The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Road Classification Plan (FHU): WCR 10 is a collector road and requires an 80-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
Our most recent AADT count reflects 451 vehicles per day taken in August 2009.
• WCR 65 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in
the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Our most recent MDT count reflects 29 vehicles per day taken in October 2008.
Site Plan: The applicant shall utilize the existing access to this parcel.
Parking areas and the access drive shall be surfaced with gravel, recycled asphalt or the equivalent and
shall be graded to prevent drainage problems.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in
such a manner that it will reasonably preserve the natural character of the area and prevent property
damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration
and/or unplanned ponding of storm run-off.
Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for a feed distribution
business. Feed is brought in by semi and then delivered by the applicants to various
locations. Customers may also come to the site to pick up feed. The application
indicates there are currently no employees.
Water is supplied by an individual well which is permitted for "domestic purposes inside
three (3) single family dwellings". As there may be customers that come to the site, the
well may not be sufficient for business usage. Written documentation from the State
• Division of Water Resources is required to verify the well is appropriately permitted for
the proposed use.
Customers must have access to sanitary facilities. The restroom in the home may be
utilized, however that may require changing the well permit as well as adhering to
building department requirements.
The residence is served by an individual sewage disposal system (Permit #SP-
9800088) and was sized for a 4 bedroom home which is equivalent to 8 people. The
septic system will not require an engineer's evaluation unless the hydraulic load
exceeds 8 people.
As there are delivery trucks associated with the business, a dust abatement plan is
required for on site dust control.
A waste handling plan is required to ensure the business items are disposed of in an
appropriate manner.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
• recorded:
• 1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed of
(including the facility name, address, and phone number).
3. If the applicant intends to utilize the existing septic system at the home, for
employee and/or customer use, the septic system shall be reviewed by a
Colorado Registered Professional Engineer if the number of people using the
system will exceed 8. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
•
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
4. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well is appropriately permitted for the
business use.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

. 3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
7. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing private water supply, well permit
215742.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
9. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water

available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

1. A building permit shall be obtained for the change of use for any structure.
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet for the Weld County Building Department with each building permit. Submittal plans
shall include a floor plan showing the specific uses of each area for the building. The
Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
• Code.
3. Weld County records indicate the metal barn has never been issued a building permit. The
existing metal barn will require a licensed Engineer or Architect registered in the State of
Colorado to verify it meets all the design criteria of the 2006 International Building Code and the
Weld County Building Code.
4. Buildings shall conform to the requirements of the various codes adopted at the time of the
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; 2003 ICC ANSI 117.1 Accessibility Code; 2008 National Electrical
Code and Chapter 29 of the Weld County Code.
5. All building plans shall be submitted to the Southeast Weld Fire Protection District for review
and approval prior to issue of the building permit.

Subject: USR-1734 Referral
Upon review of my case files and computer, an active Zoning Violation(ZCV09-00299)was noted. This
violation was initiated due to the presence of a feed and seed operation without first submitting and
completing the necessary Weld County Zoning Permits. This case has not yet been presented to the
Board of County Commissioners through the Violation Hearing process;therefore no Investigation Fee is
required.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, the feed and seed storage and business operations shall be removed from the
property within 30 (thirty) days. Additionally, if denied by the Board of County Commissioners please
request this violation case be referred to the County Attorney's Office with a delay of legal action for the 30
(thirty) days mentioned above.
