NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the petition of Blehm Land and Cattle Company for a change of zone from A-Agricultural Zone District to E-Estate Zone District on the abovedescribed tract of land be, and hereby is, granted subject to the conditions contained in the Planning Commission recommendations dated October 2, 1979 . BE IT FURTHER RESOLVED by the Board that the reasons for approval of the change of zone are as follows: 1. The proposal is consistent with the policies of the Weld County Compre- hensive Plan. 2. The uses which would be allowed on the subject property by granting the change of zone will be compatible with the surrounding land uses. 3. Adequate water and sewer service can be made available to serve the site. 4. Road and highway facilities providing access to the property are adequate in size to meet the requirements of the proposed zone district. Tom Norton, Engineer and representative of the applicant, elaborated on the plans for- this site that necessiates said change of zone. Walker Miller, Legal Counsel for the applicant, was present. Mr. Fagan, President of Little Thompson Water District, was present and stated that they will provide water for this property. There was no one present in opposition to this request. Commissioner Steinmark made a motion based on the Planning Commission' s recommendation to approve the Change of Zone from A (Agricultural District) to E (Estate District) , including the Planning Commission' s comments and finding that adequate water and sewer is available, that the request is not in confliet with continiuty of the Town of Milliken, and that it does comply with the comphrensive plan. Commissioner Kirby seconded the motion and it carried unanimously. Blehm Land and Cattle Company Z-327 :79 : 11 PLANNING COMMISSION RECOMMENDATION October 2, 1979 the desires of the towns as expressed in their comprehensive plans . Additionally, the agricultural policies in the Weld County Comprehensive Plan state: "In order to minimize conflicting land uses and minimize the cost of new facilities and services to the taxpayer, industrial, commercial, business and residential development will be encouraged to locate adjacent to the existing 27 incorporated towns and in accordance with the comprehensive plans and states wishes of each community. " The proposed development is within 5 mile of the Town of Milliken separated only by the Big Thompson River and its respective floodplain. The Towns of Milliken and Johnstown have given their approval of this request. 3 . It is the opinion of the Planning Commission that the request is in conformance with Section 81-5 of the Weld County Zoning Resolution in that the request is consistent with the Weld County Comprehensive Plan, will be compatible with surrounding land uses, and will have adequate water and sewer service available to the site to serve the proposed uses permitted on the property. Generally: The Weld County Comprehensive Plan (hereafter "Plan") , in recognizing the essential characteristics of this County, estab- lished the controlling criteria of growth and maintenance of the existing environment: Highly productive irrigated farmland should be preserved and non-rural growth should occur within or near existing communities. Consis- tent with those fundamental ideas, the Weld County Future Land Use Map was developed to indicate various growth areas around existing communities. This was concededly done with broad brush and in any given particular circum- stance cannot be viewed as an absolute. In the language of the Plan itself: "As new facts are developed and new trends evolve, the plan must be changed and improved to more precisely match the needs and wants of the citizens." (Plan at pp. vi and vii) . Exactly that sort of detailed analysis is required with the application of Blehm Land and Cattle Co. for rezoning from A-1 District to E Estate District. Such a rezoning is entirely consistent with the funda- mental purposes and intentions of the Plan; strictly speaking, however, the actual acreage is not included within a "future growth area." The Applicant believes that more precise knowledge is now available and the rezoning appli- cation should be granted as being consistent with the Plan. To the extent the Plan varies in its generalized designation of this area, the Plan is in error, undoubtedly simply because of lack of detailed knowledge at the time of its preparation. 2. Location of Subject Land: The subject land is less than two- thirds of a mile (approximately 3300 feet) to the North-Northwest of the Town of Milliken (across the flood plain and river) . It is approximately two miles to the Northeast of the Town of Johnstown. Although within close radius of both towns, the Land Use Map does not designate the subject land as being within the "future town growth area" of either community. It is nevertheless "in close proximity" to both and, in particular, utility service is readily available with the Town of Milliken. Accordingly, it is quite consistent with the goals of the Plan (see generally pp. 52-53 of Plan) . 