RE: GRANT OF SPECIAL USE PERMIT FOR EXPANSION OF GAS COMPRESSOR
STATION TO PANHANDLE EASTERN GAS COMPANY.
WHEREAS, a public hearing was held on September 27, 1976 ,
in the chambers of the Board of County Commissioners , Weld County,
Colorado, for the purpose of hearing the petition of Panhandle
Eastern Gas Company, P . O. Box 127 , Brighton, Colorado, requesting
a special use permit for the expansion of a gas compressor station
located on a parcel of land in the Northwest Quarter of Section 14,
Township 2 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows:
Commencing at the Northwest corner of said
Section 14 , Thence South 89 °47 ' 59" East for
a distance of 1 , 050 . 00 feet to the true point of
beginning ; thence South 00°07 ' 15" West for
a distance of 578 . 22 feet; thence South
75°14 ' 33" East for a distance of 746 . 86 feet ;
thence North 00°03 ' 04 " West for a distance of
765 . 95 feet; thence North 89°47 ' 59" West for
a distance of 720 . 31 feet to the point of
beginning , and containing 11 . 13 acres , more or
less .
WHEREAS , the petitioner was present, and
WHEREAS, the above described parcel of land is located in
an agricultural zone as set forth in the Weld County Zoning
Resolution, and
WHEREAS , Section 3 . 3 .E. 4 of the Weld County Zoning Resolution
authorizes such a use in agricultural districts on the grant of a
special use permit by the Board of County Commissioners, and
WHEREAS , the Board of County Commissioners has considered
all the testimony and statements of those present, has studied
the request of the petitioner and has studied the recommendations
of the Weld County Planning Commission and having been fully
informed and satisfied that the requested use complies with the
Weld County Comprehensive Plan and the provisions of the Weld
County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners , Weld County, Colorado, that the application of

Panhandle Eastern Gas Company for a special use permit for the
expansion of a gas compressor station on the above described
parcel of land be, and hereby is, granted, subject to the
development standards contained in the special use permit and to
the following additional standards :
1. Noise levels generated by the expanded compressor station
shall not exceed 70 dba at the property line;
2. Total horse power of compressors at the site shall not
exceed 6, 000 horse power.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on this 29th day of
September , A. D. , 1976.

have been proposed to be placed on the plat prior to recordation and they
are as follows: 1 ) The hog farrowing and finishing operation on .the
hereon described parcel located in part of the SW4 of Section 32, T7N,
R64W of the 6th P.M. , Weld County, Colorado shall be limited to the facil-
ities shown which are designed to handle approximately 100 sows, 400 baby
pigs, and 400 feeder pigs. 2) The Special Use Permit area shall be main-
tained in such a manner as to prevent fugitive dust, soil erosion, and
the growth of noxious weeds. 3) Access shall be limited to the two exist-
ing points as shown hereon. 4) Building permits shall be secured prior
to the construction of the structures to be located on the Special Use
' Permit area. 5) All sewage disposal facilities installed on the site shall
conform with all applicable Weld County and State Health Regulations. 6)
The Special Use Permit shall be limited to the plans submitted and governed
by the development standards stated above. Any changes to the plans and/or
the development standards shall require approval of another Special Use
Permit before such changes shall be allowed. Mr. Hiatt raised the question
as to whether this development would take place within one year. Mr. Cecil
explained that he was going to start work immediately upon approval of the
permits being issued, and should be through, except for maybe the finishing
barn , within a year. He explained that he will be starting this from
scratch. Mr. Nix wondered if there were any objections from the people in
Galeton. Mr. Carlson explained that this operation would be down wind from
most of the town.
RESOLUTION: Be it therefore resolved to recommend approval to the Board of
County Commissioners with all request as written and according to the
development standards. Motion by Carlson. Seconded by Bette Kountz. A
vote of "Aye" by Carlson, Kountz, Nix, Yost, and Hiatt. MOTION CARRIED.

SUBJECT: Expansion of Gas Compressor Station
APPEARANCE: Robert Clair
DISCUSSION: Mr. Clair explained that the proposal would be additional
dehydration facilities to drop the liquids out of the gas as it passes through
the plant so when it gets to the compressor units it's dry. He said they had
added some future plans which may or may not develop for some possible horse
power. The addition dehydration facility will give them an addition 30 million
cubic feet of additional drying of the gas going through the station. The extra
horse power will be needed to transport this additional gas. Mr. Nix wanted to
know if this would be used as a pumping station. Mr. Clair explained that they
are looking at either 1000 or 2000 horse power units if this develops. Mr.
" Nix wanted to know what kind of noise this would produce. Mr. Clair said that
there are three other stations in the area and that the noise level will not
exceed 70 dbA's at the property lines. He said the building, which comes out
of Texas, are well insulated buildings and the noise from the engines them-
selves are almost totally contained. They use good quality exhause silencers
and air intake silencers. The Weld County Planning Commission staff recommends
approval of this permit for the following reasons: 1 ) The request complies

