RE: USR-1322, Sparboe Horizon Corporation—Farm 2
I am addressing Conditions of Approval for the above case number approved by the Board
of County Commissioners on June 6, 2001 in preparation for mylar plat recording. I have
provided attached documentation for each condition.
2A. The plat shall be amended to delineate the following:
1) Conform to Section 23-2-260.D of the Weld County Code.
2) A total of 30 feet from the centerline of Weld County Road 16 shall be
delineated right-of-way on the plat.
3) The access lane shall be a minimum of 20 feet in width.
The plat has been amended and submitted to the Department of Planning Services for
review and approval.
28. Provide written evidence to the Departments of Planning Services and Public Health
and Environment from the State Water Engineer regarding availability of water for
this operation.
Letter attached from the Office of the State Engineer regarding the permitted wells.
They request that both wells be equipped with totalizing flow meters and records of
the total diversions (which historically they are and have been). Sparboe Horizon
Corporation will continue to maintain these records for review by the State.
2C. All septic systems located on the property shall have appropriate permits from the
Weld County Department of Public Health and Environment. The WC PH&E was
unable to locate a septic permit for the septic systems currently serving the existing
structure that will be converted into a biosecurity/garagefrestroom, located south of
the poultry houses. Any existing septic system(s) which is not currently permitted
through the Weld County PH&E will require an I.S.D.S. evaluation prior to the
issuance of the required septic permit. In the event the system is found to be
inadequate, the system must be brought into compliance with current I.S.D.S.
Regulations. Written evidence of approval from the Department of PH&E shall be
submitted to the Department of Planning Services.

2D. Apply for an Underground Injection Control (UIC) Class V Injection Well permit
through the Environmental Protection Agency (EPA), for the floor drain system that
serves the maintenance shop, or provide evidence that the applicant is not subject to
the EPA Class V requirements. Written evidence of approval from the Environmental
Protection Agency shall be submitted to the Department of Planning Services.
Please see attached e-mail from Trevor Jiricek to Julie Chester and the letter from
Ron Jepson, State of Colorado regarding the Class V injection well requirements and
pond liner issues. Both of these requirements have been rescinded.
2E. Items 1 through 8 have been addressed in the Manure Management and
Nuisance Plans. Both of these plans have been approved by the Weld County
Department of PH8E. See attached letter from Trevor Jiricek.
2F. A letter was submitted to your department requesting vacation of REC#0004.
3. The Department of Planning Services and Building Inspection granted an early
release of building permits due to the scope of the project.
I have also provided you with a paper copy of the plat for your review and comments.

This is to confirm that the records of the State Engineer show that there is one well
completed in the Laramie-Fox Hills aquifer in the NE ' of the SW 'A of Section 29,
Township 2 North, Range 65 West of the Sixth Principal Meridian. That well withdraws
water under two different permits.
Permit No. 32930, held in the name of Milton G. Waldbaum Company, allows water to
be withdrawn pursuant to Division 1 Water Court Case No. 82CW047 in the amount of
7.11 acre-feet per year at a maximum rate of 20 gallons per minute. The water
withdrawn under this permit may be used for domestic, stockwatering and commercial
uses. Permit 26160-F, issued to R & G Farms, may remove up to 9.23 acre-feet per
year In addition to the 7.11 acre-feet per year allowed by permit 32930. The permitted
uses for this well are domestic, livestock, commercial and irrigation uses. Both wells
are to be equipped with totalizing flow meters and records of the total diversions from
both wells are to be maintained by the well owner.
We have no information as to whether the allowed withdrawals are sufficient to support
the planned use of the property.

Wastewater Management Plan
Dear Mr. Dunker:
The Weld County Department of Public Health and Environment (WCDPHE) has completed its review
of the Comprehensive Nutrient Management Plan (the Plan) for the Sparboe Horizon Corporation,
Farm #2. The facility is located in the SW 1/4 of Section 29, Township 2 North, Range 65 West, near
Hudson, Weld County. The Plan is required by Condition of Approval 2.E. of USR #1322.
The WCDPHE approves the Plan. Due to the submittal of revisions to the originally submitted plan,
the following documents make-up the Manure and Wastewater Management Plan for this facility:
• December 14, 2001 letter from AgPro Environmental Service (AgPro) to the WCDPHE
• November 19, 2001 letter from AgPro to the WCDPHE
• September 28, 2001 letter from AgPro to the WCDPHE
• Comprehensive Nutrient Management Plan, dated August 27, 2001, prepared by AgPro.
Please note that the approval of the Plan is conditional upon the facility's use of the lagoon at the
Sparboe egg laying facility for the disposal of wash water from the interiors of the barn. Should the
ownership of either facility change an amended manure and wastewater management plan must be
submitted for review and approval. Also, should manure from the this facility be composted at the egg
laying facility, it may be necessary for the egg laying facility to amend its current operating permit.

