HomeMy WebLinkAbout760611.tiff RESOLUTION RE: EXEMPTION OF LAND TRANSFERRED BY ROBERT D. PFENNING FROM DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED LAND" . WHEREAS, the Board of County Commissioners, Weld County, Colorado, has reviewed the request of Robert D. Pfenning for an exemption of land to be transferred by him from the definition of "subdivision" and "subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended, and in Section 2-1 of the Weld County Subdivision Regulations, and WHEREAS, the Board finds that the contemplated transfer, an addition to an existing legal lot, does not conflict with the intent of the Weld County Comprehensive Plan and will not have an adverse impact on the existing use of the land, and WHEREAS, the Board has considered the recommendations of the Department of Planning Services on this matter. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners , Weld County, Colorado, that the addition of certain lands to an existing tract of land, being described as : A portion of the Southeast Quarter (SEi) of the Southeast Quarter (SEa) of Section 31, Township 7 North, Range 64 West, of the 6th P.M. , Weld County, Colorado, being irore particularly described as follows: Beginning at the South Fact (SE) corner of said Section 31 and considering the Fast line of said section as bearing North 00°00'00" West with all other bearing contained herein relative thereto; Thence North 00°00'00" West along the East line of said Section 170.00 feet Thence South 88°25'40" West a distance of 174.03 feet. Thence South 00°49'10" East a distance of 170.02 feet to a point on the South line of said section. Thence North 88°25'40" East to the point of beginning. Pfenning on a parcel of land located in the SE* of the SE* of Section 31, T7N, R64W of the 6th P.M. , Weld County, Colorado, containing 0.674 acres more or less. The pro- perty lies immediately in the northwest corner of County Roarls 51 and 74 at the community of Galeton. The 0.674 acre parcel is part of the abandoned Union Pacific ROW previously deeded to Mr. Pfenning fran the railroad. If has historic- ally boon utilized as a parking area for the Galeton Garage owned and operated by Glen Hill. Due to existing physical conditions and surround- ing land use, reversion of the 0.674 acre parcel to Agricultural use would not appear practicable nor feasible. Based on the information submitted and the policies and regulations of Weld County, the Planning Staff reca¢nends the request be approved for the following reasons: 1) The request complies with the Weld County Cd irehensive Plan, and the Intent clause of the Agricultural District in that non-productive agricultural land will be utilized; 2) Water and sewer is not required to the property; and 3) All required items have been submitted. By approval of the Subdivision Exemption, the Board has not granted any new zoning or approved extension of a non-conforming use. The activity WELD COUNTY COMMISSIONERS GLENN K.
