SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW (USR)
QUESTIONNAIRE ANSWERS
1. Explain, in detail, the proposed use of the property.
ANSWER: This application is submitted byA&W Water Service, Inc. which owns the
subject parcel. A&W Water Service provides support services to approximately 200
mineral developers in Weld County and Colorado, including oil field water hauling, frac
tank rental, pipe storage and other related services. The subject USR will comprise
approximately 36 +/- acres of a 92-acre parcel owned by A&W Water Services, Inc. and
located where WCR 38.5 meets Highway 60. The parcel is not being farmed, is not
irrigated, and is nonprime agricultural land. Additionally, the proposed uses fit well with
four existing augmentation and recharge ponds currently located on the property which
support the supplying of water to agricultural users in Weld County. Accordingly, locating
the proposed uses on this parcel signifies diligent effort to conserve prime agricultural land.
In addition to the four ponds, currently on the parcel are two commercial water wells and
nine 20,000-gallon frac tanks used to supply water for oil and gas production, a vacant
residence, a 19' x 25' garage, a 32' x 80' barn with concrete foundation and with attached
covered concrete bay and two 20,000 gallon bins.
A&W Water Service's aims for the USR are to accommodate existing and future
needs in Weld County for oil and gas support services from a central location,
consolidating a variety of services for oil and gas production support at a single site with
• convenient access from Highway 60, rather than disburse such uses at different locations.
As described below, a well site provides water for use at oil fields. Slurry mix for use in
water at mineral production sites will also be available at this site. Pipe for use in the
mineral development industry will also be available at the site.
Accordingly, A&W Water Service is proposing the following uses at this site as a
means to help meet the growing demands for oil and gas development in Weld County:
Well Operation. The property has two permitted Ground Water Management
Subdistrict wells which pump into nine frac tanks for storage for hauling water to oil
development sites. Six additional tanks for water and slurry storage are anticipated at full
operation. Water tank trucks come to the site, fill their tanks, and then depart to various
mineral development sites to deliver the water.
Potash Facility. An existing enclosed 32' x 80' barn on the property is proposed for
the purpose of mixing potash or for supplying salt for oil field use, to be stored in up to two
20,000 gallon storage bins on the site for pick up and delivery of slurry mix to production
sites. Approximately six round trips per week are anticipated concerning this use.
Production Pipe and Equipment Storage Area. A 29.08( +/- )acre storage area for
mostly new, and some salvage, oil and gas production pipe is proposed, as well as for
production equipment and materials and empty storage tanks. New pipe will be received
• and stored until dispatched to a production location. Some used pipe will be received,
and stored until dispatched to a production location. Some used pipe will be received,
• inspected, graded and either stored for dispatch or for sale as scrap iron. The applicant
anticipates the use of up to three forklifts for moving, loading and unloading the pipe, which
will be stacked on the ground, minimizing visual impact to the surrounding property owners.
The storage yard will be screened along the east, north and west with berming and the
raised augmentation pond beds; along the south the yard will be screened with 6-foot high
chain link fence with opaque screening.
Office. The existing residence on the parcel will be used as an office until such time
as new office space may be constructed for on-site management. The garage will be used
for equipment storage.
2. Explain how this proposal is consistent with the intent of the Weld County
Code, Chapter 22 (Comprehensive Plan).
ANSWER: The Weld County Comprehensive Plan states that conversion of
agricultural land to urban residential, commercial and industrial uses will be encouraged
when the subject site is located inside an approved intergovernmental agreement area,
urban growth boundary area or Mixed Use Development area, urban development nodes,
or where adequate services are currently available or reasonably obtainable. As the USR
parcel is located in an area of transition from agricultural uses to other mixed uses, is
located near both Colorado Highway 60 and Highway 85, and adequate services are
• available to the parcel, the proposed use meets the goals of the Weld County
Comprehensive Plan to minimize disturbance to agricultural uses while encouraging the
development of oil and gas, which the Comprehensive Plan recognizes as an integral part
of the County's economy. A&W Water Service employs 108 people in Weld County, and
an additional 40 people work as contractors supporting A&W's operations. Additionally,
the proposed use pays its own way, as costs for improving the parcel consistent with the
proposed uses will be borne by the applicant, while revenue-generating activities will be in
place on the site.
This proposal is additionally consistent with Chapter 22 of the Weld county Code as
it is in a somewhat isolated and protected location; has good vehicle access; does not
interfere with agricultural uses; is suitable for the land; facilitates Weld County business
and the production of taxes and revenue within the County; is appropriately located in
terms of surrounding uses; minimizes interference with rural settlement patterns and
existing residential communities; is compatible with existing and future land uses;
appropriate infrastructure is available to provide adequate access, and the use will be in
compliance with all Federal, State and County statutes, regulations and ordinances. As
the site will support goals for meeting the growing needs for support services to oil and gas
development in Weld County, with conformance of the site to reasonable requirements of
Weld County and the State of Colorado and other applicable governing bodies, the
proposed use adequately provides for the protection of the health, safety and welfare of the
surrounding neighborhood and the inhabitants of Weld County.

