WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 14th day of February, 1977, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Rae Barnett;
Sidney E. Dinner and Shirley Dinner; Albert I. Dinner and Janice R.
Dinner; Melvin Dinner and Diane M. Dinner, Weld County, Colorado,
more particularly described as follows:
A tract of land located in the South Half (S1) of Section 15,
Township 6 North, Range Sixty five West of the Sixth Principal
Meridian, Weld County, Colorado, and being more particularly
described as follows:
Cainencing at the Southeast Corner (SE Cor) of said Section 15,
and considering the East line of said Section 15 to hear North
00°03'10" East, and with all other bearings contained herein
relative thereto:

15, 62.50 feet to a point on the North right-of--way line of

"subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Rae Barnett; Sidney E. Dinner
and Shirley Dinner; Albert I. Dinner and Janice R. Dinner;
Melvin Dinner and Diane M. Dinner, be exempt from the definition
of the terms , "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
February, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 23rdday of February, A.D. , 1977.

Re: Recorded Exemption 246
Dear Commissioners:
The attached application, plat, and related items are
reference to a request by the Dinner family represented
by Melvin Dinner for a recorded exemption. The parcel
of land is described as pt . of the Si of Sec. 15, T6N,
R65W of the 6th P.M. , Weld County, Colorado. Said parcel
is located 3 miles east of Lucerne. The subject property
contains 137.47 acres of Class III and IV irrigated soils.
The request is to split the property into parcels of 123. 83
acres and 14.42 acres. As explained by Mr. Dinner in a
letter dated December 14, 1976, Lot A of the requested
recorded exemption has been utilized in connection with the
feed lot operation located immediately to the east which
is owned by Melvin and Albert Dinner. Most of the area
within Lot A is currently being used as hay storage area
and ensilage pits. This request is designed to legally
sanction the splitting off of Lot A, which practically and
functionally has been tied with the cattle feed lot operation
which is located immediately to the east .
Based upon the information submitted and the adopted policies
in the County, the Planning Staff recommends the request be
approved for the following reasons :
1. The proposed split conforms with the intent clause
of the recorded exemption procedure (Sec. 9-2 of the
Weld County Subdivision Regulations) , the intent
clause of the Agricultural District (Sec. 3. 3A of the
Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan since the use would be compatible
with the surrounding agricultural uses. As indicated by
Board of County Commissioners
February 8, 1977

Mr. Melvin Dinner in his letter dated December 14,
1976, Lot A for all practical purposes has a separate
use from the remainder of the property and is function-
ally tied in with the cattle feed lot operation located
directly east of County Road 45.
2. The request complies with the provisions of Sec. 9-4
(A) of the Weld County Subdivision Regulations.

Pursuant to our recent conference, I am enclosing herewith the following:
1. Recorded Exemption forms (Mylar) and blue print copy.
2. Application form for Recorded Exemption.
3. Check in the amount of $56.00 to cover the application fee in
the amount of $50.00 and recording fee for the Recorded Exemption in the
amount of $6.00 (being the rate of $2.00 per page) .
As indicated at the time of our recent conference, my brother, Albert J.
Dinner, and I are now and have for some years past been the owners of
the SW' of Section 14, Township 6 North, Range 65 West of the 6th PM. ,
Weld County, Colorado, as well as the 5'Nk of Section 14, Township 6
North, Range 65 West of the 6th P.M. , Weld County, Colorado. For many
years my father and mother, Louis Dinner and Ida Dinner, have been the
owners of what is described as Lot A and Lot B, an irrigated farm in the
SEk of Section 15, Township 6 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, containing 138.25 acres.
For a considerable period of time in the past, and at the present time,
portions of the acreage described as Lot A of the requested Recorded
Exemption have been utilized by my brother Al and me in connection with
the operation and management of the feedlot adjacent thereto, across
the road in the SWk of Section 14. Located on Lot A of the Recorded
Exemption are ensilage pits and various other facilities, stacked hay,
stacked straw, and other items which are utilized in connection with the
feedlot operation.
Within the past year my parents have conveyed the irrigated farm (Lot A
and Lot B of the Recorded Exemption) owned by them located in a part of
the SE' of Section 15, Township 6 North, Range 65 West of the 6th P.M.
to various members of the family, namely, Rae Barnett, Sidney E. Dinner
and Shirley Dinner, Albert J. Dinner and Janice Dinner, and Melvin
Dinner and Diane M. Dinner. The present owners include my 2 brothers
and their respective wives and my sister.
The request for this recorded exemption basically is designed to provide

title correction of what has existed for considerable period of years in
our use of a portion of the SEA of Section 15 in connection with the
feedlot operations. Our present plans do not involve any construction
of a residence on Lot A, but it is quite possible that at some future
date that it may be a desirable or recommended arrangement as a part of
the feedlot operations or of the farming operations in the area.
Accordingly, I would appreciate your submitting this to the Board of
County Commissioners for their approval. I would be pleased to provide
them with any additional information they would desire in connection
with these matters and to discuss this matter with them at their con-
venience.
