RE: SUBDIVISION EXEMPTION NO. 42 - EXEMPTION FROM LAND TRANSFERRED
FROM THE DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED LAND" -
JERALD A. BOHLENDER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Jerald A. Bohlender for an
exemption of land from the definition of "subdivision" and "sub-
divided land" in Section 30-28-101 (10) , CRS 1973 , as amended,
and in Section 2-1 of the Weld County Subdivision Regulations, and
WHEREAS, the Board finds that the granting of the request
does not conflict with the intent of the Weld County Comprehen-
sive Plan and will not have an adverse impact on the existing use
of the land, and
WHEREAS, the Board has considered the recommendation of the
Department of Planning Services on this matter and has reviewed
information submitted by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners, Weld County, Colorado, that the transfer of certain
lands located in Section 1, Townhsip 3 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described as follows:
Part of the Northeast Quarter (NW4) of Section 1,
Township 3 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, and being more particularly
described as follows :
Beginning at the Northeast Quarter (NE Cor) of said
Section 1, and considering the North Line of said
NEq as bearing North 89°49 ' 54" East, with all other
bearings contained herein relative thereto;
Thence South 00°00 ' 00" West, 990. 00 feet;
Thence North 37°40 ' 00" West, 704. 90 feet;
Thence North 52°30 ' 06" West, 704. 90 feet to a point on
the North Line of said NEa
Thence North 89°49 ' 54" East, along said North Line,
990.00 feet to the True Point of Beginning
Said described parcel of land contains 9 . 789 acres ,
more or less, including a strip of ground 30 feet in
width along the North and East lines of said described

subject to any rights-of-way or other easements as re-
corded by instruments of record or as now existing on
said described parcel of land.

The owners of the follocing described property have requested

regulations adopted September 1972 which defines the term

Comments : This request is to simply change the property lines of two
existing parcels. Presently these are parcels of 30 acres and 130 acres.
Mr. Bohlender desires to change the parcel sizes to 9.789 and 150 acres
so that he can install a pivot irrigation sprinkler.
