LAND AND LIVESTOCK CO. , ROUTE 1, BOX 386, AULT, COLORADO 80610 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS The Board of County Commissioners of Weld County, Colorado held a public hearing on the 8th day of August, 1979 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the appli- cation of Booth Bros. Land and Livestock Company, Route 1, Box 386, Ault, Colorado 80610, for the granting of a Special Use Permit for a cattle feedlot on the following described real estate, to-wit: A parcel of land located in the West half (W1) of Section 36, Township 7 North, Range 65 West of the 6th P.M. , County of Weld, State of Colorado, being more particularly described as follows : Beginning at the Northwest Corner (NW Cor) of said Section 36 and considering the North line of said Section 36 as bearing North 90°00 ' 00" East, with all other bearings contained herein relative thereto. Thence North 90°00' 00" East, 1209. 00 feet to the True Point of Beginning; Thence North 90°00' 00" East, 320. 07 feet; Thence South 04°36' 22" West, 2734. 07 feet; Thence South 87 °21 ' 00" West, 321. 74 feet; Thence North 04°36 ' 32" East, 2749. 00 feet to the True Point of Beginning. Said described parcel of land contains 20. 083 acres, more or less, including a strip of ground 30 feet in width along the North line of said described property reserved for county road right-of-way purposes and is subject to any rights-of-way or other easements as granted or reserved by instruments of record or as now existing on said described parcel of land, also including a strip of ground 20 feet in width reserved for alley along the east line of said described parcel. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a cattle feedlot on the above- described real estate, and ^i.MIS 790485 WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Reso- lution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a cattle feedlot on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the petitioner for a Special Use Permit for a cattle feedlot be, and hereby is , granted subject to the Development Standards contained in the Special Use Permit. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated July 17, 1979 be, and hereby are, adopted as the find- ings of fact of the Board of County Commissioners in this matter. It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Sections 3 . 3.E. 2 and 6 . 1 (4) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The request is to establish an agricultural enterprise in the Agricultural Zone District with existing land uses being predominantly agricultural. B. The cattle feedlot with the associated management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing any potential adverse impacts . C. The following referral agencies have reviewed this request and have set forth no objections to it: 1 . The West Greeley Soil Conservation Service, letter dated June 11, 1979 2 . Division of Water Resources, letter dated June 21, 1979 3. County Extension Agent, letter dated June 18 , 1979 4. Galeton Fire District, letter dated June 12, 1979 5. County Engineer, letter dated June 29, 1979 The Planning Commission recommendation for approval is conditional upon the following: 1. The attached Development Standards being recommended and adopted for the Special Use Permit. 2. No building or electrical permit shall be issued for the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the Department of Planning Services office. • Comments : In a telephone conversation on July 16, 1979, Mr. Ray Junge of the Colorado Geological Survey stated that his agency had no objections to the proposed cattle feedlot. To date our office has not received any letters of opposition from surrounding property owners. Chairman Carlson called for a motion to approve the minutes of July 3 , 1979. Ben Nix made a motion to approve the minutes as presented. The motion was seconded by Percy Hiatt. After some discussion, the members decided they would prefer hearing it at the next scheduled Planning Commission meeting. MOTION: Be it therefore resolved to continue the application to the August 7 , 1979 Planning Commission hearing. Motion by Fred Otis , seconded by Jim Gilbert. Wk, Section 36, T7N, R65W LOCATION: 41/2 miles east of Eaton APPEARANCE : Stow Witwer DISCUSSION: Mr. Witwer stated that the applicant desires to expand his present operation by 2, 000 head of cattle for a total of approximately 4, 000 to 4, 500 head. The expansion of the feedlot would put it no closer', to any residence than presently exists and the proposed expansion would cause no adverse impacts to anyone. There being no questions at this / time, Chuck Cunliffe read the Planning Staff' s recommendation for approval, \ the Development Standards , and the staff' s comments. No further questiol�s . NW% NW4, Section 12, T1N, R66W LOCATION: 2 miles east and k mile south of Fort Lupton APPEARANCE: Jim Smith DISCUSSION: Mr. Smith stated that they wish to increase the capabilities of the operation by adding Pits #4 and &5 for water. Pit #1 and #2 are already in existence. Pit #3 no longer exists . The addition of the two pits will increase the evaporation capabilities of the water in the pits. They also would like to implement an aeration system on Pits #2, #4, and #5 which would increase the evaporation capabilities. They would also like to be given the opportunity to use an equivalent such as vinyl to seal the pits. Bentonite could also possibly be used. Chuck Cunliffe then read the Planning Staff' s recommendation for approval, the Development Standards, and the Staff' s comments . John Hall of the Weld County Health Department then requested clarification through figures regarding how much water will be lost through evaporation based on engineering figures and also how much water will be lost with the proposed aerators. He