This change will not require another amendment to the AmFHDP-404 . The removal of the berms will make the situation better. Below you will find a listing of each condition followed by an explanation of how we have satisfied the condition. 1.A. The applicant shall address the concerns of the Weld County Sheriff's Office, as outlined in the referral dated January 9,2004. Evidence of approval shall be submitted to the Department of Planning Services. Response: Three concerns were raised in the January 9, 2004 Sheriff's Office correspondence (See Exhibit A), that are addressed as follows: 1. No regular trucking activities are planned for the Duckworth site, as all mined material will be conveyed via a covered conveyor bridge across Weld County Road 20.5 to Lafarge's existing Cottonwood Pit. However, if any trucks do access the site to remove material they will, per company policy, be required to tarp loads to reduce the likelihood of vehicle damage or material escape. 2. In order to minimize the transport of foreign materials via trucks and other vehicles leaving the site, approximately 100-200 feet of cobble clean-off pad will be installed at the entrance. 3. Lafarge appreciates the sheriff's office offer of training through the program," Crime Prevention through Environmental Design" .We may contact them as this project prepares for construction to take advantage of the opportunity. 1.B. The applicant shall address the concerns of the Mountain View Fire Protection District, as outlined in the referral dated December 18,2003. Evidence of approval shall be submitted to the Department of Planning Services. Response: The Mountain View Fire Protection District had no objections to the Special Use Permit application (See Exhibit B). Lafarge will abide by all Uniform Fire Code rules and regulations. 1.C. The applicant shall address the concerns of the Town of Frederick, as outlined in the referral dated January 6, 2004 Lafarge incorporated many of the Town of Frederick's comments into our landscape plan, including the use of vegetated berms and tree preservation. Final reclamation does incorporate provisions for wildlife habitat in conjunction with possible water storage. Regarding community issue resolution throughout the life of the mining operation, this site, as with all Lafarge mining operations, will be posted at the entrance with site identification information. Large land management staff will be available to answer any concerns that may arise. 1.D. The applicant shall contact the State of Colorado, Division of Wildlife, regarding any concerns it may have. Evidence of approval shall be submitted to the Department of Planning Services A Wildlife Resources Assessment and Preble's Jumping Mouse Habitat Assessment were submitted to the DOW in 2003 and 2004 with no objections from the Department. (See Exhibit C for US Fish and Wildlife response) 1.E. The applicant shall provide written evidence that all issues involving "the placement of dredge or fill material, and any excavation associated with a dredge or fill project, either temporary or permanent, in waters of the United States which includes ephemeral, intermittent, and perennial streams, lakes,ponds or wetlands at the site..."have been addressed to the satisfaction of the Department of the Army, Corps of Engineers. Evidence shall be submitted to the Weld County Department of Planning Services for review and approval. Response: Lafarge submitted a wetland delineation report to the US Army Corps of Engineers in 2003 to which the Corps responded with no objections. Only non-jurisdictional wetlands will be disturbed and the Corps did not raise any objection to these activities (See Exhibit D). 1.F. The applicant shall submit evidence of an Air Pollution Emission Notice(A.P.E.N.)and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Public Health and Environment, if applicable. Evidence of approval shall be submitted to the Department of Public Health and Environment, if applicable. Evidence of approval shall be submitted to the Department of Planning Services. Response: Please see attached APEN application and CDPHE response. (See Exhibit E). 1.G. The applicant shall submit a Dust Abatement Plan for review, and approval, to the Weld County Department of Public Health and Environment. Evidence of approval shall be submitted to the Department of Planning Services. Dust abatement will be conducted in accordance with the State approved APEN. Additionally, mining and reclamation will occur in phases to minimize disturbed areas that could lead to dust problems and a water truck will be available to spray the access road as needed. 1.H. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division(WQCD)of the Colorado Department of Public Health and Environment for any proposed discharge into State Waterways. Alternately, the applicant can provide evidence from the WQCD that they are not subject to the requirements. Evidence of approval shall be submitted to the Weld County Department of Planning Services. Response: Please see attached Colorado Wastewater Discharge Permit. (See Exhibit F). 