Dear Mr. Rittel,
Notice is hereby given that the property listed above, is not in compliance with USR-1506
(Special Use Permit for a welding fabrication shop). All conditions of the original permit must be
in compliance by November 2, 2007 or a Probable Cause public hearing, pursuant Chapter 23,
Article II (2), Division 4, Section 23-2-270 of the Weld County Code, will be scheduled.
If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review
case number USR-1506, for compliance with the Development Standards and Conditions of
Approval, as approved by the Board of County Commissioners on August 3, 2005, to determine if
probable cause exists to hold a hearing on revocation of the permits.
The site inspection by representatives of the Department of Planning Services was conducted on
August 27, 2007. It has been determined that you are not in compliance with the following
Development Standards:
1. Number 20 requires compliance with the Screening Plan as shown on the recorded USR
plat. This screening has not been constructed to the extent required.
2. Number 13 requires compliance with the Weld County Code. The property is in violation
of the following portions of the Weld County Code.
a. The various items located on the property qualify it as a noncommercial
junkyard; section 23-1-90 of the Weld County Code requires that all
noncommercial junkyards be screened from all adjacent properties and
public rights of way.
b. The cargo container located on the property is allowed but requires a
building permit according to section 23-3-30.K. of the Weld Cou

c. Up to 2 semi-trailers are allowed on an agriculturally zoned property
however without registration plates and tags and wheels these trailers
are considered derelict vehicles as per section 23-1-90 of the Weld
County Code.
These violations must be corrected in order to bring the property back into compliance with the
development standards of the Use by Special Review permit and the Weld County Code. All
components of the noncommercial junkyard shall be fully screened from all adjacent properties
and public rights of way. The proposed barrel fence shall not be used to satisfy the requirements
of the Use by Special Review permit. If the 2 semi-trailers are to remain as derelict vehicles they
shall be fully screened as they will be considered part of the noncommercial junkyard. If the
appropriate plates and tags are attached to the vehicles and the wheels are reattached so as to
make the semi-trailer street ready they shall no longer be considered derelict and therefore may
remain unscreened. A building permit shall be obtained for the cargo container. Lastly, the fence
required by the screening plan shall be constructed. If the noncommercial junkyard is to remain
on the property staff will require screening in addition to what is required as part of the Use by
Special Review permit.
If it is determined at the public hearing that there is probable cause that you are not in compliance
with USR-1506, the Board of County Commissioners will schedule a Show Cause public hearing
to consider revocation of the Use by Special Review permit. I have enclosed a copy of the Plat
Map and the Board of County Commissioners resolution for your convenience.
