HomeMy WebLinkAbout20101813.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000077 AGAINST EUGENE WATREN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Eugene Watren, ZCV#1000077, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of August, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Eugene Watren, property owner, was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 10, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance by removing the items associated with the construction business on the site, and for an additional inspection to be completed by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000077 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Eugene Watren to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until September 10, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance by removing the necessary items from the property. The majority of his properties might lay within the Floodway. Michelle Martin indicated she is seeking direction from Clay Kimmi. 07/26/2010 Telephone call Eugene Watren (303-918-2380) called. He said he received my Violation Hearing notification letter and was confused. He said he was doing everything he was supposed to. He explained that he had hired a Margaret Brown (Civil Engineer) to start a flood study. I asked what her time line was. He said he didn't know. I asked him to contact her to get her estimated time line for completion. I advised him that both Michelle and Heidi expected him to contact one of them to keep them in the loop as to what he was doing and where he was at in the process and since neither had heard from him, my next step in the Violation process was to schedule this hearing. I advised him that Michelle is schedule to be back in the office on Thursday, I will discuss the situation with her to seek her direction. (The legal description is Lot A RE-4226; Part SW4 of Section 31, T2N, R68W of the 6th P.M.) Background Information: The applicant currently stores some trailers on site in which he keeps the concrete forms on site. There may be potentially up to 10 employees associated with the business. In the future, the applicant intends to build a home on site. Public Works Staff informed the applicant that the site is located in a floodplain and possibly a floodway. The applicant will need to hire a civil engineer to determine where the floodway is. Staff suggested obtaining the following maps to help in determining where the floodway is: • Boulder County work maps and model for 1995 FIRM panel 08013C0435F(also, check with FEMA to see if it is available) • 1977 Kucera&Associates map which shows floodplain and floodway—maps available from CWCB website. No traffic study is required. Planning Department The site is currently in violation for storage of trailers and concrete forms. Staff advised the applicant to keep Bethany Salzman, Zoning Compliance Officer, informed of progress. Upon determination of floodway, staff suggested to meet another time to explain the USR process if the applicant wishes to move forward. The USR application fee is $2500.
