financing arrangements.
Approved With Conditions
The Subdivision Exemption is approved in accordance with information submitted in the application and the policies
of Weld County. The Department of Planning Services has determined through its review that the standards of
Section 24-8-40 of the Weld County Code have been met.
1. Prior to recording the plat:
A. The plat shall be titled: Subdivision Exemption No. 1176
B. The applicant shall address the requirements of the Department of Public Works as stated in their
referral dated July 7, 2010. A right-of-way permit shall be shall be required and shall be obtained
from the Department of Public Works for the access to the proposed facility.
C. County Road 392 is designated on the Weld County Road Classification Plan as a local gravel road,
which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A
total of 30 feet from the centerline of County Road 390 shall be delineated right-of-way on the plat.
This road is maintained by Weld County. The applicant shall verify and delineate on the plat the
existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured
from the edge of future right-of-way. If the right-of-way cannot be verified, it shall be dedicated.
D. County Road 136 is designated on the Weld County Road Classification Plan as a collector road,
which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A
total of 40 feet from the centerline of County Road 136 shall be delineated future right-of-way for
County Road 136 on the plat. This road is maintained by Weld County. The applicant shall verify
and delineate on the plat the existing right-of-way and the documents creating the right-of-way. All
setbacks shall be measured from the edge of future right-of-way. If the right-of-way cannot be
verified, it shall be dedicated.
E. The applicant shall provide the Weld County Department of Planning Services with a Statement of
Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
F. The following notes shall be placed on the plat:
1) This Subdivision Exemption is for the temporary use of a parcel for a public utility facility.
2) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the definition
of setback in the Weld County Code, the required setback is measured from the future right-
of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A, B,
E, F, H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any
wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of
any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld
County Code.
3) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that the lot has an adequate water supply of sufficient
quality, quantity and dependability.
5) Subdivision Exemption Lots created for a Public Utility Facility shall revert back to the
original parcel when the use ceases to exist.
6) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
7) Building permits shall be obtained prior to the construction of any building.
8) Effective January 1, 2003, Building Permits issued on the proposed lots will be required to
adhere to the fee structure of the Weld County Road Impact Program. (Ordinance 2002-11)
9) Effective August 1, 2005, Building permits issued on the subject site will be required to
adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
10) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices and
a lower level of services than in town. Along with the drawbacks come the incentives which
attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of
city noise and congestion, and the rural atmosphere and way of life. Without neighboring
farms, those features which attract urban dwellers to rural Weld County would quickly be
gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area. Well
run agricultural activities will generate off-site impacts, including noise from tractors and
equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work,
harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from
ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields,
including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of
the way of residential development without threatening the efficient delivery of irrigation to
fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be
a public or private nuisance if the agricultural operation alleged to be a nuisance employs
methods or practices that are commonly or reasonably associated with agricultural
production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of municipalities.
The sheer magnitude of the area to be served stretches available resources. Law
enforcement is based on responses to complaints more than on patrols of the county and
the distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who
must leave their jobs and families to respond to emergencies. County gravel roads, no
matter how often they are bladed, will not provide the same kind of surface expected from a
paved road. Snow removal priorities mean that roads from subdivisions to arterials may not
be cleared for several days after a major snowstorm. Snow removal for roads within
subdivisions are of the lowest priority for public works or may be the private responsibility of
the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal
services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines,
territorial farm dogs, and livestock present real threats to children. Controlling children's
activities is important, not only for their safety, but also for the protection of the farmer's
livelihood. Parents are responsible for their children.
2. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat
along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in
the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall
be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar
plat and additional requirements shall be submitted within sixty (60) days from the date the Administrative
Review was signed. The applicant shall be responsible for paying the recording fee.
3. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Subdivision Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS
formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The
preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to
maps(c�co.weld.co.us.
4. The Weld County Department of Planning Staffs approval of this Subdivision Exemption is based upon
satisfying the above conditions. Should an applicant be unwilling or unable to meet any one of these
conditions, within 60 days of approval, then this case will be forwarded to the Board of County
Commissioners with a recommendation for denial.