there was an addition to the Development Standards as printed on the
\. plat and that is as follows: The noise emission from the facilities
within the Special Use Permit area shall not exceed 70 dbA's at the property
\ line. Mr. Nix wanted to know who would determine this. Mr. Honn explained
\. that in the case of a complaint of the noise, if upon measurement of the
i site,the noise level is found to be greater than 70 dbA, then they would
be required to lower to that particular amount. He also stated that as of
this date there have been no complaints received regarding this application
or the existing facilities that are on the property now. Mr. Carlson expressed
concern over consistancy of noise level controls from one plant to another
Glen Paul , Weld County Health Department, explained that noise levels have
to reach 86 dbA before they become a health hazard. He said that although
it is not a health hazard it could be a nuisance. The question of the dif-
ference between db's and dbA's was raised. Mr. Honn explained that there
was a difference and it becomes significant as the dbA reading is significant
' to the actual level of real sound that one hears. A db factor is actually
r- / a meter measured sound rating through an instrument but the measured sound
^, ,d' as you would hear it, may be different than the true decibel rating. The
"A" on the end of db means Actual , he thought. Mr. Paul said that in
/// talking with Lee Grossman from the State Health Department, he received the
same information.
RESOLUTION: Be it therefore resolved to recommend to the Weld County Board of
( County Commissioners approval of this Special Use Permit subject to the
addition to the development standards of the Noise emission not exceeding
70 dbA at the property line. Motion by Marge Yost. Seconded by Percy Hiatt.

APPEARANCE: Bill Eisenbarth, Manager of Licensing and Safety, and staff
DISCUSSION: Mr. Eisenbarth explained that in May of this year Wyoming Mineral
Corporation filed a Special Use Permit and in the terms and conditions it
was stated that the Planning Commission and Board of County Commissioners
would not pass on the application until the State of Colorado passed and
established the terms and conditions of our subsurface disposal permit. On
August 3, 1976 a public hearing was held at the Health Department and an
application for subsurface disposal permit for this test operation was
passed subject to establishing terms and conditions for that permit. This
hearing was held in the Colorado State Health Department on 11th Avenue in
Denver, Colorado. Mr Eisenbarth explained that Wyoming Mineral had been

In RE: Application for Addendum to Special Use Certificate
and Planned Unit Development Certificate
Gentlemen:
Panhandle Eastern Pipe Line Company (PEPL) has owned and operated a
natural gas liquid terminal on the acreage shown on the attached Exhibit
"Al" Vicinity Map since mid 1973. Volumes of natural gas at Vollmar
Liquid Terminal were expected to increase each year until future ad-
ditional facilities would be required. At present time gas producers
in this area have increased the volumes of natural gas provided to PEPL
to the point where new facilities must be installed by August 1976.
In order to provide more efficient transportation of these larger volumes
of natural gas, PEPL proposes to install a second glycol dehydrator and
reboiler. The additional facilities will increase our dehydration capacity
by thirty (30) million cubic feet of gas per day. Koch Oil Company pre-
sently picks up liquids with two-hundred (200) barrel tank truck once
every ten (10) days during the summer months and twice a week during the
cool fall and winter months. With our proposed expansion this frequency
shall be approximately one truck a week during the summer months and three
(3) times a week during the cool fall and winter months? and PEPL further
proposes to install six (6) new 994 H.P. gas engine compressor units as
shown on the attached Exhibit "Bl" or possibly three (3) new 2000 H.P.
gas engine compressor units or a combination of both units. Integral with
each unit are gas coolers and scrubbers and engine exhaust and air intake
silencing equipment, all mounted on the individual units skidded frames.
A minimum of air pollution can be expected from the exhausts of these
clean burning natural gas powered gas compressors and air standards for
each new engine installed shall be applied for and meet the Colorado De-
partment of Health Air Pollution Control Division.
These units would be enclosed by a steel building specially insulated
against sound emissions. This design indicates that the property line
noise level would be no higher than 70 dbA with proposed facilities in-
stalled.