3. The Plan is in Error in its Designation of the Growth Area Around Milliken: The Land Use Map shows Milliken's growth area to be West, South and North of its present boundaries. The most northern extension of the designated growth area appears to be within the flood plain and is also traversed by several railroads. The western and southern areas of the growth area encompass highly productive, prime agricultural lands. Although no growth is shown to the East of the Town, the problem of invasion of prime agricultural land would be the same. In short, the growth areas designated would seem inconsistent with the fundamental criteria of protecting highly productive agricultural land and the avoiding of development within flood plain areas. The explanation for this undoubtedly lies in the fact that there was a broad base analysis at the time of preparation of the Land Use Map. Assuming the general principle of growth around existing communities, this was simply shown as a growth area without detailed consideration of the facts. Since Milliken had not developed a master plan it is assumed that only such general analysis was applied. We are now afforded the opportunity of viewing the subject property and the Town of Milliken's growth area with more detail. We have reached the conclusion that the subject property should have been designated as the future growth area within the comprehensive plan in lieu of the other designations. As is set forth below, protection of highly productive farmland can be accomplished by permitting growth to occur North of the Big Thompson flood plain rather than to the South, West and East of Milliken. In fact, the subject parcel is the first piece of ground North of the flood plain, and except for the intervening flood plain, it would be contiguous to the designated growth area. Under any circumstances, it is the nearest property to Milliken that can be developed without the necessity of sit ik removing highly superior ground from agricultural use. Therefore, applying the criteria of the Plan, we believe the Plan is in error in this particular area now that we more precisely know the facts. 4. The Proposed Development is Very Consistent With the Goals and Purposes of the Plan: In terms of the actual goals and standards of the Plan, this land should be a growth area. Some of these considerations are as follows: a. The Subject Land is Very Marginal Agricultural Land: A detailed analysis by the Soil Conservation District has been submitted with the application. Remembering that the SCS does not make judgmental decisions based on configuration, irrigation difficulties, etc. , one still realizes that just the soil and slope characteristics show the entire tract to be very marginal (only 22 acres of the 226-acre site could be considered prime ground for agricultural purposes and even then the average slope is over 3.5 percent and of irregular shape). In the words of the representative of the Agricul- tural Extension Service the "total parcel is definitely not prime agricul- tural land. There are small, uneven areas that could be farmed; however, it would not appear practical due to the size and shape of these tracts." His- torically such has been the use. Accordingly, development of this ground as a growth area extension of Milliken is quite logical. b. Agricultural Water Use Will Not be Impaired: The property itself has excessive water rights assigned to it and more than adequate water exists. More importantly, the complete ownership of the Hill Seepage Ditch year-round flow is possessed by the Applicant. This water will be used to the full extent permitted by law by the Applicant and will consequently avoid decrease in agricultural use of existing water rights. c. The Subject Property is in Close Proximity to the Existing Communities: Although not actually contiguous to the Town of Milliken, it is nevertheless quite near or in "close proximity" to Milliken. As detailed above, it is the closest non-productive area for growth. d. Protection of Highly Productive Agricultural Lands: Ad- justing the growth pattern of the Town of Milliken as suggested by this ap- plication will result in the protection of prime irrigated farmland rather than its consumption for non-rural use. Any alternative to Milliken's growth other than as proposed by this application would be inconsistent with that fundamental basis of the Plan. e. Excellent Transportation Connections Exist: The property borders on Highway 257. Accordingly, existing street and highway facilities will be utilized to the maximum extent. f. Municipal or Quasi-Municipal Services Are Readily Avail- able: Because of its close proximity to Milliken and established water dis- tricts, standardized utilities for water and sewer service are readily avail- able, consistent with the Plan goals. g. Environmental Protection and Open Space: It is difficult to imagine a development more suited to protection of these key considerations. When viewed as a whole, the proposed living unit density would be less than one per two acres. Because of the golf course and flood plain dedications, more than half of the area will become very attractive and pleasing open space. The natural year-round flow of water has already been enhanced and protected. The development of the golf course will include tremendous increase in vege- tation for wildlife cover, ground protection and simple aesthetics. By very definition a tremendous greenbelt will be established with permanency. h. The Needs and Desires of the Citizens of the Area Will be Met: As is evidenced by letters submitted and the virtual lack of objection, the desire of the local