto as to constitute, in the opinion of
second [party, a hazard to said towers, poles, and/or other structures,
wires or cables;
(c) grant any easement cr easements on, under, or over said strip without
the written consent of second party.

assigns of the respective parties hereto, and all covenants shall ap

PRODUCTS CO. , INC. , a Y.ansas corporation, with its principal
Colorado office located at La Junta, Colorado, (hereinafter
referred to as Lessee) ,

viinn'AS, Lessor is the, owner of the NE'; of Section 16,
Township 7 North, Range 67 West of the 6th P. M. in Weld County,
Colorado; and
WIWREA3, Lessee is desirous of constructing agricul-
tural labor housing on two acres, more or less, of said real
estate; and
W^,.1Psn?.AS, Lessor is desirous of permitting said construc-
tion and leasing of said real estate to Lessee,
NOW, Tr? rcUOR , for the considerations herein provided,
and upon the terms and conditions hereof, Lessor does hereby
demise and lee unto Lessee the following described real estate
situate in the County of Weld and State of Colorado, to-wit:
Two acres, more or less, in the NE'4 of Section 16,
Township 7 North, Range 67 test of the 6th P. P4. ,
being situate approximately one-eighth of a mile
South of highway 14 on County Road 19, and more
specifically described as follows:
1. TERN: Lessee shall have and hold the above des-
cribed premises, together with all improvements situate thereon
and hereafter constructed thereon, for a period from the date
hereof to and including April 1, 1986.
2. RENTAL: In consideration of the improvements to
be constructed upon the said property by Lessee and other valu-
able consideration herein provided, Lessee shall pay to Lessor
no lease rental during the term of this lease provided in para-
graph 1 hereof.
3. CONSTRUCTION: Lessee agrees to construct upon the
said tract of land agricultural labor housing in accordance with
such plans and specifications as Lessee in its sole discretion
shall determine; provided, however, that said housing shall be
in accordance with requirements of the appropriate agencies of
the State of Colorado.

4. Lessee sl i 11 have the right to utilize said
premises and improvements for housing of agricultural labor;
provided, however, that at such times as the use of said premises
for said purpose is not desired by Lessee, Lessor shall have the
right to utilize said premises and improvements for agricultural
labor. •
5. TAXI : Lessee shall pay all taxes assessed and
levied against the improvements constructed by Lessee during the
term of this Lease and any extension thereof.
G. In URANC : The Lessee shall ply such insurance and
in such amounts as Lessee shall determine, covering said improve-
ments during the term of this Lease end any extension thereof.
7. MAIUTENA CE: Lessee shall perform, or cause to be
performed, all maintenance that Lessee shall determine is necessary
or advisable during the term of this Lease and any extension thereof
8. UTILITIES: Lessee shall pay all utilities expense
incurred and pey ble by reason of utilization of said utilities
upon said premises during the periods of time, or times, that
Lessee shall be utilizing said premises for the purposes herein
provided, and during the tims that the improvements upon said
premises are not being utilized. Lessor shall pay all utilities
utilized upon said premises during the times and to the extent of
utilization of said premises and improvements by Lessor, as herein-
before provided.
9. 0, r;.x.siiiP: All improvements constructed upon the
above described premises by Lessee, upon the termination of the
primary term of this Lease as provided in paragraph 1 hereof, or
the termination of any extension thereof as hereinafter provided,
shall beccmo the sole property of Lessor. ,
10. IN;RESSSAND EGRESS: Lessor agrees to grant to and
provide to Lessee all rights of ingress and egress to said property
necessary, convenient or practical for utilization of said premises
and improvements by Lessee during the term hereof and any extension
thereof.
11. 00VE Ac1T O?' TITLE, AUTHORITY AND QUIET POSSESSION:
Lessor covenants and warrants that Lessor has full right and
lawful authority- to enter into this Lease for the full term
aforesaid and that Lessor is lawfully seized of the ent;re
premises hereby demised and has good title thereto. free and
clear:of all tenancies.
Lessor further covenants and warrants that, if Lessee
shall discharge the obligations herein set forth to be performed
by Lessee, Lessee shall have and enjoy, during the term hereof,
the quiet end undisturbed possession of the premises demised,
together with all appurtenances appertaining or appendant thereto.

. 12. OPTION: As a p,-ft of the con3id-gyration herein:
(a) Lessor does hereby grant to Lessee .
the option to lease the above described premises
and improvements for an additional term from
April 1, 1986 to March 31, 1996 at an annual
rental of $ , payable annually in
advance, upon the same terms, conditions and
provisions hereinbefore provided for the primary
term of 10 years, excepting only the amount of
annual rental.
(b) Exercise of this option by Lessee
must be exorcised by written notice from the
Lessee to Lessor or Lessor 's Personal Repre-
sentative, heirs, successors or assigns on
or before sixty (GO) days preceding the expira-
tion of the primary term of this Lease provided
in paragraph 1 hereof, which notice may be
given by written notice transmitted to Lessor,
her Personal Representative, heirs, successors
or assigns by ordinary mail, postage prepaid.
13. This Lease shall be binding upon the parties -
hereto and their successors, heirs, Personal Representatives
and assigns.
IN WIT 2SS WHEREOF,EOF, said Lessor and Lessee have signed
this Lease dry and year first above written.