The plant will be adequately protected from fire hazzards through in-
stallation of gas detection equipment which would automatically shut
down the station. Thirty (30#) pound ansul dry powder extinguisher
will be located strategically throughout the facility. In addition,
automatic emergency shut down systems for high and low temperatures
and high and low pressures will be provided on each compressor unit.
This station is designed for complete unattended operation: however,
one or two personnel will be present for brief periods during the day
to perform necessary preventative maintenance. No sanitary or any
type of water facilities are planned for this booster station. Should
the need for water become evident at a later date, PEPL will apply to
the Colorado Board of Water Resources for a permit to drill an exempt
water well.
The proposed and existing equipment, facilities and ingress and egress
roads are as shown on the attached Exhibits "Al" and "Bl". Should you

Gentlemen:
Panhandle Eastern Pipe Line Co. (P. E.P.L. ) has owned and operated a

Vicinity Map since mid 1963. Volumes of natural gas at Vollmar Liquid
Terminal were expected to increase until future additional facilities would
be required. At the present time gas producers in this area have increased
the volumes of natural gas provided to P.E.P.L. to the point where new
facilities must be installed as soon as possible.
In order to transport natural gas efficiently, the liquids inherent in
the gas stream must be removed. Due to the larger volumes, our existing
dehydration capacity has been exceeded. To remedy the situation, P.E.P.L.
proposes to install a second glycol dehydrator and reboiler. The additional
facilities would increase our dehydration capacity by 30 million cubic feet
of gas per day. This should be sufficient to provide effective gas transpor-
tation.
The additional facilities will not change any of the routine maintenance
or operation of the liquid terminal other than a small increase in tank truck
liquid hauling. This would be minimal due to the fact that trucks now often
leave only partially filled.
The noise level at the terminal will be no higher nor will water facilities
be needed. Only minute or trace amounts of water vapor and heat are expelled
from the glycol reboiler, similar to that of a wellhead separator unit used on
most every well in Colorado.
The proposed and existing equipment, facilities, and ingress and egress
roads are as shown on the attached Exhibits "A-1" & "B-1". Should you have

Panhandle Eastern Gas Company for a Special Use Permit, expansion
of Gas Compressor Station, at the time and place so specified.
After discussion, Commissioner Moser made a motion to grant the
Special Use Permit and Commissioner Carlson seconded the motion.
It carried unanimously with Commissioners Carlson, Moser,
Steinmark and Billings present. Commissioner Jacobucci was absent.

In the event Lessee ceases to occupy said premises for the purposes above recited and
removes its property therefrom, said Lessee may terminate this lease by giving to Lessor
ten days notice in writing of its desire and intention by paying to the Lessor the sum of One

ADDENDUM 7!�
THIS ADDENDUM, Made and entered into this 7Th, day of August, 1972 ,
and being made a part of the Lease of this same date, between PHILIP S.
McCOY and LILY T. McCOY, husband and wife, and PANHANDLE EASTERN PIPE
LINE COMPANY, a corporation.
1. Notwithstanding anything to the contrary, in the event of a
conflict betwecu the language of this Addendum and the language of the
Lease, this Addendum shall control.
2. Lessee agrees to pay the rent for said premises promptly when
due and payable.

3. Lessee agrees to sublet no part of said premises nor assign
this Lease, or any interest herein, without the written consent of
lessor first being obtained. Lessor agrees not to unreasonably with-
hold written consent, and further agrees that such consent will be
given where requested as a result of a merger, consolidation, convey-
ance, or assignment affecting lessee.
4. Lessee agrees to use said premises for no purpose prohibited
by the laws of the United States, the State of Colorado, or the regula-
tions of the County of Weld, and for no improper or questionable purpose
whatsoever.
5 . Lessee agrees not to attempt to hold lessor liable for any
injury or damage, either proximate or remote, occurring through or
caused by any repairs, alterations, injury or accident to occupants
of the premises, or by any other person, unless caused by the negligence
of lessor or his agents.
6. Lessee agrees to indemnify lessor against any loss or liability
arising out of lessee ' s operation or leasing of the above described
premises. Lessee will provide lessor with evidence that it carries a
valid and sufficient general liability insurance policy covering its
operations on the premises. Coverage is extended therein to lessor,
under the terms of which lessee ' s insurer will assume on behalf of
lessor, all costs, including attorney' s fees, in the event any claim
is made against the lessor for damages arising out of lessee' s opera-
tion or leasing of the described premises, and if lessee ' s insurance
company does not , for any reason, assume such defense and costs then
lessee will itself assume such defense and costs, except that lessee
shall not be required to assume the defense and costs of a claim arising

