This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: The Town of Frederick has jurisdiction over this portion of WCR 18. The applicant will utilize the existing access to the property. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained • at a maximum height of 12 inches until the area is completely developed. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. According to the application, Central Weld County Water District (Account #108941) provides water for the two existing residences. Documentation was provided verifying that Central Weld County Water District is aware that there are two dwelling units being served by one meter. There are two septic systems located on the property; Permit SP-0000279 for the 3 bedroom home and Permit SE-0900027 for the one bedroom home. The septic permit for the one bedroom home is a "Statement of Existing" and is based on information • provided by the owner. This existing septic system was evaluated for adequate size and capacity on May 29, 2009. The results of that evaluation indicated that the 750 gallon septic tank is of sufficient size and capacity to handle the flow for the one bedroom home; however not enough information was available to determine if the field size is adequate. According to the proposal, the applicant is proposing to add a bedroom to the one bedroom home. The existing septic system (SE-0900027) will require an Individual Sewage Disposal System (ISDS) evaluation by Weld County Environmental Health Services to determine if it is adequately sized for the proposed hydraulic load. In order to properly evaluate the existing system, the applicant is required to provide an accurate drawing, which depicts sizing, type and location of the existing septic field, along with a soils evaluation to this Department. If the absorption field is undersized by more than 20 percent, this Department requires that the absorption field be brought into compliance with current ISDS Regulations. The existing septic tank meets the sizing requirements (within 250 gallons) for 2 bedrooms. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: • We recommend that the following requirements be met prior to allowing the plat to be • recorded: 1. Any additional hydraulic load to any existing septic system will require an I.S.D.S. Evaluation from the Weld County Department of Public Health & Environment. In the event the system(s) is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. 2. The applicant shall provide primary and secondary septic system envelopes for each existing and proposed septic system. A map depicting the location of the envelopes shall be provided to the Weld County Department of Public Health & Environment for review and approval. Once approved the envelopes shall be recorded on the final plat. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not • meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Any septic system located on the property must comply with all provisions of the Weld County Code pertaining to Individual Sewage Disposal Systems (Permit SP-0000279 and Permit SE-0900027). 7. A permanent, adequate water supply shall be provided for drinking and sanitary purposes (Central Weld County Water District). 8. Building permits shall be obtained prior to starting. Building plans drawn to scale shall be submitted for approval. A plan review is required for each building or structure for which a building permit is required. 2. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Residential Code; 2006 International Energy Code; 2008 National Electrical Code and Chapter 29 of the Weld County Code.