citizenry and their needs will be met by the develop- ment proposed by this application. -2- Ac 5. Conclusion: In summary conclusion, this application is very consistent with the goals and standards of the Plan. Technically, the subject property is not within the broad brush designated growth area of Milliken. More detailed and precise knowledge reveals, however, that this application should be granted as being highly consistent with the goals of the Plan, which are much more important than an arbitrary estimate established several years ago. It is requested that the zoning be modified from A-1 Agricultural to E Estate. We are also submitting under separate cover a Conditional Use Application for a golf course on the adjoining 93-acre parcel. Although necessarily separate applications, they are in fact closely related and derive from common owner- ship. The total parcel involved in the project is 221.8 acres including Highway 257 right-of-way to centerline, with approximately 93 acres of ground to be developed into the golf course, 101 acres to be developed into housing, 20 acres to be left in pasture for utilization by owners in the estate area, and the balance of eight acres to remain Highway right-of-way. The subject parcel lies 3,300 feet North of the Milliken Town boundary. It cannot be annexed at present because of intervening ownership. The Town is anxious to see the project proceed and has agreed to furnish util- ity service. Copies of letters from the Town and the Milliken Sanitation District are enclosed. Milliken does not have a comprehensive plan. The applicable plan is the Weld County Comprehensive Plan. It is our opinion that the subject parcel should have been designated E Estate in the Comprehensive Plan. Obviously the County-wide plan was based on only cursory analysis of towns that did not prepare their own plans. It is quite simple to understand how the A-1 zoning would have been assigned based on only a broad base analysis. Since afforded an opportunity to view the subject parcel and the Town of Mil- liken in a more detailed way, we have reached the conclusion that the area should have been designated as an E Estate in the Comprehensive Plan. Weld County Commissioners August 10, 1979 Page Two The Comprehensive Plan shows Milliken's growth areas to be West, South and North of the present developed areas. The West and South portions lie on highly productive prime agricultural property. The North area lies in flood plain and is traversed by several railroads. No growth is shown East of Town; however, the problem with prime agricultural land would be the same. The problem with highly productive farmland can be largely avoided by permit- ting growth to occur North of the Big Thompson rather than South and West. Specifically, this property is relatively unproductive from an agricultural viewpoint. Based on the Soil Conservation Service Report, a copy of which is attached, only 22 acres of the 222-acre site are considered to be prime ground for agricultural purposes; that classification is very marginal. The average slope of the 22 acres is over 3.5 percent with localized increases to over ten percent. Irrigation is difficult because of the slope and is further complicated because of the irregular shape. The Soil Conservation Service evaluation is based only on soil type and slope. They do not make judgment decisions pertaining to configuration, irrigation difficulties, or other problems which affect feasibility of farming a partic- ular parcel. Mr. Gene Inloes of the Agricultural Extension Service was con- tacted to furnish additional general judgment input. His conclusion was par- tially as follows: "This total parcel is definitely not prime agricultural land. There are small, uneven areas that could be farmed; however, it would not appear practical due to the size and shape of these tracts." A copy of Mr. Inloes' letter is submitted herewith. The subject parcel is the first piece of ground North of the Big Thompson. Except for the intervening flood plain, it would be contiguous with the Com- prehensive Plan growth area. It is the nearest property to Milliken that can be developed without the necessity to remove highly superior ground from agri- cultural use. We consider the site ideally suited for Estate-type residential development. It is aesthetically very appealing. The view is excellent and will be further improved by the proposed golf course construction. Land to the South and West is presently wasteland and is being put to no use. The railroad lies just South of the parcel and the property South of the railroad is flood plain. Highway 257 adjoins the property on the East. Ignoring the highway, the Northerly 1,000 feet is joined on the East by a farm with one dwelling. The South 3,000 feet is joined on the East by vacant unproductive ground. The adjoining uses appear totally compatible with the proposed rezoning. 