Environmental Health Services has reviewed this proposal for storage of construction
materials such as doors and door frames. Water will be provided by an individual
domestic well (permit 277840). A septic permit, for a five bedroom residence, has been
issued (permit SP-0800111) but has not been installed.
As there are no employees, which would increase the hydraulic load, an engineer's
evaluation of the septic system design will not be required. However, an individual
sewage disposal system will be required, in conjunction with this application, since the
applicant comes to the site several times a week for material deliveries. If the residence
will not be constructed immediately the applicant could add a restroom to the existing
building and connect the house to the septic system at a later time. All requirements of
• the Building Department would be necessary.
A minimal dust abatement plan will be required for on site dust. The plan should include
items such as a reduced speed limit and watering, as necessary. If the domestic well
permit will not allow watering in association with the construction storage, outside water
may be brought in via a cistern or water truck.
A waste handling plan is required to ensure materials are disposed of properly. The
name, address and phone number of the company that will be responsible for removing
the waste shall be included in the waste handling plan.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.

2. An individual sewage disposal system is required for the proposed site and shall
• be installed according to the Weld County Individual Sewage Disposal
Regulations.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
• contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.

7. Sewage disposal for the facility shall be by septic system. Any septic system
• located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
9. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
10.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. Comments made during this phase of
the process may not be all-inclusive, as other concerns or issues may arise during the remaining application
process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
Weld County Strategic Roadway: (December 2002) WCR 49 is classified by the County is a Strategic
Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
(23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24, 27,
37, 49 and 74)
WCR 6 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.

Storm Water Drainage:
The historical flow patterns and runoff amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
Please provide calculations for water quality capture area and location on plan.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Upon review of my case files and computer, an active Zoning Violation(ZCV08-00360)was noted. This
violation was initiated due to the commercial storage and operations related to Sierra Detention Systems
without first obtaining the necessary Weld County Zoning Permits. This case has not yet been presented
to the Board of County Commissioners through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
remove all commercial storage and operations from the property.

There is one (1) historical building permits attached to this parcel, 5000 sq ft pole frame, it has been

1. A building permit shall be obtained prior to the change of use, or construction of any new
structures
2. A plan review is required for each building for which a building permit is required. Two
• complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld

The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of the
Weld County Code. In addition to these requirements, the plat scale shall be 1" = 40 feet. The
Vicinity Map scale of 1" = 2000 feet scale accurately be delineated on the plat.
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
Section 23-3-250.A.5.A
• Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not
be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was a schematic
Landscape Plan submitted with the application materials. The applicant shall provide additional
documentation including all proposed fencing, lighting, adjacent property screening and
landscape treatment to meet this section of the Weld County Code.
Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the lot.
Driveways may pass through the required landscaped areas. Additional information is requested
as to the proposed evergreen tree plantings and the method of the installing the seed on all
disturbed areas. Further, staff requests information on the proposed seed mix, installation
methods of the seed and irrigation provided to ensure good initial year growth the newly installed
plant materials. It is uncertain how this is accomplished. Please provide additional comment.
Section 23-3-250.A.6
Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials did not identify the location of the dumpster on
the plat. Future submittals shall address this issue as outlined in this Section of the Code.
Written evidence of compliance shall be submitted to the Department of Planning Services.

Outside Storage. Uses involving outdoor of materials shall be screened from public rights-of-way
and all adjacent properties. The applicant shall submit documentation as to how the outside
storage will be screened during the construction period, and for periods thereafter, as applicable.
Section 23-3-350.B.
Operation Standards. Uses shall demonstrate conformance with the following operation
standards to the extent that they are affected by location, layout and design prior to construction
and operation.
Section 23-2-250.6.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the following
standards: sources of light shall be shielded so that beams or rays of light will not shine directly
onto adjacent properties; neither the direct nor reflected light from any light source may create a
traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may
be used which may be confused with or construed as traffic control devices. The application
materials did not include a Lighting Plan. Should exterior lighting be a part of this facility, all light
standards shall be delineated on the USR Plat.
Section 23-2-250.B.7
Property Maintenance. Property shall be maintained in such a manner that grasses and weeds
are not permitted to grow taller than twelve (12) inches. In no event shall the property owners
allow the growth of noxious weeds. The application materials do not address property
maintenance. Future correspondence shall identify how the property will be in compliance with
this Section of the County Code.
Section 23-4-50.
Off Street Loading. The applicant shall delineate on the plat the location of the loading zone that
is in compliance with this Section of the Code. There shall be no parking or staging of trucks
within the public rights-of way. Further, the applicant shall meet all requirements of the
Department of Public Works concerning access and internal circulation of vehicles for this
proposed facility.
Section 23-4-90
Signs. The application materials did not address the issue of on-site signs. The applicant shall
provide written evidence that all proposed signs are in compliance with this section of the Code.

Dear Ms. Hatch:
This referral does not appear to qualify as a "subdivision"as defined in Section 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors,
this office will only perform a cursory review of the referral information and provide comments. The comments
do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used
to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical
availability of water.
According to the referral information the operation will be served by an existing domestic well, however
no well permit number was provided. The State Engineer's Office records show that the well permit number for
• the property is 277840.
Well permit no. 277840 was issued on June 16, 2008 pursuant to CRS 37-92-602(3)(b)(II)(A) as the
only well on a tract of land of 75.46 acres described as that portion of the E1/2 of the NE1/4 of Section 25,
Township 1 North, Range 65 West of the 6'h P.M. The use of ground water from this well is limited to fire
protection, ordinary household purposes inside not more than three (3) single family dwellings, the watering of
poultry, domestic animals and livestock on a farm or ranch and the irrigation of not more than one (1) acre of
home gardens and lawns. Well permit no. 277840 was permitted for a well to be constructed into the not non-
tributary Upper Arapahoe aquifer. According to our records well permit no. 277840 has not been constructed,
however the expiration date on this permit is June 16, 2010.
Based on the information provided, the proposed storage of construction materials plan will not employ
any people at this site and there will be no customers using the site. As long as the proposed development will
be operated solely by the property owner, this office has no objection to use well permit no. 277840 to supply
the property for the permitted uses. However, if the proposed storage of the construction materials will employ
people or there will be customers using the site, we will view this as a commercial business and well permit no.
277840 cannot be used to supply water to a commercial business on the property. If the well will be used to
supply a commercial business, the Applicant will need to obtain a well permit for commercial use. The ability for
this lot to obtain a commercial well permit would be evaluated at the time that a well permit application is
submitted.