We have received a copy of the Colorado Department of Public Health & Environments comments
concerning the Sparboe Horizon Corporation, Farm#2, (pullet facility) Manure and Process Waste
Water Plan. The comments are presented in a letter dated November 19, 2001.
The comments appear to be relevant to both the facility's compliance with the Confined Animal
Feeding Operation Control Regulations and USR#1322. As such, we request that you address each
comment in writing. We will continue the review of the MWWMP once the issues in this letter and our
October 29, 2001, letter have been appropriately addressed.

Re: Sparboe Horizon Corporation
Dear Mr. Jiricek:
This is in response to your letters dated October 29, 2001 in regards to Sparboe's method of
handling wastewater from the chicken houses during washing. It is Sparoe Horizon Corporation and
AgPro Environmental Services' opinion that this issue has already been adequately addressed with
the updated CNMPs and my previous correspondence dated September 28, 2001. However, since
this issue is holding up Sparboe's project, I will add some detail to what Sparboe is planning.
• Sparboe has a portable 6-8 horsepower sump pump that they will utilize to pump water out of the
buildings while they are being cleaned. The sump pump will be placed at one end of the building in
a pit where water naturally collects. The sump pump will then pump any excess water from this pit
out of the building and either directly into the pond system at Farm No. 1 or directly into a tank on
the back of a pickup for Farm No. 2.
�.At Farm No. 1 Sparboe will run a hose from the sump pump directly to the pond north of the
chicken houses. Therefore,the wastewater will be pumped directly from the houses into the pond.
At Farm No. 2 Sparboe will utilize the sump pump with an appropriate length of hose to pump
wastewater directly into a 200-gallon tank on the back of a pickup and then transport the wastewater
to Farm No. 1 where it will be deposited directly into the pond.
As for the pond lining issue, please see the attached letter from Ron Jepson at the Colorado
Department of Public Health and Environment. Mr. Jepson's letter should address and finalize the
lining issue.

Sparboe Horizon Corporation("Sparboe"). Sparboe is located northwest of the Town of Hudson, is a poultry egg

You indicated that wastewater from the egg washing and truck washout facilities is directed to and contained by one
retention structure. This structure is located on site. You asked if the retention structure needed to just meet CAFO
regulatory requirements,or if a"Discharge to Groundwater"permit was required because wastewater from the truck
washout is involved. Today's letter confirms that the retention structure needs to just meet CAFO regulatory
requirements. Sparboe does not need to hold a"Discharge to Groundwater"permit for the structure.
You indicated that the retention structure existed as of about 1987 or 1988. Under subsection 81.4 (C)of Regulation
No. 81 of the Colorado Water Quality Control Commission,this retention structure is not required to have available
evidence that a completed lining meeting the requirements of subsection 81.4(A)has been constructed.

The Weld County Department of Public Health and Environment (WCDPHE) has reviewed your
September 28, 2001, letter concerning the revised Comprehensive Nutrient Management Plan (the
Plan) for the Sparboe Horizon Corporation, Farm#2. The facility is located in the SW 1/4 of Section
29, Township 2 North, Range 65 West, near Hudson, Weld County. Your letter was submitted to
provide supplemental information for the Plan as requested in our letter dated September 14, 2001.
The Plan is dated August 27, 2001.
The WCDPHE has found the Plan to be inadequate as submitted. One issue requires additional
information. It is as follows:
• The facility has not adequately addressed the method that waste water from the washing of
the interior of the barns will be collected. This would include a description of all containment
features and any specific practices that will be incorporated to prevent a discharge from the
facility.
The WCDPHE has requested additional information concerning this item in letters dated
August 20, 2001 and September 14, 2001. Please note that this information is required in
Condition of Approval 2.D.(3) of USR#1322.

