The inspection was focused on detecting potential nuisance conditions and the acceptance of unapproved feedstock. The Department recommends that the following measures be included in the upcoming Design & Operations Plan revision: (I) include a visual inspection procedure and leak testing (such as a falling head test) for the mixing pad and (2) construct a secondary containment structure around the waste storage tanks. The purpose of the test is to accumulate quantitative data regarding the various energy byproducts that can be produced using aerated static pile composting methods. It goes without saying that there is significant emphasis being placed on finding alternative energy sources, with an emphasis on utilization of agricultural resources if possible. To conduct the test we will use typical Class I, II, and III feedstocks that are already being received at our site, and typical operational equipment and processes as defined in our approved D&O plan and USR permit. One of the chief feedstocks we want to test will be corn stover. We will use a standard aerated static pile composting method as approved in our D&O plan and USR permit. While our normal process is to place our compost on our standard site surface, to assist in obtaining quality data we will construct a concrete pad on which to conduct this test. The pad will include aeration channels to provide air to the compost heap and to collect leachate from the heap for testing. The pad will be constructed of 4000 PSI concrete and engineered to accommodate front end loaders and other equipment.A cover will be placed over the heap with collection pipes to capture test emission gases produced by the composting process. Prior to construction of the concrete pad, we will obtain the proper Weld County building permit.At the end of the test, the concrete pad will remain on the site. After testing, the gas produced will be delivered to an enclosed flare for destruction as opposed to venting to the atmosphere. While there is no requirement to flare the gas,we feel it is the more environmentally responsible option. At the conclusion of the test,the flare will be removed along with the other equipment required for the test. The test is a temporary process and is anticipated to take 6 months or less from the time of initial compost heap placement. He stated that there were 3 exemption options for tests of this type: 1) 6 months or less for the duration of the test, or 2) less than 500 pounds of VOC emissions post flare created during the test,or 3) less than 10,000 pounds of material utilized in the test. This test qualifies under both the first and second exemption options. The test will require monitoring by 2 additional site personnel who will utilize a temporary office trailer to house equipment, including a weather station. The trailer will be rented from a licensed provider and will meet all Weld County requirements for temporary installation and use. At the conclusion of the test, the office trailer will be removed from the site. At times,the site will be manned 24 hours per day to monitor performance, but no operational activities will be conducted outside of permitted operational hours. A separate portable toilet will be provided for the monitoring personnel and placed next to the trailer. Potable water will also be provided in the office trailer. I have attached a flow chart for the test, design information on the concrete pad and accessory equipment,schematic drawing of the enclosed flare, and a site plan showing the general location of the pad and test office in relationship to existing structures. We anticipate applying for the building permit within the next 10 days or so to allow us to complete construction of the pad, allow for a curing period for the concrete,and begin the test sometime in mid June. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the Recreation Center. 7. The facility shall utilize the existing municipal sewage treatment system. (St. Vrain Sanitation District) 8. The facility shall utilize the existing public water supply. (Little Thompson Water District) 9. I have since spoken with the Fire Dept.who said they would want to review the tank during construction. Bryon said that Fire Department review of this type of tank is already part of the building permit process. In Public Works Dave said due to the floodplain they would need a FHDP that would require them to secure the tank so it didn't float away in case of a flood. Trevor from the health dept.response is below. I have repeatedly tired to speak with Carl Mount from the Div. of Reclamation and have not been able to get him on the phone. So just to refresh your memory-I was asked if the addition of the tank constituted a significant change to the currently approved USR which included gravel mining and 2 different batch plants at the site up on O Street and CR 35. Are you sure those are the correct dimensions? I think based on size alone, from a land use perspective, it would be appropriate to include the public so they are aware as to why this large structure is being constructed and what its being used for. It also makes me wonder if there will be increased production and vehicular traffic in the area as the result of increased storage capability? There is the potential for additional odors from the storage of such a large quantity of asphalt. It.is extremely likely that this structure would require an emissions permit due to the emissions of the 05/14/2007 • Page 2 of 2 contents....Call me if you have any questions. It is for a gravel mine,with the amendment they added a batch plant. Now they arc asking us if the addition of a large storage tank for liquid asphalt represents a significant change to the approved USR. I am thinking that it does not however, I wanted to see if there where any concerns from your point of view that would necessitate them amending their permit. The tank will be 100 feet in diameter and 40 feet tall. Since the contents need to remain hot the tank will have an electrical connection. The applicant plans for it to be bermed. On Monday Todd Loose and I, along with representatives from the company doing the test met with Kim, Trevor, and Troy and fully reviewed the details of the test with them and their applicability to our approved USR and D&O. Trevor called later that day and said that he had spoken with Kim and their opinion was that this was best defined as simply testing of existing processes that are already approved (use by right) and not a new pilot operation. As such they asked us to prepare a packet of information on the test for their file and review if needed along with a courtesy notification letter. I have prepared the packet and delivered it to Kim, Trevor, and Troy today. I will be sending you a hard copy via snailmail, and also will have Nancy send you an electronic copy.
