WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land, being
the property of Leonard I. Schaeffer, Greeley, Colorado, and more
particularly described as follows, to-wit:
The West Half (WI) of the Northeast Quarter (NEI) of
Section 2, Township 5 North, Range 64 West of the 6th
P.M. , Weld County, Colorado, being more particularly
described as follows:
Beginning at the Northeast Corner (NE Cor) of said
Section 2, and considering the North Line of the North-
east Quarter (NE') of said Section 2, as bearing South
90°00'00" West, with all other bearings contained herein
relative thereto. Thence South 90°00'00" West, along
said North Line, 1320. 42 feet to the True Point of Be-
ginning;
Thence South 00°57'30" West, 2648. 50 feet to a point on
the South Line of the Northeast Quarter (NEI) of said
Section 2;
Thence South 89°59'28" West, along said South Line,
1321. 60 feet to the Center of said Section 2;
Thence North 00°58'58" East, along the West Line of the
Northeast Quarter (NE1) of said Section 2, 2648. 73 feet
to the North Quarter Corner (N4 Cor) of said Section 2;
Thence North 90°00'00" East, along the North Line of the
Northeast Quarter (NEI) of said Section 2, 1320.47 feet
to the True Point of Beginning, containing 80. 313 acres,
more or less, and
does not come whin the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, desires to exempt this particular division of land upon the
recommendation of the Weld County Zoning Administrator for the reasons as
stated and pursuant to its authority under CRS 106-2-33 (d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described
tract of land owned by Leonard I. Schaeffer, Greeley, Colorado, be exempt
from the definition of the terms "subdivision" and "subdivided lands" as pro-
vided for in the new Weld County Subdivision Regulations at Section 201 A., (3)
adopted August 30, 1972, as amended.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 7th day of January, A.D. , 1976.

Dear Sirs:
The attached materials pertain to a request from Leonard I. Schaeffer for
a recorded exemption on his property in the W1 of the NEU of Section 2,
T5N, R64W of the 6th P. M. , Weld County, Colorado. The parcel involved
contains 80.313 acres, and Mr. Schaeffer proposes to split off a 1 .586
acre parcel with existing improvements.
The Planning Commission staff recommends approval for the following
reasons:
1 . The proposed exemption meets the intent clause of Section
9-2 of the Weld County Subdivision Regulations in that
non-productive agricultural land is proposed to be split
off.
2. All requirements for submission have been met.