Dear Mr. Dunker:
The Weld County Department of Public Health and Environment(WCDPHE) has reviewed the revised
Comprehensive Nutrient Management Plan (the Revised Plan) for the Sparboe Horizon Corporation,
Farm#2, located in the SW 1/4 of Section 29, Township 2 North, Range 65 West, near Hudson, Weld
County. The Revised Plan, dated August 27, 2001, was submitted in response to our letter dated
August 20, 2001.
The WCDPHE has found the Revised Plan to be inadequate as submitted. The Revised Plan did not
adequately address items#2 and#3 from our August 20, 2001 letter. Each item is discussed in more
detail below:
Item#2 Our August 20, 2001 letter stated the following: "The Plan failed to discuss the fate of
waste water that is generated from washing the interiors of the barns. Please provide
a discussion of this process and the fate of the waste water. " The Revised Plan
states: "Sparboe Horizon Corporations Farm No. 2 produces minimal process
wastewater at this facility. During cleaning and sanitizing of the barns, a small amount
of water is used but is assimilated within the manure. Therefore, no process
wastewater is generated that needs disposal."
During our visit to the facility on March 16, 2001, the facility operator verbally informed
our staff that waste water from the washing of the interiors of the barn is discharged
onto the ground surrounding the barn through access doors. Further, the Revised
Plan indicates that the wastewater"...is assimilated within the manure." This is
somewhat confusing. Page 5 of the Revised Plan states that manure is routinely
removed from the barn by a conveyor system that exists above the floor of the barn. It
is our assumption that the wastewater would collect on the floor of the barn rather than
the narrow conveyors. As you are aware, according to the Confined Animal Feeding
Operation Control Regulations (5 CCR 1002-81) this facility is required to operate as a
"no-discharge"facility. As such, please provide a detailed description, drawings,
schematic, etc., and written text that describes the specific washing procedures
incorporated in the barn and the barriers or grading that is in place, within the interior
of the barns, that directs the wastewater so that it is assimilated within the manure.
Item#3 We apologize for ambiguity concerning this issue in our August 20, 2001 letter. Our

only intent was to receive a commitment from Sparboe that if the facility hauled manure
to a composting facility that the composting facility be appropriately permitted in
accordance with the Colorado Solid Wastes Disposal Sites and Facilities Act and the
regulations promulgated thereto (CRS § 30-20-100.5 et seq. & 6 CCR 1007-2,
respectively). It is the opinion of this Department that the Solid Waste Act requires such
consideration even if the CAFO regulations do not.
Manure from this facility that would be composted, rather than directly used as a
fertilizer or soil amendment, at a separate off-site composting facility would be viewed
as a "solid waste" rather than an "agricultural waste"according to the definition of
agricultural waste found in the regulations. Any composting facility that composts
manures, other than manure that was generated on its own site, requires a permit from
the Weld County Board of County Commissioners and approval from the Colorado
Department of Public Health and Environment. Therefore, a CAFO operator who
disposes of manure by transport to an illegal composting site may be found to have
unlawfully disposed of solid waste under§ 30-20-113(1) (b) C.R.S.
Additionally, page 5 of the Revised Plan indicates that manure from this facility may be
composted at Farm No. 1. Please note that should Farm No. 1 compost any manure
other than the manure generated on the facility, it must obtain an appropriate permit
from the Weld County Board of Commissioners and approval from the Colorado
Department of Public Health and Environment.

prior to our approval of the Plan. They are:
1) Conditions of Approval 2.E.(1) and (2) requires that these items be conducted by a Colorado
Registered Profession Engineer. As a result, please assure that these portions of the Plan are
stamped by an engineer.
2) The Plan failed to discuss the fate of waste water that is generated from washing the interiors
of the barns. Please provide a discussion of this process and the fate of the waste water.
3) Page 5 of the Plan indicates that all manure from the existing barns is routinely hauled off site
to area farmers or to a composting operation. Given the nature of chicken manure and its
vector attraction qualities, discuss how nuisances will be prevented at sites that receive the
manure. Also, please discuss the facility's alternatives to manure management should the
composting operation no longer accept the manure.

Condition of Approval 2. B. of this permit requires that the facility get a permit from EPA for the discharge from the truck
wash. After discussing this item with Sharyn Frazer and reviewing our files, the effluent from the truck wash does not go
into a septic system, rather into the on-site ponds. Therefore, they do not have to obtain a class V permit from EPA.
However, because of this the facility now needs to obtain a groundwater discharge permit from the CDPHE. This
requirement can be found in Section 61.14 ot the Colorado Discharge Permit System Regs(5 CCR 1002-61). There does
appear to be an exemption trom the permit. I his requires tnat whatever ponds capture me emuent nave a liner tnat aoes
not exceed 1 X 1U-6 Cm/sec. I did a quick review ot their Manure and Waste Water Management Plan and observed they
have provided no evidence to this effect. We will require that in our review of the plan.