4r Weld County Commissioners August 10, 1979 Page Three Adequate water and sewer service are available from Milliken or the Milliken Sanitation District and the Little Thompson Water District. The Sanitation District advised that they have the capacity to serve and are anxious to provide service. Also, both Milliken and Little Thompson have six-inch lines with good pressure available; both are interested in furnishing service. Access to the property will be from State Highway 257 which is of sufficient capacity to meet all needs. Preliminary contact was made with the Highway Department to confirm that in- gress and egress could be arranged. Mr. Chotvacs and Mr. Finch thought three points of entrance would be available which is compatible with tentative de- velopment plans. The Highway Department would not furnish written confirmation of our conversa- tions; however, they did contact Mr. Cunliffe by telephone and indicated that access should not be a problem. The Southerly end of the proposed rezoning does lie within the 100-year flood limits. The boundary of flooding is shown on the map submitted herewith. A minimum of 200 feet of lot depth is available above the flooding limit. All structure construction will be limited to elevations above flood level. The remainder of the lots will be limited to pasture or other comparable use. The property is not located within any geologic hazard zone. The Colorado Geological Survey has advised that the parcel is not underlain by any commercial gravel deposits. A letter from Mr. Walter R. Junge so advising is enclosed. A soils study was made by the Soil Conservation Service and a copy is attached. They offered the comment that some soils classed as (34) were severely limited for homesite development. This soil class lies entirely outside the requested rezoning limits. All areas within the proposed rezoning limits are shown to "exhibit only slight limitations for homesite development." The Weld County Reorganized School District Re5J has reviewed the proposed de- velopment. The Board determined, at a meeting on August 13, that the probable growth would not place an undue burden upon the District. A letter confirming that action will be furnished under separate cover. In the course of preparing this submittal tremendous support for the project has been expressed by residents of the Milliken-Johnstown area and by busi- nesses in the area. Pt. SE 1/4 and Pt. NE 1/4 S. 34, T5N, R67W Pt. NE 1/4 S. 3, T4N, R67W I inspected this property, and my evaluation follows. This land is uneven, rolling, hilly, and rough. There is a slope to the majority of this parcel which would make irrigation difficult, utilizing normal irrigation systems. There is a portion of this property that would be almost impossible to farm except for grass due to the slope and terrain. Due to the slope, surface water runoff would be rapid with a high erosion hazard. The soil surveys for this farm show areas of shale and sandstone close to the surface and layers of clay in some areas. The soil under these conditions would have poor water permeability which would restrict the kinds of crops that could be grown and have a low production potential . The south portion of this property is low and seepy in appearance, which is restrictive to use. Some of the soil in this farm would be suited to limited cropping; however, intense farming would be hazardous because of erosion. This total parcel is definitely not prime agricultural land. There are small , uneven areas that could be farmed; however, it would not appear practical due to the size and shape of these tracts. First, I want to correct a statement concerning Colby loam, 1 to 3 percent slopes and Colby loam, 3 to 5 percent slopes. These soils are not high potential cropland without irrigation water available. They are prime soils with irrigation. Second, as indicated by your contour map prepared from the actual site measurement. There is probably more 40-D, Colby loam, 5 to 9 percent slopes, than indicated on our copy of the soil surveymap. There are probably about 20 to 25 acres of soil types Colby loam, 1 to 3 percent slopes and Colby loam, 3 to 5 percent slopes actually present, rather than the 50 acres indicated by the soil map. 20 acres of prime farmland, when surrounded by lesser potential soil, is very difficult to economically justify maintaining in today' s market place. The enclosed map will provide you with the location of the following soils. Colby loam, 1 to 3 percent slopes, (40-B) : This is a deep, well drained upland soil. When irrigated, this soil is considered prime farmland. Won- irrigated, it is considered high-potential. For homesite development, it - exhibits only slight limitations, which can be overcome with conventional construction methods. Colby loam, 3 to 5 percent slopes, (40-C) : This also is a deep, well drained upland soil. When under irrigation this soil is considered prime farmland. It is considered high potential when not -irrigated. There are slight limita- tions for -homesite development. Septic tank filter fields are adapted to the . site. Colby loam, 5 to 9 percent slopes, (40-D) : This is a deep, well drained upland soil. This soil is not prime farmland under irrigation and is not high poten- tial as non-irrigated cropland. This soil exhibits only slight limitations for -homesite-development and septic tank filter fields. Aquolls and Aquents, gravelly substratum, (34) : These are nearly level soils on bottom lands and floodplains. They are deep and poorly drained soils. They are not considered prime farmland under irrigation nor are they high potential cropland when not irrigated. They are severely limited for homesite development and 'segtit tank filter -fields due to-possible flooding and the possible-presence of a water table. 