The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Road Classification Plan (FHU): The Colorado Department of Transportation (CDOT)
has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley
office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that
may be needed to obtain or upgrade the permit. (State Highway 52)
Access:
• The location of the existing access was field verified to have sufficient sight distance in both directions.
A stop sign shall be placed in the appropriate location prior to entering on State Highway 52.
Site Plan:
The access from State Highway 52 must be paved from the access point to the office location. The
internal parking areas and travel lanes may be gravel constructed to County Standards (3/4" to 1"
minimum aggregate). Please correct the site plan to show the paved and gravel areas.
Each customer parking space shall be equipped with wheel guards or curb blocks when necessary to
prevent vehicles from extending beyond the boundary of the space and from coming into contact with
other vehicles, walls, fences or plantings.
Storm Water Drainage:
Public Works has requested minor drainage calculations for a water quality feature in lieu of a full
Drainage Study. The applicant submitted calculations for a detention pond provided by CRC Consulting.
The calculations were stamped and signed by a registered professional engineer. This Drainage Study
does not follow the Weld County Drainage Criteria. The detention pond cannot release at a rate greater
than the 5-year historic. If a detention pond is to be used instead of a water quality feature, it must be
designed utilizing the Weld County Drainage Criteria.
Please provide either:
a. Calculations for a water quality feature. (Volume 3, Section 4.4.2 of the Urban Storm Drainage
Criteria Manual)

b. A revised drainage study following the Weld County Drainage Criteria (Weld County Code,
Chapter 8, Section XI)

Geotechnical Soils Report:
The applicant shall provide a soils report for review and comment. Contact Clay Kimmi, Drainage &
Floodplain Engineer, 970-304-6496 ext. 3750, for a follow up.
Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency (FEMA).
At this time we are unable to conduct a full review of the USR application due to the missing items
described above. Public Works will require sufficient time to review the additional materials and
depending on the submittal date as well as the content,we may request the hearing for this
project to be continued to a later date.

Environmental Health Services has reviewed this proposal for outdoor storage of RV's,
boats and construction equipment. There was not an RV wash site or an RV dump
station identified in the application. There is a RV dump station at the Love's truck stop
at 1-76 and SH 52. The existing well on the property has been re-permitted to allow for
commercial use (permit 66600-F). There is an existing septic system on the property
(SP-0800036) that was originally sized for a three bedroom home. The Board of Health,
on March 25, 2008, approved an engineer design for the addition of 5 patrons a day to
the septic system which included the addition of 462 square feet to the existing septic
system. The engineer design was based on 100 storage sites. As this proposal
includes 4 employees, 152 spaces and an office/apartment an updated engineers report
Sis required or a new septic system can be installed for the additional flows.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. In the event the applicant intends to utilize the existing septic system for all or
any of the following: addition of 4 employees, 52 storage spaces and an
office/apartment, the septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
• 3. Alternately to item #2 above, the applicant shall install an individual sewage
disposal system at the office/apartment and the system shall be installed
according to the Weld County Individual Sewage Disposal Regulations. The
system shall be sized for all or any of the following: addition of 4 employees, 52
storage spaces and an office/apartment. The septic system is required to be
designed by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
• 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.

• 6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate drinking, handwashing and toilet facilities shall be provided for patrons
of the facility, at all times.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing private water supply. (Permit
66600-F)
9. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
10.Sewage disposal shall be by septic system. Any septic system located on the
property must comply with all provisions of the Weld County Code, pertaining to
Individual Sewage Disposal Systems.
• 11.Any vehicle washing area shall capture all effluent and prevent discharges from
the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
12.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

1. A separate building permit shall be obtained prior to the construction of any building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Commercial building plans shall bear the wet stamp of a Colorado registered architect or engineer. Two
complete sets of plans are required when applying for each permit. Residential building plans may be required
• to bear the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2006 International Building Code;
2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas
Code; and the 2008 National Electrical Code, 2006 International Energy Conservation Code and Chapter
29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
5. The storage units will probably be classified as(S-1), storage of moderate hazard materials.The dwelling will
be classified as a mixed use (R-3) single family dwelling with a (B) office. The office will be required to be
accessible to persons with disabilities.
6. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
7. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. When measuring buildings to determine offset and setback requirements, buildings
• are measured to the farthest projection from the building. Property lines shall be clearly identified and all
property pins shall be staked prior to the first site inspection.
7. Provide letter of approval from Fort Lupton Fire Protection District prior to construction of any structure.
8. There are no building permits on record for this parcel.

Here are the CDOT comments for a few referrals which are due in a few days.
AmUSR-1679 (JLW Investment, LLC) :
This Permittee has already completed their CDOT access permit which is attached to this e-
mail. There is a clause attached to the permit which reads:
THIS PERMIT AUTHORIZES A MAXIMUM OF 30 TRUCKS PER DAY USING THIS SITE. IF TRAFFIC IS FOUND TO
BE GREATER, A TRAFFIC STUDY WILL BE REQUESTED FROM THE PERMITTEE, ALONG WITH A NEW CDOT
ACCESS PERMIT.
Any help the county can give with monitoring the parcel to check for compliance with our
traffic requirement will be greatly appreciated.
The right-of-way request for this parcel is 75 feet from centerline of the roadway.

Upon the signing of this permit the permittee agrees to the terms and conditions and referenced attachments contained
herein.All construction shall be completed in an expeditious and safe manner and shall be finished within 45 days from
Initiation.The permitted access shall be completed in accordance with the terms and conditions of the permit prior to
being used.
The permlttee shall notify Unda McWilliams with the Colorado Department of Transportation In
Greeley, Colorado at(970)350-2147, at least 48 hours prior to axmrnendng construction within the
State Highway right-of-way.
The person signing as the permittee must be the owner or legal representative of the property served by the permitted access and have full authority to

Permit for a use permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the Commercial and Industrial Zone District (RV, Boat, and construction
equipment storage) in A (Agricultural) Zone District
Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county
planning directors, this office will only perform a cursory review of the referral information and provide
comments. The comments do not address the adequacy of the water supply plan for this project or the
ability of the water supply plan to satisfy any County regulations or requirements. In addition, the
• comments provided herein cannot be used to guarantee a viable water supply plan or
infrastructure, the issuance of a well permit, or the physical availability of water.
The referral information indicated that the proposed development will be supplied by a
commercial well, however no permit number was provided. According to the records of the State
Engineer's Office the well permit for the property was identified as permit no. 66600-F.
Well permit no. 66600-F was issued on December 12, 2007 for the use of an existing well
constructed under permit no. 165214 (canceled) and permitted under permit no. 240275. The use of
ground water from this well is limited to commercial, domestic, livestock, animal watering and irrigation.
The annual amount of ground water to be appropriate by this well shall not exceed 7.8 acre-feet.
Based on the uses described above this office has no objections to use well permit no. 66600-F
to supply the proposed development on the property, as long as the well is being used within the
conditions of approval of well permit no. 66600-F.
