HomeMy WebLinkAbout20102648.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING BCV #1000070 AGAINST GLENN AND PAMELA PACKER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Glenn and Pamela Packer, BCV #1000070, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of November, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, the property owners were present at said hearing and provided testimony, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 9, 2011, to allow adequate time for the property owner(s) to bring the subject property into compliance by either removing the tent-like structures from the property, or by obtaining the appropriate permits. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Glenn and Pamela Packer, to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until January 9, 2011, to allow adequate time for the property owner(s) to bring the subject property into compliance by either removing the tent-like structures from the property, or by obtaining the appropriate permits. He does not believe the tent structures need permits as there is nothing structural. I explained that anything 120 SF and over needs to be permitted. He said he has five of them. He is very unhappy about this and said he doesn't have much work so is very short of money. I told him he needs to submit the applications and doesn't need to pay at that time. We will process them and call him when they are ready to be issued and will tell him the fees at that time. He said this is just stupid. 07/13/2010 Phone Call Phone call from Glenn Packer.