4 . . Page 2 - Blehm Project No. 79032 Thedalund loam, 1 to 3 percent slopes, (43-B) : This is a moderately deep, well drained soil. Depth to shale ranges from 20 to 40 inches. This soil has cropland capability, however, it is not considered prime farmland when under irrigation nor high potential cropland without irrigation. This soil has a moderate limitation for home development for dwellings without basements due to low load strength and for dwellings with basements due to depth to consolidated shale. Installation of septic tank filter fields is severely limited due to depth to rock. Thedalund loam, 3 to 9 percent slopes, (43-CD): This soil is moderately deep and well drained. Depth to shale ranges from 20 to 40 inches. Without irrigation it is not considered to have cropland potential and with irrigation, slope limits capability and erosion protection is a primary soil management consideration. This soil is not prime farmland. It moderately limits home development and severely limits installation of septic tank filter fields. Tassel fine sandy loam, 5 to 20 percent slopes, (84-DE) : This is a shallow, well drained soil on upland breaks. Included in this unit are some sandstone outcroppings. Depth to sandstone ranges from 10 to 20 inches. This soil is not cropland capable and should be maintained in permanent vegetative cover where possible. It moderately limits homesite development due to shallow depth to rock. Septic tank filter fields are severely limited due to shallow depth to sandstone which will not allow for proper function. I have discussed this matter with Paul Hoshiko, chairman of the board for the District. As you are aware, the Central Weld Board reconsidered this item at a regular meeting of the District. Mr. George Underwood attended the meeting requesting that immediate action was required for District service. The Board did not have time at that meeting to fully explore the available alternates or to communicate with the Little Thompson District regarding same. The agreement reference noted in your November 6th letter was not reviewed by the Board and needs to be addressed. We suggest that any final action or approvals regarding water service to the Blehm development be delayed until after the Districts resolve or agree on a satisfactory procedure. We have not received any further communication since our last communication to the town regarding said service to this development. Therefore, we are not aware of the current status on this item. Because of the November 14th hearing date and the limited time prior to that for further evaluating this matter, it does not appear possible to have a joint meeting between the Districtsand resolve this matter prior to the November 14th date. The Central Weld Board wishes to communicate fully with the Little Thompson Board to assure that we don't have further misunderstandings regarding this service. Existing agreements between the Districts were reviewed. It noted that the fourth paragraph of page 6 of the "Purchase and Sale Agreement" reads as follows: "In view of the possibility that Central may sell water to a third party as a result of said third party owning and constructing a water line to Central's main transmission line and connecting therewith within the Thompson District, Central hereby agrees that any and all agreements to sell water under such circumstances shall expressly deny to the vendee the right to sell water from his, hers, their, or its line within Thompson's District or in the immediate area of Thompson's District, to which Thompson offers service and readily serviceable by Thompson." It was further noted that the property in question is surrounded on all sides by property included within the boundaries of Little Thompson Water District. This property is capable of being served by the facilities of Little Thompson Water District. A hearing on the zoning change for the Blehm development is scheduled before the County Commissioners of Weld County at 2:00 P.M. of November 14, 1979. The Little Thompson Water District will be represented at the hearing. Since it seems that a violation of the agreement between the Districts may exist, we would app- reciate your response prior to November 14, 1979. The system is an extet.ded aeration activated sludge process with a design flow of approximately 95,000 gpd. High volumes of groundwater infiltrating the collection system cause flows to go over 200,000 gpd. This in turn causes severe operational problems. To date, the system has been able to meet effluent limitations however, they are having problems with Lludgc handling and process control. The district has applied for aid from local affairs to study their infiltration and theproblems with their treatment plant. The ability of Milliken Sanitation District to treat any more flow is questionable. It is possible that they could handle the additional 35,000 ;pd of flow that we discussed. My initial feeling is that they are not capable of treating this additional flow. Until a study of the system is made, we do not know if they can or cannot treat this flow. Those comments assessed only the potential impacts of the golf course on State Highway 257. We have subsequently reviewed the Blehm Land and Cattle Company application for a Zone Change from "A" Agricultural to "E" Estate. If the County approves this zone change, it will be necessary to assess the additional traffic