RESOLUTION RE: ACCEPT TRANSFER OF $50,000 OF TEMPORARY ASSISTANCE FOR NEEDY FAMILIES (TANF) RESERVES AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS — LA PLATA COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 15, 2010, the Board of County Commissioners of La Plata County approved a Resolution that authorized the transfer of $50,000 from the Temporary Assistance for Needy Families (TANF) Reserves to Weld County, a copy of which is attached hereto, and WHEREAS, Weld County is in need of such funds, and WHEREAS, La Plata County is authorized by Colorado law and regulations to transfer monies from its Temporary Assistance for Needy Families (TANF) Reserves to another county, and WHEREAS, after review, the Board deems it advisable to accept the transfer of $50,000 of TANF Reserves from La Plata County, effective June 15, 2010. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the transfer of$50,000 of La Plata County's Temporary Assistance for Needy Families (TANF) Reserves to Weld County be, and hereby is, approved, effective June 15, 2010. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign any necessary documents to effectuate the transfer. La Plata County Board of County Commissioners is requesting this money be transferred to the following counties: • Montrose County $50,000 • Weld County $50,000 The director of Human Services has been in contact with both counties and they are in agreement with this transfer. Attached please find a letter from the Board of County Commissioners of each county agreeing to be responsible for the MOE. Many counties like yours are at risk of having a portion of your TANF reserve revert to the State Long Term Reserve. Your county will not receive any compensation for the MOE spent in prior years to receive TANF funds now in your county TANF Reserve. Since Weld County does not have excess TANF reserves that will be capped,one way your county can recapture MOE would be by"selling"some of the excess TANF reserves to Weld County. It is our understanding your county has$230,000 in excess TANF Reserves that you may be compelled to revert to the State Long Term Reserve under SB 08-177. Weld County is willing to purchase your excess TANF Reserve amount for an amount equal to what you spent in local MOE dollars to get them. Montrose County is one of those and is in the process of no longer providing child care to the 185%of poverty(waiting list established), is experiencing 70%reduction of outside services to child welfare families,who observes vacancy savings as staff leave and is experiencing a 78%increase in SNAP caseload. As a result of increasing caseloads and the ongoing reduction in other services, Montrose County Health& Human Services still finds itself in need of requesting assistance in purchasing TANF reserve from other counties. Through communications,we understand that LaPlata County may have some funds available for purchase at the 20%MOE match. Montrose County is very interested in purchasing said funds if they should become available. Additional information can be provided if you require. The first paragraph raised a red flag because it indicated La Plata wasn ' t even approving their Resolution until Monday , so I wondered why not wait until Wednesday to do the acceptance , but when I called La Plata County Commissioners , their assistant indicated it will not be on their Agenda until June 15 and we will not have a Resolution to attached until the following week at the earliest , nor will the funds be transferred until that time . Is this Resolution premature ? Technically we can still list it on Monday , but it will just have to sit here until we have a La Plata Resolution to finalize the paperwork . Esther E . Mgr, Approvala_aett:t,, Background: On April 28, 2010 at the Board Discussion Time meeting, I presented to the board a financial report on the Temporary Assistance to Needy Families (TANF) allocation. At that time we were projecting there would be an under expenditure of the allocation due to the reduction in the reserve cap. The board supported the concept of first attempting to contract with our TANF partners and secondly supported the transfer of any unexpended allocation to other counties that have over spent their allocation. We had requests from two counties, Montrose and Weld, for any unspent TANF dollars. At this time the department has followed the Board's recommendation and is projecting to be under spent in this allocation by 108,000. Because the close of the state fiscal year is June 30, 2010, it was necessary to begin the transfer process by submitting a letter signed by the Board Chair approving the transfer of $50,000 to Montrose County and $50,000 to Weld County for approval by the Works Allocation Committee. Fiscal Impact: The County will be reimbursed the county share of the 108,000 from the two counties receiving this funding.