wants assurance that what is presently in existence can accommodate the increased load that will be placed on the facility. Jim Gilbert asked if the Development Standards that are attached to the original Special Use Permit application have been adhered to. Chuck Cunliffe responded that the present request has originated as a result of a violation of the Development Standards . Percy Hiatt stated he was concerned about seepage. Discussion followed. Mr. Hall also questioned how many domestic wells were in the immediate area which could be affected by seepage. Mr. Smith responded that the closest well is located to the east approximately 600 yards which could be affected. MOTION: Be it therefore resolved to continue the request to the August 7 , 1979 Planning Commission meeting to have questions answered at that time regarding evaporation and seepage. Motion by Jim Gilbert, seconded by Percy Hiatt. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Jim Gilbert, Jerry Kiefer, Chuck Carlson, and Fred Otis. A vote of "no" was cast by Irma White. Planning Commissior inutes Page 3 July 17 , 1979 CONSIDER A RECOMMENDATION ON PROPOSED AMENDMENTS TO THE WELD COUNTY ZONING RESOLUTION WHICH WILL CLARIFY THE DUTIES AND RESPONSIBILITIES OF THE DEPARTMENT OF PLANNING SERVICES, THE PLANNING COMMISSION, AND THE BOARD OF COUNTY COMMISSIONERS IN ACTIONS CONCERNING AMENDMENTS TO THE MAP OF THE ZONING RESOLUTION DISCUSSION: Chuck Cunliffe requested that this item again be continued until such time as the Planning Staff has an opportunity to revise the recommendation. MOTION: Be it therefore resolved to continue the request. Motion by Jim Gilbert, seconded by Fred Otis. The permitted uses on the hereon described parcel of land shall be a cattle feedlot and shall be limited to the facilities shown hereon which are designed to handle a total of 2, 000 head of cattle and all other uses permitted by right under Section 3 . 3B of the Weld County Zoning Resolution. 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 3 . All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division. 5 . All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6 . There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 7. Drainage along Weld County Road 76 must be contained on private property and not in the borrow area. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. This will be accomplished by building 7 pens of 250 head capacity each. The total capacity for the feedlot, old and new, will be 4,000 head. Bearing these numbers in mind, the feedlot will be operated as follows: (A) There will be 1 shift worked during the daylight hours from 6:00 A. M. to 6:00 P. M. This shift would consist of no more than 5 employees - 3 pen checkers on horses and 2 feeders, 1 to operate a feedtruck, the other a loader. The cattle will be fed with 1 feedtruck, making approx- imately 20 loads per day - 10 in the morning and 10 in the afternoon feeding. (B) Pollution: (1) Air pollution at the feedlots will consist of the manure dust raised by the cattle as they move in the pens and as the feeding equipment runs in the feed alleys. This will be held to a minimum by a truck that will spray water out on the pens and wet them as well as the feed alleys. (2) Water pollution will be contained by retention ponds built at the bottom side of all pens to catch any and all runoff, natural or otherwise. These ponds or lagoons will be built to meet State and/or County specifications. (3) Odor from the feedlots will be controlled by regular maintenance in the pens, by loading and hauling out the waste and spreading it on the adjacent owned farms as fertilizer. This is done with a front end loader and manure spreader boxes on diesel trucks. Keeping the pens clean in this manner, also helps control the air and water pollution mentioned previously. (4) Noise, glare, fire, and/or other safety hazards will be very minimal or non-existent. (5) Traffic congestion will be no greater after completion than before. The feedlot is self contained as no equipment will have to leave the premises. The manure spreading equipment will use County roads to spread on adjacent owned farms as they have in previous years. There will be 2 manure spreading trucks, that will have to use no more than 1 mile of County road regard- less of the farm that is being spread. Other traffic congestion will come from cattle being hauled into and out of the feedlots. This would be a maximum of 3 loads of fats per day leaving the premises, and no more than that coming back in - 6 loads in and out per day maximum. Page 2 (C) Water will be supplied from an existing well pumping into a 100,000 gallon cistern for storage. The water will then gravity flow through a pipeline to the 7 new pens. The well has no adjudication or permit number because it was drilled before the laws were put in effect. This well was drilled sometime in the early 1950's, and is non-tributary water. It has a capability of 12 gallons per minute, and with the 100,000 gallons of storage, will be able to supply approximately a 12 to 2 day supply of water in case of any problems that should arise. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May 1978. Applicant shall be responsible for any additional directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division as appropriate. 2. Any discharge of water, to include irrigation, will warrant application for a NPDES permit. 3. Applicant shall be responsible for adhering to noise levels as stated in 25-12-103, C.R.S. 1973. 4. Any domestic septic system will require a permit from this office. 5. Applicant shall be responsible for adhering to the provisions of the Colorado Air Pollution Control Commission's Regulation No. 2. 