3. Explain how this proposal is consistent with the intent of the Weld County
• Code, Chapter 23 (Zoning) and the zone district in which it is located.
ANSWER: The Weld County Code provides for this type of use to be by special
review in the Agricultural Zone. (Weld County Code Sec. 23-3-40.A.2 and 23-3-40.R)
4. What type of uses surround the site? Explain how the proposed use is
consistent with and compatible with surrounding land use.
ANSWER: The parcel abuts Highway 60 and is located approximately 5,000 feet
from Highway 85. Agricultural, commercial, industrial, and rural residential uses surround
the site. A sand and gravel operation (Platte Sand and Gravel) is located approximately 1/2
mile south and 2 miles west of the property. Property directly to the south is permitted for
Oil and Gas Support and Service (storage of pipe and production equipment, Noble
Energy, USR 1662). There is a gas compression station across Highway 60 from the
parcel, as well as nearby residential and agricultural uses to the east, north and west. A
commercial sod farm operates about a half mile to the south along Highway 60, and south
of that is a storage area for highway maintenance material such as magnesium chloride.
Just north of the parcel (about a quarter-mile east of highway 60 on WCR 40), is an oil and
gas equipment shop.
5. Describe, in detail, the following:
• a. How many people will use this site?
ANSWER:
Well Operation: At maximum capacity use, up to approximately 90 people
will visit the site per day, on average.
Pipe Storage: At maximum capacity use, approximately up to 20
additional people will visit the site per day, on average. Up to 5 employees will be
stationed at this site per day.
Potash Facility: Approximately six additional people will visit the site per
week, on average. One employee will be stationed at the site per day.
Office: The office will accommodate up to seven people (including those five
employees indicated at the storage yard).
b. How many employees are proposed to be employed at this site?
• ANSWER: A maximum of seven employees.

• c. What are the hours of operation?
ANSWER: The site will be open 7 days per week. Most traffic to the site
will be generally from 6:00 a.m. to 8:00 p.m. Oil field demands may cause some truck
traffic to shift access to the site for the well operation to between the hours of 8:00 p.m.
and 6:00 a.m., and the water wells will operate 24 hours per day.
d. What type and how many structures will be erected (built) on this site?
ANSWER:
Well Operation: In addition to the existing items (two wells, nine 20,000-
gallon portable tanks, three electric pumps) six additional portable tanks will be added for
maximum operation capacity.
Pipe Storage yard: no structures are required.
Pot Ash Facility: The existing 32' x 80' barn will be used for potash mixing.
Two 20,000-gallon bins will be on the site for storing the potash or salt.
• Office: The existing residence will be used as office space until such time as
a new office may be constructed for on-site management .
e. What type and how many animals, if any will be on this site?
ANSWER: None
f. What kind (type, size, weight) of vehicles will access this site and how
often?
ANSWER:
Well Operation: This use will be serviced by 80,000 - 85,000 lb tractor trailors.
Existing traffic to the site for 2009 is estimated to be, on average, 75 round trips to the site
per day. Site visits fluctuate according to market requirements; at maximum potential
operation, there may be, on average, approximately up to 90 round trips to the site per day
(90 trips in, and 90 trips out). Trucks will generally be on the site for periods of 30 minutes,
the time it takes to fill the truck tanks.
Pipe Storage yard: This use will involve a maximum average of 20 tractor trailers
(80,000-85,000 lb) daily trips to the site for delivery and/or pickup of pipe for use in mineral
development. As well, up to two forklifts will be maintained at the site for moving and
• loading, unloading, moving and stacking the pipe.