impacts which will result. Preliminary approval was given to the proposed access easement to the golf course, but additional study will be necessary for any other points of access. We would expect this access easement will be available for use by residents of the "Estate" property. If this is the case, it is possible that traffic volumes could warrant a left-turn lane as well as the deceleration lane described in our previous letter. As recommended in our comments on the golf course, projected traffic volumes on S.H. 257 indicate that a total of 150 feet would be needed to accommodate future roadway expansion. We ask that a total of 75 feet on the west side of the centerline be protected by reservation or dedication in order to meet future needs. At such time as a site plan becomes available for review, we would like to address drainage impacts of this site as they relate to the highway and the effects of highway noise on the site. The best areas for wildlife are, of course, the riparian areas along the draw where the golf course is. Since the golf course is already in place, it is a bit difficult to really make any serious evaluation on the total picture of a housing development on what remains of the rest of the parcel. With the golf course in place, much of the wildlife habitat is gone; and with the placement of houses adjacent to this, there will doubtless be rather detrimental impacts on remaining wildlife. These impacts will come in the form of human harassment and encroachment by residences as well as children and pets that are uncontrolled. It seems to be a general problem in rural areas such as this that people seem to feel they are out in the unfettered open spaces and tend to allow their pets to roam at will and do as they please. This has proven in similar areas to all but eliminate most wildlife by breaking up nesting, chasing of various animals, etc. Therefore, I would have to disagree with the statement concerning the "tremendous increase in vegetation for wildlife cover." The District is aware that the sewage flow from the existing users is approaching the hydraulic capacity of the existing treatment facility. Coupled with flow from apparent inflow/infiltration, the existing treatment facility is currently hydraulically overloaded. The District has initiated steps to improve the existing treatment capability and to investigate the extent of inflow/infiltration. A-95 applications for funding of proposed improvements have been approved. Funding applications for the improvements have been sub- mitted and tentatively approved by the State Division of Local Governments and Farmers Home Administration. Tap fees and monthly users fees that would be generated through ap- proval of the Blehm Land and Cattle Company request for zone change would be a financial benefit to the District. It is our opinion 1 ) that the requested zoning change should be granted, 2) that the District can serve the proposed development if the proposed improve- ment in the funding applications are constructed. The discharge has consistently met NPDES permit limitations. However, the treatment plant is currently experiencing a number of problems. Among these problems are insufficient sludge digestion and handling facilities, excess infiltration, exposed chlorination equipment, and inadequate clarifier. The Milliken Sanitation District has recognized these = problems. They have hired a consulting engineer and have applied to Local Affairs for aid to complete a study of their collection and treatment systems. The Milliken system was originally designed as an extended aeration activated sludge system with a design flow of approximately 95,000 gpd. High volumes of groundwater infiltrating into the collection system cause flows to go over 200,000 gpd. These high flows change the treatment mode of the system. During the high flow summer period, the system runs in the coventional activated sludge mode. Since the system was not designed for this, severe operational problems occur. Due to the equipment and operational problems, the ability of the Milliken Sanitation District to adequately treat additional flow is questionable. It is possible that the District could handle the additional flow we discussed. Until a study of the system is made, we do not know if they can or cannot treat this increased flow. Before any new sewer lines are added to the Milliken Sanitation District, the plans and specifications must be approved by the Colorado Department of Health. Five percolation tests were conducted at the locations indicated on the attached copy of the Soil Conservation Service map. Holes were presaturated on the evening of September 26 and were also maintained in a saturated condition until approximately 3 :00 p.m. on September 27 . Depth of holes was three to four feet . Tests were conducted with water in the bottom 25 percent of the hole . The results of tests were as follows : Percolation in Hole Minutes Per Inch 1 5 minutes, 5 seconds 2 6 minutes, 20 seconds 3 6 minutes, 40 seconds 4 10 minutes, 30 seconds 5 20 minutes, 30 seconds There was some evidence of uniform, pervious, soft sandstone in the bottom of Holes 3, 4 and 5 . All holes were situated in areas classed • as severely limited by the Soil Conservation Service . Based on the holes observed, it appears that septic tanks would be generally acceptable in the area.