6. Box 386 Ault, Colorado 80610 This is in answer to your request for soil and site information for feedlot expansion in the WZNW4 of Section 36, Twp. 7N, Range 65W. The area described is made up of two soil types. They are Otero sandy loam, 1 to 3 percent slope, (53-B) , and Shingle loam, 3 to 9 percent slope, (87B-CD). Otero sandy loam is a deep, well drained soil with a typical surface layer of brown sandy loam about 12 inches thick, underlain to a depth of 60 inches with a pale brown calcareous fine sandy loam. This soil has rapid permeability, slow surface runoff and low water erosion hazard. However, it is susceptable to wind erosion. The primary limiting factor that is exhibited for animal waste systems is the possible seepage from sewage lagoons that would contaminate ground waters. Shingle loam is a shallow, well drained soil formed from weathered shale. This soil has a typical surface layer of grayish brown loam about 6 inches thick. The underlying material is light yellowish brown clay loam about 12 inches thick. Depth to shale ranges from 10 to 20 inches. Permeability is moderate, with medium surface runoff and low water erosion hazard. The major limiting feature for use with animal waste collection facilities is the shallow depth to shale. Construction of waste lagoons may be hampered due to shallow depth and hardness of materials encountered. Seepage may be possible if the shale is fractured. If activity is planned on this soil, an on-site investigation should be made prior to construction to determine exact design requirements. It formed in materials weathered resi- dually from shale. Included in this unit are some small outcroppings of shale and sandstone. Typically the surface layer is grayish brown loam about 4 inches thick. The underlying material is light yellowish brown clay loam about 10 inches thick. Depth to shale ranges from 10 to 20 inches. Permeability is moderate. Available water capacity is low. Effective rooting depth is 10 to 20 inches. Surface runoff is medium to rapid and erosion hazard is moderate. The potential native vegetation on this soil is dominated by alkali sacaton, western wheatgrass and blue grama. Buffalograss , sideoats grama, needle-and-Lhiead , little bluestem, sedge , winterfat and fourwing saltbush are also present. Potential production ranges from 800 pounds per acre in favorable years to 500 pounds per acre in unfavorable years. When range condition deteriorates , the midgrasses decrease and production drops. Undesirable weeds and annuals invade the site as range condition • becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Western wheatgrass , blue grama alkali sacaton, sideoats grama, little bluestem, pubescent wheatgrass and - limgmaur alet•^n i- _—_ — - A • crested wheatgrass are suitable for seeding. The grass selected L ✓ should meet the seasonal requirements of livestock. For successful os: seeding, a clean, firm, sorghum stubble -- prepared the g growing season prior to planting -- or a firm, prepared seedbed and grass drill should be used. Early spring seeding has proven most successful. Windbreak and environmental plantings are generally not suited to this soil. On-site investigation is needed to determine if plantings are feasible. Rangeland wildlife , such as antelope , cottontail and coyote are best adapted for life on this soil. Forage production is typically low and proper livestock grazing management is necessary if livestock and wildlife share the range. Livestock watering facilities are also • important and are utilized by various wildlife species. It formed in mixed outwash and eolian deposits. Included in this unit are some soils with loam and clay loam under- lying material. Typically the surface layer is brown sandy loam about 12 inches thick. The underlying material, to a depth of 60 inches, is a pale brown cal- careous fine sandy loam. Permeability is rapid. Available water- capacity is moderate. -Effective rooting depth is 60 inches. or'more. Surface runoff is slow and erosion Chazard is low. This soil is used almost entirely for irrigation and is suited to all crops adapted to this area.- Some conservation practices such as land - leveling, ditch lining and pipelines may-be needed for proper water application.- - -- All methods of irrigation are suitable with furrow irrigation the most common type used. Barnyard manure and commercial fertilizers are needed for top yields along with maintaining good organic matter content. In nonirrigated areas this soil is suited to winter wheat, barley and sorghum. Most of the area is planted to winter wheat which is alter— nated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fertilizer.ik Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to control wind and water erosion. Terracing may also be needed to control water erosion. The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle and thread, switch- grass, sideoats grama and western wheatgrass are also prominent. Potential production ranges from 2200 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Trees that are best suited and have good survival are Rocky Mt. juniper, eastern redcedar, ponderosa pine, Siberian elm, Russian olive and hackberry. Shrubs best suited are skunkbush sumac, lilac and Siberian peashrub. Wildlife is an important secondary use, with these soils best suited for openland wildlife. Habitat favorable for ring-necked pheasants , mourning doves and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants, the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development. This is especially true in areas of intensive - agriculture. Rapid expansion of the Greeley and surrounding area has resulted in E( urbanization of much of this Otero soil. It has excellent potential for urban and recreational development. Its only limiting feature is the moderately rapid permeability in the substratum and the hazard of con- ___ tamination of ground water from sewage lagoons.