• Pot Ash Facility:At maximum anticipated use, this use will involve 80,000-85,000 lb
tractor trailer trucks accessing the site at an average rate of six round trips per week, in
addition to the other proposed uses on the site.
Office: At maximum anticipated use, this use will involve seven passenger vehicles
per day on average, including employees and office visitors to the site.
Subject to the requirements of CDOT and Weld County, the traffic will enter and exit
the site from/to the south or the north on Highway 60, using the existing 40-foot wide
access designated on the plat. .
Haul Routes:
No specific haul routes can be designated, as the truck traffic approaches and
leaves the site to and from various destinations. However, trucks are strongly advised not
to make use of WCR 38 '/2 to and from the site. Most truck traffic will access and leave the
site as follows:
From and to the south: Highway 60 to Highway 85
From and to the north: Highway 60, with use of County road 40 east of Highway 60.
Traffic to and from nearby destination points will make reasonable use of county
roads
g. Who will provide fire protection to the site?
ANSWER: Platteville/Gilcrest Fire Protection District
Fire protection plan: Water storage or facilities are proposed in accordance
with the fire authority's requirements and guidance.
h. What is the water source on the property? (Both domestic and irrigation).
ANSWER: Domestic: Central Weld County Water District has indicated
that domestic water service is available for the site. See letter, enclosed.
Additionally, there are two permitted GWMS Wells for the Well Operation. (Attached).
Irrigation: n/a
i. What is the sewage disposal system on the property? (Existing and
proposed).
ANSWER: Applicant will obtain a septic permit for an ISDS pursuant to the requirements
• of Weld County.

• j. If storage or warehousing is proposed, what type of items will be stored?
ANSWER:
Water will be stored in up to fourteen 20,000-gallon frac tanks on the well
operation site; one additional 20,000-gallon tank will contain potash slurry ("KCL").
Up to two 20,000-gallon storage bins will be on the site to store potash or
salt.
Maintenance equipment, pumps and pipes will also be stored.
Production pipe, storage tanks and equipment will be stored in the pipe
storage yard.
The garage will store equipment.
6. Explain the proposed landscaping for the site. The landscaping shall be
separately submitted as a landscape plan map as part of the application
submittal.
• ANSWER: The augmentation and recharge ponds on the parcel are
elevated and, along with the natural contours of the parcel, serve to screen much of the
site activity from surrounding areas. Additionally, the property will be bermed along the
east, shielding the uses from the highway traffic and properties to the east. A 6'foot high
opaque-screened fence will serve as screening on the south side of the parcel.
Otherwise, the property's existing natural grasses will serve as landscaping in areas
surrounding the USR activity. The landscaping plan is detailed on the site map submitted
with this application.
7. Explain any proposed reclamation procedures when termination of the Use
by Special Review activity occurs.
ANSWER: The proposed uses will have little impact on the land. In the
unlikely event that the uses are terminated, USR improvements, except the residence,
office, garage, the barns and the water wells, would be removed from the property, and the
parcel would be reasonably restored to its condition prior to the USR, with native grasses
planted where the USR activity on the parcel has occurred. It is anticipated that future
other use of the residence, office, garage, the barn and the water wells would remain on
the parcel for other allowable uses.
• 8. Explain how the storm water drainage will be handled on the site.