The telecommunication shelter(or Hut as we refer to them) is needed for the Fiber to the Home project
Wiggins Telephone Association is currently undertaking. This hut will house electronics that will
regenerate the lightwave signal to allow further reach of the lightwave signal. In future years the shelter
will have fiber distribution equipment that will allow us to split the signal of one fiber to serve up to 32
homes as we complete the Fiber to the Home.
The rural areas we serve will see the benefit of improved telephone service over the existing 30+year
old copper facilities currently in place as well as the benefits of having access to a truly broadband
internet service for business and education purposes.

THIS LEASE AGREEMENT is made and entered into as of the `gam day of feirve'-7 2010 ,by and
between Charles Dunlap and Linda Dunlap,Husband and Wife hereinafter referred to as
"Lessor",and WIGGINS TELEPHONE ASSOCIATION,414 S. Main,Wiggins,Colorado 80654,a Colorado Corporation,
hereinafter referred to as"Lessee". This building is on leased ground.
1. Description of Property Lessor hereby grants and conveys permission to Lessee to construct,operate and install
building and/or equipment as required and necessary to support Lessee's telecommunications system on the following tract of
land
A parcel not to exceed 20 feet by 40 feet located approximately 30 feet northeast and 352
feet southeast of centerline of the intersections of County Road 390 and County Road 136
of all that part of the NW '/4 NE 1/4 lying north and east of County Road 390, Section 34,
Township 12 North,Range 62 West of the 6th P.M., Weld County,Colorado.
2. Term The term of this Lease Agreement shall be twenty-five(25)years from February 1,2010.
3. Lease Payments The yearly lease payment shall be One Hundred Dollars($100.00),with all twenty-five
payments,a total of$2,500.00,due in advance on or before the date this lease becomes effective,as set forth in Article 2.
4. Installation and Maintenance of Lessee's Building,Structures and Equipment Lessor agrees and hereby
grants Lessee free access to the described land for the purpose of constructing,inspecting and maintaining the facilities as set
forth in Article 1. It is agreed that only employees,engineers and contractors of Lessee,including their subcontractors,or
persons under their direct supervision,will be permitted to enter the property. It is further agreed that Lessee's construction and
installation will comply with all applicable rules and regulations of the Federal Communications Commission,Public Utilities
Commission of Colorado,and all applicable Electrical Codes.
5. Road and Utility Easement If the construction site is not immediately accessible to a public road,Lessor agrees
to allow access as necessary to the Lessee,from the nearest accessible point to the site for the purpose of constructing and
maintaining required public utility facilities,including electrical and telephone equipment.
6. Site Maintenance Lessee shall construct and maintain a fence around the building.
7. Lessee's Equipment Lessor acknowledges and agrees that all personal property,equipment, apparatus, fittings,
fixtures and trade fixtures installed or stored on Lessee's premises constitute personal and exclusive property of Lessee or one
of Lessee's affiliates,including without limitation,all telecommunications equipment,towers,switches,cables,wiring and
associated equipment or personal property(collectively,the"Equipment"). The equipment shall remain at all times the
personal property of the lessee or one of Lessee's affiliates,and neither the Lessor nor any person claiming by,through or under
Lessor shall have any right title or interest(including without limitation a security interest) in the equipment. Lessee,and
Lessee's successors in interest, shall have the right to remove the equipment at any time during the term of this Lease,including
without limitation upon the expiration of the term of this Lease or its earlier termination. With respect to the holder of any
mortgages,deed of trust or other lien affecting lessor's interest in the premises,whether existing as of the date hereof or arising
hereafter,Lessor and Lessee hereby agree,acknowledge and declare that the equipment is now and shall at all times hereafter
remain the personal and exclusive property of lessee or one of lessee's affiliates. The parties further acknowledge and agree
that Lessor shall have no right or authority to grant a lien or security interest in or to any of the equipment.
8. Leasehold Mortgages and Security Agreements (a) Lessor hereby agrees that Lessee may execute and deliver
to one or more of Lessee's Lenders("Lender"),and perfect one or more leasehold mortgages and security agreements
("Mortgage")creating a lien on the leasehold estate created by this Lease and on any and all property now or hereafter in or on
such leasehold estate. The Mortgage on such leasehold estate and property shall be senior to any lien of Lessor thereon.
