I. BY THE COMMISSION
A. Statement, Findings, and Conclusions
1. This matter comes before the Commission for consideration of a Petition to Join
the Approved Interventions of Boulder County and the City of Boulder, filed on June 16, 2010
by Boulder County and the City of Boulder.
2. By Decision No. C10-0452, mailed May 7, 2010, the Commission opened Docket
No. 10M-245E to consider the plan expected to be filed by Public Service Company of Colorado
in compliance with House Bill 10-1365, the "Clean Air—Clean Jobs Act."
3. In Decision No. C10-0545, the Commission granted petitions to permissively
intervene filed by both Boulder County and the City of Boulder. However, as these petitions
were nearly identical, we "strongly encouraged" Boulder County and the City of Boulder to
withdraw their petitions and re-file as a joint party. Boulder County and the City of Boulder now
seek to comply with the Commission's request in Decision No. C10-0545 by joining as a single
party. The Commission will grant the petition.