ANSWER: A drainage plan is being supplied with this application.
• 9. Explain how long it will take to construct this site and when construction and
landscaping is scheduled to begin.
ANSWER:
Well Operation: No construction is required for this use. (Six additional portable frac tanks
will be placed at the site within two years of approval.)
Pipe storage yard: No construction for this area is anticipated for this use.
Potash Mixing Facility: No construction is anticipated for this use.
Office: The existing residence on the parcel will be used until such time as a new office
may be constructed
Landscaping is anticipated to commence within 180 days from the date of recording the
final plat. Construction of the fence is anticipated to commence within 180 days from
commencing use of the pipe storage yard.
• 10. Explain where storage and/or stockpile of wastes will occur on this site.
ANSWER:
Well Operation: No storage or stockpile of wastes will occur associated with this use.
Pipe Storage Yard: No onsite storage or stockpile of wastes will occur with this use
Potash Mixing Facility: No storage or stockpile of wastes will occur with this use
Office: No storage or stockpile of wastes will occur associated with this use. (Trash pickup
will occur on a weekly basis).
11. Mineral Owners
Certification of notice to mineral interest owners will be submitted as required by C.R.S.
Sec. 24-65.5-103.3. The site plan design adequately incorporates mineral development
activities into the plan as the improvements are located so as not to interfere with drilling
windows and there is ample access on the site for such activities. Applicant is in contact
with the mineral developers on the parcel and is finalizing agreements. Specifically, the
• proposed site plan has been amended to adequately mitigate the stated concerns of the
mineral developers.
• 12. Lighting
There are two existing 25-foot high pole lights on the property (one at the commercial well
operation, and one yard-light in the potash mixing/office area). The office will be lit by
exterior lighting affixed to the building. Two security lights will be installed at the south gate.
All such lighting will be shielded and directed in a manner to prevent any direct glare upon
the adjacent properties which would interfere with the use of those properties, as required
by the Weld County Code.
13. Signage
One existing sign is on the site as directing truck traffic to avoid using WCR 38.5. The sign
is approximately 24" x 28" and the bottom of the pole-mounted sign is approximately 6' off
the ground. A photo of the sign is enclosed with this application. No other signage is
proposed.

A&W WATER HIGHWAY 60 SITE USR
WELD COUNTY,COLORADO
1.0 GENERAL LOCATION AND DESCRIPTION
The proposed A&W Water Highway 60 development is located in a portion of the east half of
Section 31,Township 4 North, Range 66 West of the 6th Principal Meridian,County of Weld,
State of Colorado. More specifically,the site is located on the west side of State Highway 60
between County Road 38 and 40 and is under the jurisdiction of Weld County. The USR site
boundary consists of approximately 36 acres of undeveloped grassland,an existing house and
barn,and existing oil and gas well and tanks. The Farmers Independent Ditch lies northwest of
the USR boundary, along with three(3)Central Weld Water District water reclamation ponds.
The existing topography generally slopes from west to northeast across the proposed site. The
hydrologic soil type for this site is A.
The proposed development of the site will consist of new construction of a potash mixing facility
and office area,a concrete washout area,reverse osmosis area,future pipe and equipment storage
area,and the construction of a fence and berm for screening. Due to the extremely flat slopes,
and existing low points on the site,a stormwater retention pond is proposed in the northern
portion of the future pipe and equipment storage area to control stormwater discharge quantity
and quality.

2.0 DRAINAGE BASINS AND SUB BASINS
A. MAJOR BASIN DESCRIPTION
The proposed site is not located within any existing Weld County Master Drainage basins or
areas. There are no floodplains located within the property boundaries. The site's relative
flood hazard rating is Area C—minimal flooding and is mapped on FIRM Community Panel
No. 080266 0750 C. A F1 RMette on the site has been included in Appendix D. Runoff from
the major basin in this area generally sheet flows from southwest to northeast and releases
into the South Platte River. The soils in this area are mainly sandy loams that drain well.
SUB-BASIN DESCRIPTION
The historic drainage pattern for the proposed site is primarily overland flow from the
west/southwest corner to the northeast corner of the USR site. An existing low point on the
site captures a portion of the site's nmoff prior to its being released into the borrow ditch
located along the west side of State Highway 60. The ditch runs to the north along Highway
60 to the South Platte River.
The USR site is surrounded on the west and north by the existing Farmers Independent Ditch
and three(3)Central Weld water reclamation ponds that either capture or re-direct any off-
site runoff away from the site. Therefore,no off-site runoff flows impact this site.