(b) Lessor further agrees(i)that if an address of Lender is provided to Lessor,lessor shall provide to Lender written
notice of any default in payment of lease payments required to be made by Lessee under this lease,(ii)that Lender shall have
the right,but not the obligation,to cure any such default at any time within sixty days after Lender's receipt of such notice,and
(iii)that Lessor shall not seek to cancel this Lease if such default is so cured.
(c) Lessor further agrees that if Lender shall foreclose or otherwise realize upon any Mortgage,Lender may elect in
writing to succeed to,and to have all of the benefits of, all of Lessee's right,title and interest in and to said leasehold estate,but
Lender shall not be responsible for lease payment or indemnity obligations of lessee prior to lender's written election,provided,
however,that there shall be no monthly proration of yearly lease payments. If Lender assigns and transfers such leasehold
estate,notwithstanding other provisions,Lender shall have no obligation under this lease arising,accruing,or attributable to the
period subsequent to such assignment and transfer by Lender,and Lessor shall not require otherwise for any consent to such an
assignment or transfer.

(d) Lessor agrees to execute and deliver to lender from time to time,as requested,lessor's written consent regarding
the foregoing.
9. Sublease Lessee shall not assign this Lease or sublet the premises or any part thereof,except to an affiliate of
Lessee,without first obtaining the written consent of the Lessor. Notwithstanding the above prohibition or limitation of
Lessee's right to sublease or assign its interest under this Lease,Lessor acknowledges and agrees that Lessee shall have the
right to grant a security interest in its right and interest under this lease. Lessor further agrees that any person foreclosing or
otherwise realizing upon such a security interest granted by Lessee shall succeed to, and shall have the benefits of,all Lessee's
rights,title and interest under this Lease.
10. Taxes and Insurance Lessee shall be responsible for and shall pay all personal property taxes on the leased
premises.
Lessee shall at all times during the term of this Lease maintain at its own expense worker's compensation and
employers' liability insurance in accordance with appropriate laws on all employees used in the performance of this lease,and
shall maintain comprehensive general public liability and property damage insurance covering operations,products,completed
operation,contractual and independent contractors' liability in minimum bodily injury amounts of$1,000,000 per occurrence
and aggregate.
11. Lessor's Indemnity Lessor hereby agrees to indemnify and hold Lessee harmless from any damages,claims or
causes of action which may arise during the term of this Lease as a result of any action or negligence by the lessor,their agents,
servants or'employees,and to pay all reasonable costs and expenses,including,but not limited to,attorney's fees and court
costs.
12. Lessee's Indemnity Lessee hereby agrees to indemnify and hold Lessor harmless from any damages,claims or
causes of action which may arise during the term of this lease as a result of any action or negligence by the lessee,their agents,
servants or employees,and to pay all reasonable costs and expenses, including,but not limited to,attorney's fees and court
costs.
13. Contingency This Lease Agreement is contingent upon Lessee receiving all necessary permits and licenses,
including,but not limited to,FCC and any zoning requirements.Any other provision herein contained notwithstanding,no lease
payment shall be due until receipt by lessee of final approval. The date of receipt of such final approval shall be the
anniversary date of this Agreement and the date payment is due pursuant to Article 3.
14. Governing Law Any claim arising out of this Agreement shall be governed by the laws of the State of Colorado.
15. Binding Effect This Agreement is binding upon the parties hereto,their respective heirs,executors,
administrators,successors and assigns.
16. Warranties of Title and Ouiet Possession Lessor covenants that lessor is seized of the demised premises in fee
simple and has full right to make and enter into this lease and that lessee shall have quiet and peaceable possession of the
demised premises during the term of this lease agreement.

The Weld County Public Works Department has reviewed this proposal. Staff comments made during this phase of the
process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues
of concern must be resolved with the Public Works Department. Our comments and requirements are as follows:
COMMENTS:
WCR 390 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-
90), the required setback is measured from the future right-of-way line.
WCR 136 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-
90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
1. The applicant shall obtain a Right-of-Way Permit for the proposed access. Contact the Public Works Traffic
Engineer.
2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of
12 inches until the area is completely developed.
FLOOD HAZARD DEVELOPMENT STANDARDS:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency
(FEMA).
