HomeMy WebLinkAbout20101214.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000033 AGAINST VICTOR HILLMANN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Victor Hillmann, ZCV#1000033, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of June, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Victor Hillmann, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 8, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000033 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Victor Hillmann to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until July 8, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance by completing the screening of the site, or by obtaining license plates for all vehicles located on the property. RECOMMENDATION: The Department of Planning Services recommends that this case be forwarded to the County Attorney's Office for immediate legal action. HE ASKED WHO COMPLAINED. I TOLD HIM THAT FROM THE CALL IT DID NOT APPEAR TO BE A NEIGHBOR, THAT IT WAS SOMEONE DRIVING BY. HE SAID HE HAD BEEN MEANING TO DO IT ANYHOW. HE HAD SHEET METAL, LIKE HIS SHED, IF THAT WAS OKAY. I TOLD HIM AS LONG AS IT WAS PAINTED A NEUTRAL COLOR THAT WOULD BE FINE. HE SAID HE DIDN'T KNOW IF THE PERSON THAT COMPLAINED WAS IN A TRUCK OR CAR BECAUSE THE HIGHER UP THE VEHICLE WAS HE MAY NEED TO GO HIGHER ON HIS FENCE. I TOLD HIM AS LONG AS IT WAS AT LEAST 6 FT HE WOULD BE IN COMPLIANCE WITH THE COUNTY. I TOLD HIM WE GIVE 30-DAYS BUT IF SUBSTANTIAL PROGRESS HAS TAKEN PLACE IN THAT TIME, ONE 30-DAY EXTENSION MAY BE GRANTED. HE SAID HE WOULD GET IN TOUCH WITH ME AS HIS DEADLINE APPROACHES.
