RE: REQUEST TO COLORADO AIR QUALITY CONTROL COMMISSION TO POSTPONE
IMPLEMENTATION OF IM240 OZONE TESTING PROGRAM IN NORTH FRONT
RANGE UNTIL 2013
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, in response to the requirements promulgated in Senate Bile 09-003, and
through a rulemaking hearing set for March 18, 2010, the Colorado Air Quality Control
Commission ("CAQCC") will consider adopting certain amendments to Regulation 11 which will
require certain portions of Larimer and Weld Counties to be included in the IM240 Ozone
Testing Program, and
WHEREAS, the Weld County Tower, located in Greeley, Colorado, includes hourly and
daily readings for ozone, and
WHEREAS, since 2007, the Weld County Tower has shown a decrease, on a yearly
basis, in the 4th Maximum, 8-Hour Average parts per million (ppm) ozone value, such that the
three-year average in 2009 was at .071 ppm, which is below the .075 ppm requirement set forth
in the State Implementation Plan (SIP), and,
WHEREAS, with the decreasing average values, it makes sense to wait until the
promulgation of the Ozone Action Plan required for submittal by the Federal Environmental
Protection Agency in 2013, and
WHEREAS, under S.B. 09-003, the CAQCC has the authority to delay adoption of rules
pertaining to the inclusion of the subject portions of Larimer and Weld Counties until
December 31, 2013, and may delay the effective date of implementation until after July 1, 2010,
and
WHEREAS, the Board therefore deems it prudent to request that the CAQCC postpone
the adoption of the amendments to Regulation 11 such that the implementation of the IM240
Ozone Testing Program in Larimer and Weld Counties be postponed at least until the effective
date of the Ozone Action Plan in 2013.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that it hereby requests the CAQCC postpone the adoption of the
amendments to Regulation 11 such that the implementation of the IM240 Ozone Testing
Program in Larimer and Weld Counties be postponed at least until the effective date of the
Ozone Action Plan in 2013.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF LASALLE, COLORADO:
I. The Town of LaSalle, a municipality within Weld County, support the sentiments of the
Board of Weld County Commissioners requesting the Colorado Air Quality Control
Commission to postpone the adoption of the amendments to Regulation 11 such that the
implementation of the IM240 Ozone Testing Program in Larimer and Weld Counties be
postponed at least until the effective date of the Ozone Action Plan in 2013.
PASSED AND ADOPTED, SIGNED AND APPROVED at the regular meeting of the
Board of Trustees of the Town of LaSalle, Colorado held this 9th day of February, 2010.
