WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 16th day of October, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption number 344 , being the property of Mary M. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Mary M. P. Camenisch and the Longmont National Bank, trustee of the Mary M. Camenisch trust . The property on which the recorded exemption has been requested is described as Pt . of the NE4 of Section 10, T2N, R68W of the 6th p.m. , Weld County, Colorado. This property is located immediately west of the Del Camino complex at the interchange of Interstate 25 and State Highway 119. The subject property contains 5. 79 acres of Commercially zoned property. The request is to split the property into parcels of 3. 15 acres and 2 .64 acres. Mr. J. P. Camenisch desires to sell the 3. 15 acre parcel to Howard and Eugene Frame, who intend to use the parcel for commercial storage of insulation materials . The 2.64 acre parcel will continue to be the personal residence of Mr. Camenisch. Based upon the information submitted and the adopted policies in the county, the Department of Planning Services staff recommends the request be approved for the following reasons : 1. The proposed split conforms with the recorded exemption intent clause and the Weld County Comprehensive Plan. The use would be compatible with surrounding land uses. The request would allow a higher and better use of the Commercially zoned property. 2. The 5 acre + parcel has a low utility for agricultural use due to the amount of acreage and the intent for commercial develop- ment which the county Commercial Zone District allows. The Colorado Division of Highways, in a letter dated October 2, 1978, has indicated an apparent discrepancy exists between the recorded exemption plat showing a 72-foot half right-of-way on the south side of State Highway 119 and the plans of the Division of Highways showing a 75-foot half right-of-way. They have suggested this discrepancy be resolved before final action is taken on this matter. The staff is recommending that the following be a condition for approval : The applicant shall resolve the discrepancy on the recorded exemption plat that exists concerning the State Highway right-of-way before recording the recorded exemption plat . Camenisch application for a Recorded Exemption, and we ask for your consideration of the following comments. 1 . The attached copy of our right-of-way plans would seem to differ from the plat which has been provided for our review. The plat shows a 72-foot half right of way on State Highway 119, whereas our plans indicate a 75-foot half right of way. This discrepancy should be resolved before final action is taken on this matter. 2. The location of the 20-foot ingress and egress easement is consistent with our right-of-way plans. No further access to either Parcel A or B should be anticipated, since this highway does have access control . 3. Our primary concern with regard to this exemption request relates to its planning and transportation implications. The Weld County Comprehensive Plan addresses this issue on page 60. In summary, the trend toward commer- cial development along access-controlled highways, particularly near inter- changes, is viewed as an undesirable situation. We support this position and we agree that the encouragement of commercial uses, other than essential services to motorists, could disrupt the functioning of the interchange at Interstate 25 and State Highway 119. If commercial usage should be allowed to continue along S.H. 119, the develop- ment of a frontage road system, outside of State Highway right of way, should be considered. A 50-foot strip of land would be needed to accommodate a frontage road, 30 feet for the paved surface and 20 feet for a buffer from the highway right of way. Such a frontage road system would allow for the placement of major access points at properly spaced locations to eliminate conflicting left turns off the arterial and optimization of regulated traffic control . CHUCK CUNLIFFE October 2, 1978 Page Two Provisions for the actual construction of the frontage road by the developers should be a function of the County's overall plan and anticipated zoning in this area. At a minimum, right-of-way needs should be anticipated and provided for at this time, whereas actual construction might be deferred until actual need is demonstrated or access to adjoining property is required. However, the cost of building a frontage road should not be deemed a responsi- bility of the Department of Highways. Thank you for the opportunity to review this application.