out of the negligence of lessor or his agents . 7....,7. /

7 . It is mutually agreed that if, after the expiration of this
lease, lessee shall remain in possession of said premises and continue
to pay rent, without any express agreement as to such holding, then
such holding over shall be deemed and taken to be a holding upon a
tenancy from month to month, the party holding be regarded as a
tenant from- month- to month at a monthly rental equivalent to one-
twelfth (3./12) of the annual instalments hereinbefore provided for,
payable in advance on the same day of each calendar month.
8. It is understood and agreed that the premises being leased
are owned by lessor, PHILIP S. McCOY, solely, but that because of
lessee ' s company policy, lessor ' s wife , LILY T. McCOY, has signed
this lease . Nothing herein contained shall be construed as. implying
that LILY T. McCOY is an owner or joint owner of the described property.
9 . This Lease and Addendum are subject to lessee ' s being able
to obtain any necessary approval of the Weld County Planning
Commission and County Commissioners to enter into said lease or for
any needed zoning changes, and building or other permits.
10. And said lessee further covenants and agrees that if the
rent above reserved, or any part thereof, shall be in default, or
in case of a breach of any of the covenants or agreements herein,
said lessor may declare this lease terminated, and after the expira-
tion of thirty (30) days from the date of the service of a written
notice to that effect, be entitled to the possession of said premises
without any further notice or demand; and further, that in case lessor
shall become entitled to the possession of said premises either by the
expiration of this lease or by any termination of said term as herein
provided for, and said lessee shall refuse to surrender and deliver
up the possession of said premises after the service of said notice ,
as aforesaid, then : and in that event said lessor may, without further
notice or demand, enter into or upon said premises or any part thereof,
and take possession thereof and repossess the same as lessor' s former
estate , and expel, remove and put out of possession lessee , using
such help, assistance and force in so doing as may be needful and
proper, without being liable for prosecution or damages thererore,
and without prejudice to any remedy allowed by law, available in such

' cases; provided, however, that upon the occurrence of any of the abcvc
contingencies lessee shall be allowed a reasonable time in which to
remove its property from said premises and restore the premises to
substantially their original condition.

AMENDMENT TO LEASE
THIS LEASE AMENDMENT, made and entered into this
26th day of September , 1972, by and between Philip S.
•
McCoy and Lily T. McCoy, husband and wife , hereinafter referred
to as "Lessor, " and Panhandle Eastern Pipe Line Company, here-
inafter referred to as "Lessee."
WITNESSETH THAT:
WHEREAS, heretofore on August 7, 1972, Lessor and Lessee
entered into a certain Lease, and Lease Addendum, for an 11.13-acre
site to be used by Lessee as a liquid terminal site; and
WHEREAS, the legal description of the 11.13-acre tract
so leased was approximate and has subsequently been superseded
by an actual field survey.
NOW, THEREFORE, for and in consideration of the premises
and of the mutual covenants herein contained, and contained in
said Lease, Lessor and Lessee agree to amend the Lease as fol-
lows:
1. The legal description of the 11.13-acre tract
leased to Lessee as set out in paragraph 2 of page 1 of said
Lease is hereby deleted and the following legal description
substituted therefor:
"A tract of land located in the Northwest
Quarter of Section 14, Township 2 North,
Range 67 West, Weld County, Colorado, and
more particularly described as follows:
Commencing at the Northwest corner of said
Section 14, thence South 89 degrees 47 minutes
59 seconds East for a distance of 1050.00
feet to the true point of beginning ; thence
South 00 degrees 07 minutes 15 seconds West
for a distance of 578.22 feet; thence South
75 degrees 14 minutes 33 seconds East for a
distance of 746.86 feet; thence North 00
degrees 03 minutes 04 seconds West for a
distance of 765.95 feet; thence North 89
degrees 47 minutes 59 seconds West for a
distance of 720.31 feet to the point of be-
ginning, and containing 11.13 acres, more
or less. "
2. Except as herein amended, the Lease shall remain
in full force and effect as originally written.

In reply to your request the following is the soil evaluation for the
N2 NW4 Sec. 14, T2N, t67W, Weld County, Colorado. A tract of land
approximately 11 acres in size in the north central part of the NWu
is to be used for gas storage, separation and transmission facilities.
The area is mapped (see attached sketch) as 51-C and 51-D, Vona loamy
sand, 3-5 and 5-9% slope; 55A-B, Olney loamy sand, 1-3% slope and
72-X, Valent sand, rolling topography. The Vona and Valent soils
are deep, moderately coarse to coarse textured soils, excessively well-
drained with moderately rapid to rapid permeability. The Olney soils
are deep, medium textured below 10 to 12 inches , well drained with
moderate to moderately rapid permeability. The area is not subject to
flooding and has very little runoff. The soils are all stable and have
only slight limitations for storage tanks either above or below ground.
The soil survey is made on the basis of 50 to 60 inch borings. The
soil map should be used for general planning and does not exclude the
need for on-site investigation for specific engineering purposes.