• 3.0 DRAINAGE DESIGN CRITERIA
The drainage design criteria were taken from the"Urban Drainage Storm Criteria Manual,
Volumes 1, 2 and 3"and the"Weld County Storm Drainage Criteria Addendum to the Urban
Drainage Storm Criteria Manual, Volumes 1, 2 and 3". Since all basins were less than 160 acres
in area, all flows were calculated using the Rational Method. The 5-year, 10-year, and 100-year
events were used to calculate runoff quantities. Runoff quantities for the historic(prior to any
land use),existing(current land uses)and proposed(after development)site conditions were
calculated. Values for runoff coefficients(C)were taken from the Urban Drainage Manual
based on the soil type and proposed land use. To determine rainfall intensities(I),the site lies
within Zone 1: South Platte,Republican,Arkansas and Cimarron River Basins. Platteville area
Time-Intensity-Frequency curves were used to determine specific rainfall intensities from the
corresponding time of concentrations.
The USR site is characterized by shallow slopes that generally run from the west/southwest to a
low point located near the northeast corner of the site. Flows that overtop this low point sheet
flow into the west side borrow ditch along Highway 60 that carries the flows north to eventually
release into the South Platte River. Due to the existing low point and the lack of any nearby
storm drainage facilities to gravity drain any below grade storm detention pond,a stormwater
retention facility is the only viable option to provide the required storm runoff control pond.
This facility would be below grade and will be sized to contain 1.5 times the 100 year,24 hour
storm event,and to drain within 72 hours per State law. The required retention pond volume will
be determined using the Modified FAA Method as described in the Urban Drainage Manual.

Temporary sediment/erosion control BMP's will be utilized on the site during construction. A
silt fence will be placed along the toe of any fill slopes. Vehicle tracking control pads will be
placed at the main entrance of the site. The retention pond will serve as a temporary sediment
pond until the permanent site re-vegetation is established. After that,the pond will serve as a 7

A variance is requested from the Weld County Code(Chapter 8—Public Works,Article XI-
Strom Drainage Criteria, Division 1 —General Provisions, Section 8-1140—Weld County
Addendum to Text of the Urban Storm Drainage Criteria—Volume 2, Chapter 10—Storage,
Section 3.3.4—Retention Facilities)to allow the site to use a below grade retention facility as the
permanent solution to control the storm drainage runoff developed from the USR site. The use
of a standard below grade detention pond is prohibited due to the existing shallow slopes,the
existing low point located on the site,and the lack of any nearby underground storm drainage
facilities to use for gravity draining the pond. The retention pond has been sized to meet the
criteria in the Weld County Code(150%of the 100-year,24-hour storm event)and drain within
72 hours. A geotechnical investigation that shows the pond will drain within 72 hours is
included with this submittal.

• 4.0 DRAINAGE FACILITY DESIGN
Historically,the storm runoff sheet flowed across the site from the west/southwest to the
northeast corner of the site. The runoff flows from the site were collected by the borrow ditch
along Highway 60 and directed to the South Platte River. The calculated historic runoff flows
are as follows:
5-Year Historic 0.28 cfs
10-Year Historic 2.32 cfs
100-Year Historic 11.57 cfs
The proposed USR site was divided into two major basins(Basins A&B). Basin A is located in
the southeast corner of the site and its existing land use consists of a house, barn and gravel
parking and driving area. The proposed development within the basin will consist of the additigg
of a modular office building,while keeping the existing house,barn andearking and ' 9rik`'e
driving areas. The runoff from Basin A sheet flows to the northeast corner of the basin and will
be released into an existing 12"CMP pipe that flows into an existing borrow ditch along State
Highway 60, ultimately releasing to the South Platte River. Due to the minor change between
the proposed and existing land uses,the difference between the existing and proposed runoff

• The rest of the USR site is covered by Basin B. The existing land uses in Basin B consist mainly'Jilt It kay
of natural grasses and a small portion of gravel. The existing runoff from the basin sheet flows ,b
from west/southwest across the site to the northeast where it is released into the borrow ditch �3 tit'C+
along Highway 60. The proposed development in Basin B will add the Reverse Osmosis facility,
the washout area,the commercial well operation,and a future pipe and equipment storage area.
These developed areas will be covered by gravel or left covered by the existing natural grasses.
The existing berm located in the northeast corner of the basin will be extended south along
Hi wa 60 and will block any runoff from releasing into the borrow ditches. This runoff will
7 be retained in a below•y oun' e lion pond that will be located along the northern portion of

Basin B. The required storage volume for the 100-year,24-hour event was calculated as 195,496
cu. ft. The pond will be constructed to hold at least 150%of that volume(293,244 cu. ft.)and to
drain within 72 hours. The bottom of the proposed pond shown on the drainage plan will have a
surface area of 203,650 sq. ft.deep at 1.44 feet deep. This will provide a ponding volume of
293,250 cu.ft. The pond is also located such that if it were to overflow,it will not flood any