1.1. The applicant shall submit a Landscape Plan identifying the number, size, and species of all plant material to the Weld County Department of Planning Services for review and approval. This plan shall include specifications of any proposed berms, if required. The proposed berms will be extended to mitigate impacts to surrounding properties and adjacent road rights-of-way. Any berm placed in the one-hundred-year floodplain cannot obstruct passage of flood flows. The applicant shall use breaks in the berm with landscaping to fill the void, culverts, or some other method that will allow water to flow freely. Response: Please see enclosed Landscape Plan. 1.J. The applicant shall apply for,and be approved for,a Flood Hazard Development Permit for any development that will increase or decrease the base flood elevation in the floodplain, as delineated on FIRM Community Panel Map#080266 0850 C, dated September 28, 1982. The applicant shall obtain a Flood Hazard Development Permit for any new structures. No stockpiling of material shall be allowed in the floodway. Response:a conditional Flood Hazard Development Permit has been obtained and will be finalized prior to construction, as required in Condition of Approval 2.B. No stockpiling shall occur in the floodway. 1.K. The applicant shall provide the Department of Planning Services with a copy of a Utility Right-of-Way Crossing Permit from the Department of Public Works,prior to the installation of conveyor system across Weld County Road 20.5 Response: a Utility Right-of-Way Crossing Permit will be obtained just prior to construction, as required by Weld County Public Works. Please see enclosed Weld County Public Works e-mail, (Exhibit G) 1.L. The plat shall be amended to delineate the following: 1.)All pages of the plat shall be labeled USR-1455 2.) The existing access to the site shall be utilized and shown on the plat. No additional accesses shall be granted. 3.) The location of any on-site signs. Freestanding signs will not be used. Site Identification sign smaller than 2'x2' will be posted on the access gate. 4.) The approved Landscape, Screen, and Berm Plan Provided separately. 5.) Weld County Road 20.5 is designated on the Weld County Transportation Plan Map as a four- lane minor arterial road, which requires 100 feet of right-of-way. A total of 50 feet from the centerline of Weld County Road 20.5 shall be delineated as right-of-way on the plat. This road is maintained by Weld County. 6.)A 20 foot setback from the future right-of-way shall be delineated on the plat for the setback requirement in the A (Agricultural)Zone District. 7.) The attached Development Standards for the Use by Special Review Permit shall be adopted and placed on the Use by Special Review Plat prior to recording. The completed plat shall be delivered to the Weld County Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 60 days of approval by the Board of County Commissioners. Response: Please see attached, amended plat 2. Prior to construction: A. The applicant shall obtain the appropriate building permits through the Weld County Building Inspection Department. The sheriff's office requests that gravel trucks transporting materials out of the area on county roads assure that their loads are covered, thus reducing loose materials on the roadway and the amount of damage to vehicles. 2. The Sheriffs Office also requests that gravel trucks and other vehicles leaving the site do not bring foreign materials on to the roadways on their tires. This may be accomplished by paving a short distance prior to entering the public roadway. 3. The sheriff's office would be willing to provide a program entitled Crime Prevention through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by "hardening"it to crime. • The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. It is apparent under the ruling above that the DA does not have the authority to regulate work in wetlands 1,2,3 and 4. These wetlands are not waters of the U.S. and therefore non-jurisdictional. No permit or other authorization by the DA is required for work in these Wetlands. Wetland area SE-1 does not flow to an interstate water. The wetlands at IC-1B and IC-1C site were created by man-induced irrigation and would revert to uplands if the irrigation activity were to be cut off. In that regard,these wetlands are not waters of the U.S.pursuant to Section 404 of the Clean Water Act. A Department of the Army Permit will not be required for any work in these wetlands. The particulate emission control measures listed on the attached page (as approved by the Division) shall be applied to the particulate emission producing sources as required by Regulation No. 1, Section III.D.1.b. 3. The Division's approval of the control plan is based on the submitted production level as listed below. Prior to any increase in daily or annual production rates, the applicant shall submit an Air Pollutant Emission Notice and Control Plan revision which will be subject to Division review and approval to ensure compliance with the National Ambient Air Quality Standards for particulate matter. Records of the actual production rate shall be maintained by the applicant and made available to the Division for inspection upon request. (Reference: Regulation No. 1, III.D.1.b.) Production of aggregate shall not exceed 13,000 tons per day and 2,500,000 tons per year. This activity shall not result in the exceedence of the following emissions of fugitive total suspended particulates (TSP) and fugitive particulate matter of less than ten microns (PM1o). These emission limits are based on the production rates listed above. Emissions of from conveyor transfer points shall not exceed the following limitations (as calculated in the Division's preliminary analysis): (Reference: Regulation No. 3, Part B, Section II.A.4.) Particulate Matter: 5.3 tons per year. PM10 (Particulate Matter<10 µm): 1.7 tons per year. 5. This source will be subject to the New Source Performance Standards requirements of Regulation number 6, Subpart OOO whenever there is primary crushing capacity greater than 150 tons per hour(portable equipment) or 25 tons per hour(fixed equipment) at this location as follows: a. Visible emissions from each crusher shall not exceed fifteen percent(15%) opacity. b. Visible emissions from each screen and transfer point shall not exceed ten percent(10%) opacity. In addition, the following requirements of Regulation No. 6, Part A, Subpart A, General Provisions, apply. a. No article, machine, equipment or process shall be used to conceal an emission which would otherwise constitute a violation of an applicable standard. Such concealment includes,but is not limited to, the use of gaseous diluents to achieve compliance with an opacity standard or with a standard which is based on the concentration of a pollutant in the gases discharged to the atmosphere. (§60.12) b. Written notification of construction and initial startup dates shall be submitted to the Division as required under§60.7. c. Records of startups, shutdowns, and malfunctions shall be maintained, as required under § 60.7. • d. Compliance with opacity standards shall be demonstrated according to§60.11. e. At all times, including periods of start-up, shutdown, and malfunction, the facility and control equipment shall, to the extent practicable, be maintained and operated in a manner consistent with good air pollution control practices for minimizing emissions. Determination of whether or not acceptable operating and maintenance procedures are being used will be based on information available to the Division, which may include, but is not limited to, monitoring results, opacity observations, review of operating and maintenance procedures, and inspection of the source. THIS SOURCE IS SUBJECT TO THE FOLLOWING EMISSION GUIDELINES: a. Mining and Processing Activities -Visible emissions not to exceed 20%, no off-property transport of visible emissions. b. Haul Roads -No off-property transport of visible emissions shall apply to on-site haul roads, the nuisance guidelines shall apply to off-site haul roads. c. Haul Trucks -There shall be no off-property transport of visible emissions from haul trucks when operating on the property of the owner or operator. There shall be no off-vehicle transport of visible emissions from the material in the haul trucks when operating off of the property of the owner or operator. Control Measures 1. Adequate soil moisture must be maintained in topsoil and overburden to control emissions during removal. Watering shall be implemented if necessary. 2. Topsoil and overburden stockpiles shall be compacted and revegetated within one year. 3. Emissions from material handling (i.e. removal, loading, and hauling) shall be controlled by watering at all times unless natural moisture is sufficient to control emissions. 4. Haul area from loader to feeder shall be watered at least twice per day. 5. Haul roads for finish product transport shall be treated with chemical stabilizers per manufacturer's recommendations and watered at least twice per day. 6. Reclamation works and sequential extraction of material shall be initiated to keep the total disturbed areas at any one time to a minimum. 7. Material stockpiles shall be watered as necessary to control fugitive particulate emissions. Aggregate materials shall be sprayed with water during material loading into the storage bins or stockpiles unless natural moisture is sufficient to control emissions. 8. This permit is issued in reliance upon the accuracy and completeness of information supplied by the applicant and is conditioned upon conduct of the activity, or construction, installation and operation of the source, in accordance with this information and with representations made by the applicant or applicant's agents. It is valid only for the equipment and operations or activity specifically identified on the permit. 2. Unless specifically stated otherwise,the general and specific conditions contained in this permit have been determined by the APCD to be necessary to assure compliance with the provisions of Section 25-7- 114.5(7)(a), C.R.S. 3. Each and every condition of this permit is a material part hereof and is not severable. Any challenge to or appeal of, a condition hereof shall constitute a rejection of the entire permit and upon such occurrence,this permit shall be deemed denied ab initio. This permit may be revoked at any time prior to final approval by the Air Pollution Control Division (APCD) on grounds set forth in the Colorado Air Quality Control Act and regulations of the Air Quality Control Commission (AQCC), including failure to meet any express term or condition of the permit. This permit and any required attachments must be retained and made available for inspection upon request at the location set forth herein. One of the conditions of approval requires that we obtain a utility right of way crossing permit for a conveyor installation prior to recording the plat. As we discussed, Lafarge will not be constructing the conveyor until next spring at the earliest. We understand that Weld County Public Works requires that a right of way crossing permit be obtained no sooner than 90 days prior to construction. Lafarge requests, therefore, that you conform this restriction so that we may provide same to the Planning Department in lieu of a permit.