5.0 CONCLUSIONS
• In conclusion,the proposed development of the A&W Highway 60 Site USR will not adversely
affect the existing drainage facilities or drainage patterns surrounding the site. The drainage
design for the A&W Water site complies with the criteria as noted in the"Urban Drainage
Storm Criteria Manual, Volumes 1, 2 and 3" and the"Weld County Storm Drainage Criteria
Addendum to the Urban Drainage Storm Criteria Manual, Volumes 1, 2 and 3". Due to existing
site constants as noted in this report, a variance is requested to allow the use of a below g&eaS grbdt
retention pond to provide control of the developed runoff flows from the site. With the use of
the retention pond,the overall 100 year runoff flow released from the site into the borrow ditch
along Highway 60 will be reduced. After development,the runoff flows that reach the borrow
ditch,compared to the historic and existing flows are as follows:

This is to advise of the status of A&W Water Service, Inc.'s negotiations with Kerr McGee (a
subsidiary of Anadarko) concerning the above-referenced parcel and the proposed USR application.
• In early December, A&W and Kerr McGee commenced discussions concerning the proposed
USR application as was initially submitted to Weld County for consideration November 18, 2008. Based
on the USR proposal, Kerr McGee, represented by Mr. Terry Enright and Keith Crouch, Esq., indicated
• some concerns about the proposed new berm along the east side of the parcel for screening purposes
and the existing oil and gas road running south from the Secondary Access (as denoted on the plat)
along the east side of the parcel.
The parties held a telephone meeting in early January, and, after subsequent discussions, the
proposed plat has been amended to address the stated concerns of Kerr McGee as relates to the
planned USR activity. Specifically, the berm was re-configured and the planned access into the parcel
from the Primary Access (north leading into the proposed Reverse Osmosis area) has been amended to
allow for a joint access and oil and gas road, abandoning the existing oil and gas road running south from
the Secondary Access along the east side of the parcel.
The parties continue to negotiate to finalize a Surface Use Agreement. Another meeting is
planned for this Wednesday, February 25.

• It was good to talk to you on the phone today. As I mentioned, this firm represents
A&W Water Service, Inc. in connection with making application for Use By Special Review
Permit with Weld County. In addition to the existing water well operation, A&W proposes
to be permitted to add a pipe storage yard, a reverse osmosis facility, a truck washout
facility area, and to make use of an existing barn for potash mixing and the existing
farmhouse for an office, with the possibility of constructing a new office in the future. In
addition to the site activities, A&W is proposing to extend the berm along the east
boundary of the parcel south to the office/potash plant area, and to abandon that portion of
the oil and gas road on the east side of the parcel running south from the "Secondary
Access" off Highway 60 which services the Wolf UPRR 42-31 well, tank batteries, well
separators, and gas well burners immediately north of the proposed washout area on the
site plan.
I am enclosing for your consideration a copy of the draft site plan which shows
where the proposed activities are intended at this time. As well,Anadarko has provided us
their calculated overlay of the drilling windows on the parcel, and I am including that for
your convenience, as well.
If Monago agrees that the proposal does not interfere with access to or use of the oil
and gas development activities on the site, we would appreciate correspondence from
Monogo indicating that there is no objection to the proposal. If there are questions

Regarding Property at HWY 60 and County Rd 38.5
A& W Water is applying for an USR with Weld County for changing the use of property
at the Corner of State HWY 60 and County Rd 38.5. At present A& W Water operates a
Commercial water well at this site which is used for oilfield use. A & W Water is
applying for a change of use from Weld County to add the following.
• Oilfield pipe storage yard to store new and used pipe
• Reverse Osmosis facility to clean up oilfield produce water to reuse
• • A washout area for cleaning of frac tanks
• Mixing facility to blend potash and water to create a slurry for oilfield use
FIDCO's lateral is the western and northern boundary of the property. A & W Water will
not be crossing or interfering with FIDCO's ditch. We plan in the future as we have in the
past to be a good neighbor with the ditch company.
Attached are the proposed site and drainage plats and preliminary drainage reports for the
future site plans with the facilities shown. If you have any questions please give me a call
